A RESOLUTION: PRESENTED: March 9, 2004 2004-31 ADOPTED: March 9, 2004 APPROVING SPECIAL EXCEPTION #SE 2003-06, COSTCO TIRE CENTER, 1300 EDWARDS FERRY ROAD, N.E., TO PERMIT A FOUR-BAY AUTOMOBILE TIRE INSTALLATION SERVICE CENTER WHEREAS, Costco Wholesale Corporation has requested special exception approval to amend existing Board of Zoning Appeals Special Exception #88-167 to permit the relocation of a freestanding vehicle service center (tire installation facility) from a pad location to the main Costco building at the Battlefield Marketplace Shopping Center; and WHEREAS, the property is located in the B-3 Community Retail/Commercial Zoning District; and WHEREAS, on December 4, 2003, the Planning Commission recommended conditional approval of this application; and WHEREAS, on February 24, 2004, the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for an automobile service facility as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: Special Exception application #SE 2003-06, Costco Tire Center, 1300 Edwards Ferry Road, N.E., identified in the Loudoun County Land Records as Parcel Identification Number 147-45-2905, is hereby approved subject to the following conditions: 1. No outside sales and/or displays shall be permitted. -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION #SE 2003-06, COSTCO TIRE CENTER, 1300 EDWARDS FERRY ROAD, N.E. 2. No outdoor service shall be permitted. All service work shall be conducted indoors within the service bay areas. 3. No outdoor storage of tires shall be permitted. All storage shall be conducted within an enclosed area; it shall be out of view, and in a manner that will not provide a harborage for insects and/or pests. 4. Hours of operation of the Tire Center shall not exceed the hours of operation of the Costco store. 5. The Tire Center square-foot area (2,600 square feet) shall count against the cumulative total square-foot area allowed for freestanding special exception uses, (46,889 square feet). 6. The use of outdoor speakers and/or paging systems shall be prohibited. 7. The Tire Center square-foot area (2,600 square feet) shall count against the cumulative total square-foot area allowed for special exception uses, freestanding and non- freestanding, (175,000 square feet). 8. The Applicant agrees to install an S3-C bufferyard along the northern property boundary with the Edwards Landing residential development in accordance with recommendations of the Town Arborist. White pines and American holly will be exchanged for Green Giant arborvitae and Nellie Stevens holly or a comparable hardy holly. Evergreen trees will be at least seven (7) to eight (8) feet tall at time of installation. 9. The Applicant agrees to construct a masonry wall along the length of the loading dock. Such wall shall be at least thirteen feet four inches (13'4") in height constructed with the same materials and colors as the main Costco building. 10. The Applicant agrees that freestanding lighting standards in the parking lot in the vicinity of the northern property boundary will not exceed twenty (20) feet in height. Pole fixtures shall be shielded so that the source of illumination is not visible from adjoining properties. Light bulb wattages shall not exceed 400 watts. Illumination levels at the property boundary shall not exceed 0.5 foot-candles as per DCSM 7-670 and as shown on the T.E. Inc. Photometrics Plan (Page SE-l) revised dated November 11, 2003. 11. The Applicant agrees to construct a masonry enclosure of the trash compactor. Such enclosure walls shall be at least eight feet four inches (8'4") in height, and shall be constructed of the same materials and colors used on the main Costco building. The enclosure will include an opaque gate of similar color and height. 12. The Applicant agrees to construct an opaque, beige-colored, flat-finished, vinyl, tongue and groove fence, eight (8) feet tall along the northern edge of the parking facility closest to the Edwards Landing residential development in accordance with the detail sheet attached to this memorandum. There shall be at least two gates to allow access for maintenance purposes to the buffer plantings on the north side of the fence. 13. Development of this special exception use shall be in substantial conformance with the plat entitled "Special Exception Plat - Battlefield Marketplace" dated August 17, 2003 prepared by Huntley, Nyce & Associates, Ltd., and as modified by these conditions. 14. Compliance with the above-stated conditions shall be complete prior to issuance of any occupancy permit for the Costco store. The required bufferyard and fence to be installed along the northern-most boundary of the site may be modified as necessary in order to incorporate an earthen berm reviewed and approved in accordance with applicable Town requirements. Incorporation of any such berm shall not express or imply the waiver of any required landscape buffer or fencing on the site. 16. Approval of this special exception application does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, Zoning Ordinance, or Design and Construction Standards Manual, and that final plats, development plans and construction drawings are subject to the applicable town regulations.
