APPROVING SPECIAL EXCEPTION #SE 2002-07, STAR PONTIAC, BUICK
& GMC, 326 E. MARKET STREET
WHEREAS, Mr. Ray Martin Glembot, has requested special exception approval to permit the
expansion of the existing vehicle sales, service and storage use at 326 E. Market Street; and
WHEREAS, the property is located in the B-2 (Established Corridor Commercial) District, and
H-2 (Historic Corridor Overlay) District; and
WHEREAS, on December 4, 2003, the Planning Commission recommended conditional approval
of this application; and
WHEREAS, on February 24, 2004, the Town Council held a public hearing; and
WHEREAS, the proposed use is in conformance with the special exception general review
criteria for special exceptions, as set forth in the Zoning Ordinance; and
WHEREAS, staff recommends approval, with the conditions set forth below.
THEREFORE RESOLVED by the Town Council of Leesburg, Virginia as follows: Special
Exception application #SE 2002-07, Star Pontiac, Buick & GMC, 326 E. Market Street, identified in the
Loudoun County Land Records with Parcel Identification Number 231-20-3384, is hereby approved
subject to the following conditions:
1. No Waivers. Approval of this special exception does not express or imply any waiver or
modification of the requirements set forth in the Subdivision and Land Development
Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual,
and that final plats, development plans, and construction drawings are subject to the
applicable town regulations.
2. Stormwater Management. The applicant shall comply with the Loudoun County storm
water management criteria, including BMPs, prior to approval of the final development
plan.
3. B.A.R. Review. All structures to be built on-site, including the style of lighting fixtures,
signage, and fencing is to be approved by the Board of Architectural Review (B.A.R.) in
accordance with the H-2 Overlay District requirements prior to final development plan
approval. As set forth in Zoning Ordinance Section 7.6.7.D., design of the dealership

building must incorporate sufficient architectural complexity in terms of design, line,
mass, dimension, color, material, texture, lighting, roof line and height to conform to
accepted architectural principles for permanent buildings reflecting the traditional
character of Leesburg. The Council urges the B.A.R. to consider the importance of this
site as a gateway to Dodona Manor and the Old and Historic District.
Hours of Operation. The hours of operation for vehicle sales shall be restricted to 9:00
a.m. to 9:00 p.m., Monday through Friday and from 9:00 a.m. to 6:00 p.m., Saturday.
Auto service shall be restricted to 7:00 a.m. to 5:00 p.m., Monday through Friday and
7:00 a.m. to 1:00 p.m., Saturday.
5. Site Lighting Hours. Site lighting shall be in use from dusk till 9:30 p.m., except for
security lighting.
6. No Outside Loudspeakers. No outside loudspeakers shall be permitted onsite.
7. Deliveries. Delivery of all vehicles and supplies/materials to the site shall be performed
onsite in the designated loading space.
Substantial Conformance. Development of this special exception use shall be in
substantial conformance with the Special Exception Plat dated October 2002 and revised
through March 9, 2004 entitled "Special Exception Plat - Star Pontiac, Buick, GMC",
Sheets 1-3, prepared by Bowers & Associates, Ltd., and the plat dated October 2002 and
revised through March 9, 2004 entitled "Special Design Exhibit - Star Pontiac, Buick,
GMC", Sheets 1'-2, prepared by Bowers & Associates.

Landscape Buffer on Northem Property_ Line. Landscaping and screening along the
northern property line adjacent to the residential use shall consist of an 8' wood board on
board fence with buffer yard plantings as shown on the Special Exception Plat and the
Special Design Exhibit referenced above.
