HILLSBOROUGH PLANNING BOARD
OCTOBER 25, 1983
The Hillsborough Town Board and the Hillsborough Planning Board met in special
session on Tuesday, October 25, 1983, 7:00 P.M. at the Hillsborough Town Hall Complex
for the purpose of holding a quarterly public hearing to consider rezoning requests
and an amendment to the Minimun Housing Code.
Those present were Mayor Protem Allen Lloyd, Commissioners Martin, Brown, Smith
and Stevens. Planning Board members present were Chairman Frank Sheffield, members,
Martin, Cox. Brody, Goodwin, Murphy, and Dorward. Others present were Dry Philp
Singer, Betty Martin, Tom Dula, L. Dula, Keith McNeil, Leona Hester, Lila Craven,
Mary Vicks, Tommy and Sharon Burel, Herman Craven, Robert Rhyne, Mazzy Morgan,
Pauline Parker, William Parker, Joanna Parker, Calvin and Gertrude Ashley, Eugene
Wilson, Evelyn•Hicks, Ruby Riley, Marinda McPherson, Nancy Curley, Crawford Goodwin,
S. L. Efland, William Roulac, Harold Daye, Annie Daye, J. Cartnail. and other un-
identified persons.
Mayor Protem Lloyd called the meeting'to order and then asked the Chairman of
the Planning Board, Frank Sheffield, to preside. Mr. Sheffield opened the meeting
by asking the Zoning Officer, Kay Maltbie, to show the location of the requested
rezoning property and to describe the request.
Dr. Philip Singer showed a plat of property on E. Corbin Street which is pre-
sently zoned R-20 and is being proposed to be rezoned to General Commercial. Dr.
Singer stated he wished to construct a medical office on the property. The build-
ing would have 6,000 square feet. A.dequate parking space and the required buffer
zone have been considered in the drawing of plans.
The meeting was opened for public discussion.
Lucille Dula, who lives on E. Corbin Street stated since the property is adjacent
to the Historic,Town Hall, any building put there should not de -value the property.
Dr. Singer stated he had in mind a building which looked residential.
Tom Burel added that columns and shutters would be all that is needed to make
the building look historic.
Dr. Singer stated there are presently three large old maple trees on the site
which hope to be preserved. Keith McNeil, who lives on Corbin Street, questioned
if the trees existed. and Mrs. Broda confirmed the trees did exisr_
Mr. Sheffield stated persons are not bound to specific use of the
property. That if property is zoned General Commercial, any general commerical
permitted use can go in. He stated the Planning Board is working on revisions
to the Zoning Ordinance. One revision will create a description of institutional
districts.
Mr. McNeil asked the number of undeveloped commercial zones in Hillsborough.
Mrs. Brody replied that some areas are found on Highway 70 West.

The second rezoning request was for property located,on N & K Street behind
I the Office Center in the downtown area. The request was to rezone from R-20 to
Central Commercial. Ms. Maltbie described the request and pointed out the location
on the map. The area is proposed to be used for construction of office space.
Tommy Burel, a nearby property owner, stated this was a critical problem
when one sees property rezoned commercial on the next street over. He is worried
that a domino effect will open the door for other property to become commercial.
He stated, "I don't want to see anymore commercial property behind my home." He
pointed out that the Eno River had flooded three times in the last 12 years and
water was over the Street. He added he did not want to see N & K Street opened.
Marinda McPherson stated at one time homes had been on the property and they
were flooded.
Sharon Burel asked if the matter had been presented to the Hillsborough Historic
Zoning Commission, and why the request did not go to this Board first?
Mr. Burel stated if he could get written assurance that Central Commercial would
not creep back to his area, once it started, he would not object to the rezoning.
Myron Martin stated the Planning Board would make a recommendation to the Town
Board who would be the body to act on the request.
It was further pointed out that FCX owns the adjoining lot to the property on which
the building is now located, and that the property is a non -conforming use.
Mr. Burel stated he moved to the area because of the quality and atmosphere of
the Town, and that he would not like to see that disturbed.
Gertrude AShley asked if government money is used for construction of the
building could they only be used for specific purposes.
Mr. Sheffield replied they could not be.
Harold Daye stated he was in favor of the medical center, but did not want
something else put on the property on E. Corbin Street.
Mr. Burell added he would not opposethe rezoning if central commercial ended
there and no additional property was rezoned. He further stated the Boericke would
be greAtly disturbed by the rezoning if they were in the Country.
Mrs. Brown stated as FCX grows they will be looking for another place to locate.
Barbara Page asked if the proposed medical Center had room to expand and Dr.
Singer replied hopefully they wouldn't have to move, but would plan for future expansion.
Calvin Ashley asked if the Town had looked at this property for additional
cemetery space? Commissioner Smith stated the Town has no plans to expand the Town
Cemetery at this time.
The third rezoning request was reviewed by Ms. Maltbie which requested rezoning
of property on the corner of W. Hill Avenue and Brownsville Street from R-15 to General
Commercial.

Lila Craven, who lives on Brownville Street, stated at one time two mobile
homes, an unused structure and a motor home were all located on the property.
She pointed out that a number of older widow ladies live in the area, and they
do not want the property rezoned commercial.
Mary Vick spoke against the rezoning.
Mazie Morgan stated her property and the property of Ken Collins join and
there is a frequent mess thrown onto her property from the existing trailors on
the lot.
Frank Sheffield read a letter from Maggie Rook opposing the rezoning request.
Mr. Sheffield asked if anyone else wished to speak regarding any of the three
rezoning request.
Lucilla Dula suggested the rezoning on E. Corbin Street be delayed until the
institution district is established.
Mr. Burel added the historic section of town should stay as it is.
Evelyn Hicks asked the names of those persons writing the Zoning Ordinance
and who adopted the ordinance.
Mr. Sheffield read the names to the group. He pointed out the 1979 Ordinance
was an update of the 1968 Ordinance, and the Planning Board had spent a lot of
hours working on revisions of the Ordinance.
In conclusion, Mr. Sheffield stated the next regular meeting of the Planning
Board will be November 10, 1983, and a recommendation will be made to the
Town Board for action.
Discussion continued concerning the three rezoning request. Joanne Harper
stated that one year ago property in West Hillsborough was rezoned to upgrade
the area, and that the rezoning of the property on W. Hill and Brownsville Street
would not help.
This part of the public hearing was declared adjourned.
Mr. Sheffield asked Ms. Maltbie to review the amendment to the Minimum Housing
Code which would allow the Zoning Officer or any other person to inspect btructures.
Mr. Sheffield asked if anyone wished to speak regarding the amendment and no comment
was offered.
The public hearing was then adjourned.
The Planning Board and the Town Board were asked to meet further to discuss the
Harmon Young Study.
