A RESOLUTION: INITIATING AMENDMENTS TO THE LEESBURG ZONING
ORDINANCE AND ZONING DISTRICT MAP TO EXPAND THE OLD
AND HISTORIC OVERLAY DISTRICT
WHEREAS, it is the intent and desire of Council to protect and enhance the designated Old
and Historic Overlay (H-1) District by identifying significant areas outside this district that deserve
protection in accordance with the goals of the 1997 Town Elan: and
WHEREAS, Zoning Ordinance Section 7.5.10 states that a property may be eligible for
inclusion in the Old and Historic Overlay (H-1) District if it has significant character, interest or value
as part of the town's development or heritage; and
WHEREAS, staffhas identified Carlheim, also known as Paxton Home for Children, as a
historic property listed on the Virginia Landmark Register and the National Register for Historic Places
that may warrant inclusion in the Old and Historic Overlay (H-I) District based upon the criteria set
forth in Section 7.5.10 of the Zoning Ordinance; and
WHEREAS, on April 19, 2004, in accordance with Zoning Ordinance Section 7.5.10.B, the
Board of Architectural Review adopted the attached motion which recommends to the Town Council
that a Zoning Ordinance Amendment and Zoning Map Amendment be initiated to include the Carlheim
Estate in the Old and Historic Overlay (H-1) District.
WHEREAS, the public necessity, convenience, general welfare and good zoning practice
require the proposed amendments.

ORDINANCE AND THE ZONING DISTRICT MAP TO EXPAND THE H-
I DISTRICT
THEREFORE, RESOLVED by the Council of the Town Leesburg in Virginia as follows:
SECTION I. The following amendments are hereby initiated and referred to the Planning
Commission for recommendation:
a. Amend Section 7.5 of the Leesburg Zoning Ordinance to include
Carlheim (also known as Paxton Home for Children and fi~rther identified as
Loudoun County Tax Map 48 Parcel 147) in the description of the Old and
Historic Overlay (H- 1) District.
b. Amend the Zoning District Map to include Carlheim (also known as Paxton
Home for Children and further identified as Loudoun County Tax Map 48 Parcel
147) in the description of the Old and Historic Overlay (H-1) District.
SECTION II. Pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as
amended, a notice that a Zoning Ordinance Text Amendment and Zoning Map Amendment to expand
the Old and Historic Overlay (H-l) District to include the subject property Carlheim will be considered
jointly by the Leesburg Town Council and the Leesburg Planning Commission and shall be published
in the Leesburg Today on May 7, 2004 and May 14, 2004 for a Joint Public Hearing to be held on
Tuesday, May 25, 2004 in the Council Chambers of the Leesburg Government Center at 25 West
Market Street, Leesburg, Virginia, 20176.
