Mayor Harker called the regular meeting of the City Council to order at 7:30 P. M. Rev. Gilbert Myers of the Baptist Church gave the invocation, following which Mayor Harker led the Pledg_ of Allegiance to the Flag. 2. 3. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harke: ABSENT: Councilmen -None ALSO PRESENT: City Attorney Martin, Planning Director George Dragicevich, City Manager Koski, City Treas. Buchan 5. APPROVAL OF MINUTES: a. Regular meeting of April 5, 1966. Councilman Dickason moved to approve the minutes of the regular meeting of April 5, 1966, Councilman Nunamaker seconded, and the motion carried unanimously. b. Adjourned meeting of April 13, 1966. Councilman Merritt moved to approve the minutes of the adjourned meeting of April 13, 1966, Councilman Tyrell seconded and the motion was unanimously carried. SEATING OF NEWLY ELECTED COUNCILMEN: Mayor Harker announced that at this time the canvass of the vote at the municipal election held on April 12, 1966, would be made. City Clerk Koski presented the results of the canvass by the canvassing board on April 18, at 10 A. M. advising only one change was made on the unofficial tally conducted on April 12, which made one less vote for Don Lanham. The total votes cast were as follows: Louis W. Merritt 1348 votes A. L. Nunamaker 1068 votes Paul W. Beckley 1379 votes William Burke 614 votes John W. Clemson 1385 votes Merrill Fitzjohn 1341 votes Louis T. Gilbertson 1138 votes C. Ray Johnston ,818 votes Don Lanham 425 votes Mrs. Georgia Maxey 1073 votes Mayor. Harker asked if any official protests had been received and the City Manager advised there were none. The Mayor then asked if there were any verbal protests to be made bi) anyone in the audience, and no one came forward. Councilman Dickason moved to adopt Resolution No. 66 -598 A RE- SOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIF- ORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF TEMPLE CITY ON THE 12th DAY OF APRIL, 1966, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PRO- VIDED BY LAW, Councilman Tyrell seconded, roll call vote to carry the motion as follows: AYES: Councilmen - Dickason, Merritt, Nunamaker, Tyrell, Harker NOES: Councilmen -None ABSENT: Councilmen -None The City Clerk called Paul W. Beckley, John H. Clemson, and Lou:: W. Merritt to the podium and administered the Oath of Office and delivered a Certificate of Election to each of them. The new Councilmen were seated and the outgoing Councilmen were given an opportunity to speak. Mr. Nunamaker commended the newly elected Councilmen for their work with the City in the past and stated he was confident they would continue to work for the betterment of Temple City. E1r. Dickason joined with 887 Council Minutes, April 19, 1966, page 2 Mr. Nunamaker and wished the new Council good luck and God speec' Mayor Harker expressed appreciation of the City to the two out- going Councilmen for all of the work and time they have devoted to the City as Councilmen. He then presented each with a brass plaque in recognition of their tireless efforts. Mayor Harker then requested the City Clerk to assume the chair for the election of a new Mayor. City Clerk Koski opened nominations for Mayor for the coming year. Councilman Clemson placed the name of Jack R. Tyrell in nomination for Mayor, Councilman Beckley moved nominations be closed and that the Clerk cast a unanimous ballot for Jack R. Tyrell as Mayor, Councilman Merritt seconded, and the motion carried unanimously. The new Mayor took the chair at this time. Mayor Tyrell expressed on behalf of the City appreciation for the fine job Mayor Harker had done for the past year, especially in the work in the annexation in pressing the issues which re- sulted in the success of the election. Mayor Tyrell then opened nominations for Mayor Pro Tempore. Councilman Merritt nominated Councilman Harker as Mayor Pro Tem, Councilman Clemson moved nominations be closed and a unanimous vote be cast, Councilman Merritt seconded, roll call vote to carry the motion as follows: AYES: Councilmen - Beckley, Clemson, Harker, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None The Mayor then made the following appointments to various or- ganizations: Sanitation District Mayor Tyrell Alternate Councilman Merritt League of Calif. Cities Councilman Harker Alternate Councilman Clemson Contract Cities Assn. Councilman Merritt Alternate Councilman Beckley County Library Councilman Harker Finance Councilman Beckley Rapid Transit Councilman Clemson Civil Defense Councilman Clemson S.G.V. Water Dist. Councilman Merritt So, Calif. Assn. of Gov. Councilman Harker Coordinating Council Mayor Tyrell Councilman Clemson moved to confirm the appointments, Council- man Harker seconded, and the motion carried unanimously. PUBLIC HEARING 7:30 P. M. ENTERTAINMENT LICENSE, HUNTER'S INN, 9446 LAS TUNAS DR. for piano -organ bar City Manager Koski presented the license application of the above stating reports from the Planning Director and Law En- forcement agency was favorable, and no protests have been made to the staff against this license. The only entertainment will be a piano /organ bar and the singing of the audience immediate) around the piano/organ. Councilman Merritt moved to open the public hearing, seconded and carried. Mayor Tyrell asked if anyone wished to speak in favor or against this license and no one came forward to speak. Councilman Clemson moved to close the public hearing, Council- man Harker seconded, the motion carried unanimously. Following discussion Councilman Merritt stated this type of entertainment had been in existence at this location prior to the remodeling and he moved to approve the application as presented, Council- man Clemson seconded and the motion was carried by the followin' roil call vote: AYES: Councilmen - Beckley, Clemson, Harker, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None PUBLIC HEARING: 7:30 P. M. CURB & GUTTER IMPROVEMENT PROJECT CHAP. 27 STREETS & HIGHWAYS CODE, BROADWAY, SOUTH SIDE, CLOVERLY TO ENCINITA. City Manager Koski advised a survey had been made of existing improvements at this location and 57% of the total block is improved and he recommended the Council authorize completion. 888 Council Minutes, April 19, 1966, page 3 Mayor Tyrell asked if anyone wished to speak in favor of the project. Mrs. Marquette, 9320 Broadway, spoke in favor but requested the City do the installation rather than property owners hiring a contractor. City Manager Koski advised in order to qualify for the 50 re- bate the property owners select their own contractor and can get as many bids as they want. Mrs. Marquette advised they would be gond during the summer and following discussion she agreed to have someone represent her and will advise the City Manager the name and address of this person. No one else .came forward to speak in favor. Mayor Tyrell asked if anyone wished to speak in opposition. Mr. Zettelmyer, 9205 Broadway, stated he lived on the north side and was not affected as yet but requested information about payment which the City Manager explained. He also explained the program which has been in existence 5 yrs. and the contri- bution the City makes for the improvements. No one else came forward to speak in opposition. Councilman Merritt moved to close the public hearing, Council - man Beckley seconded, and the motion carried unanimously. Councilman Harker moved to find the project in the public inter- est and instruct the Supt. of Streets to cause the work to be done, Councilman Clemson seconded, roll call vote to carry the motion as follows: AYES: Councilmen - Beckley, Clemson, Harker, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 6. STREET IMPROVEMENT PROJECT: Olive St., south side at Rosemead, Curb & Gutter City Manager Koski stated this street improvement project was submitted for Council consideration at the last meeting and was deferred until the staff could contact the church property owne, re dedication of existing right of way. He advised the church will make a gratis dedication of this particular strip along th;:. flood control. He recommended the Council proceed with this project which would be curb and gutter and street improvement at an estimated cost of $3500. Some discussion followed regard- ing the area between the curb and the flood control and this will be considered at a later date. Councilman Merritt moved to find the project in public interest and to instruct the Supt,_ of Streets to cause the work to be done, and to approve the expenditure of gas tax monies in the amount of $3500. and to amend the 1965 -66 budget to reflect this, Councilman Beckley seconded, roll call vote to carry as follows: AYES: Councilmen- Beckley, Clemson, Harker, Merritt, Tyreli NOES: Councilmen -None ABSENT: Councilmen -None REPORT ON DRAINAGE EASEMENT PROBLEM: PRIMROSE - TRELAWNEY City Manager Koski presented pictures taken showing existing conditions. City Attorney Martin stated this is a situation where the prop -, erty to the north of the drainage easement is fee owner of the property on which we have an easement. The question is whether flood control devices are being damaged or not. The owner has fee title and retains all rights which do not interfere with the City easement. Mayor Tyrell asked if anyone in the audience wished to speak. Louis Weidner, 6327 N. Primrose, stated he lived at the end of the cul de sac and owned the property the full length of the south side. He explained the harrassment to them clay and night of people from Trelawney and south Primrose walking through the wash. He explained the subdivision was built three years ago and at that time together with one other property owner they contacted the City Manager and with his permission gates were put in which were shut for two years. The property owner to the north advised unless they were opened he would tear them down. He explained the problem in detail to the Council. City Attorney Martin recommended the Council go and see the area in question and stated the rights of the City are limited as we have interest for flood purposes only. He advised the Council if they felt gates are necessary or appropriate to pro- tect flood control rights and keep children out of there, and what they throw in there is interferring with flood control 889 Council Minutes, April 19, 1966, page 4 the Council could do so. Following discussion Councilman Clem- son moved to hold this over for the Councilmen to look at this before the next Council meeting, Councilman Beckley seconded and the motion carried unanimously. 8:20 P. M. At this time Mayor Tyrell declared a five minute recess. 8 :25 P. M. Mayor Tyrell reconvened the Council. NEW BUSINESS: 8. APPEAL FROM PLANNING COMMISSION DECISION: Zone Variance Case #66 -182, Ernest R. Starr, 9219 E. Las Tunas Dr. City Manager Koski recommended a public hearing be set for the above appeal which had been filed by Mr. Starr. Councilman Harker moved to set a public hearing for May 3, 1966, at 7:30 P. M., Councilman Clemson seconded and the motion carried un- animously. 9. CURB& GUTTER: EMPEROR AVE., south side, Livia to Loma The City Manager recommended this project be set for public hearing. Councilman Merritt moved to set a public hearing for 7:30 P. M. on May 3, 1966, Councilman Beckley seconded, and the motion was unanimously carried. 10. PLANNING COMMISSION RECOMMENDATIONS: a. Recommend approval of Lot Split, Plot Plan #493, J. V. and June M. Curley, 9149 E. Broadway. Planning Director Dragicevich stated this was approved by the Planning Commission on April 14 with deletion of item #4 of the City Engineer's report requiring monuments be set, and item #5 to provtde for contributory drainage from adjacent property. James McDonough of Arcadia Engineering, stated he represented Mr. & Mrs. Curley,stated the Subdivision Map Act clearly states they do not need monuments, and that they will set them before any construction but as yet they do not know when they will star building. The City Attorney advised they are not mandatory and the Commission has waived them which is their prerogative. Mr. McDonough presented maps showing the drainage and contour map of the area. The Commission has deleted this item #5 also. Councilmen Beckley and Clemson both disqualified themselves to vote on this as they had acted on this as Planning Commissioners Councilman Harker moved to approve the Planning Commission re- commendation with stipulation as recommended by County Engineer and monuments be installed prior to construction, Councilman Merritt seconded, roil call vote to carry as follows: AYES: Councilmen-Harker, Merritt, Tyrell NOES: Councilmen -None ABSTAINING: Councilmen - Beckley, Clemson ABSENT: Councilmen -None b. The Planning Director presented Plot Plan #494 at 5013 N. Heleo Ave., owner Virginia F. Crandall, stating this was approv- ed by the Planning Commission with the stipulation that the applicant present a Parcel Map prepared by a Licensed Land Sur- veyor corresponding to the map presented to the Commission. Mr. McDonough, stated he also represented the owner of this property, advised the recommendations from the engineer re drainage were acceptable, and placing the slab 12' above the flow line which would be kept 3 ft. from the building was also acceptable at time the building permit is taken out. Councilmen Beckley and Clemson both disqualified themselves for the same reasons as above. Councilman Merritt moved to approve the recommendation of the Planning Commission on Plot Plan #494, Councilman Harker seconded, the motion carried by the following roll call vote: AYES: Councilmen- Harker, Merritt, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None ABSTAINING: Councilmen - Beckley, Clemson 11. TRAFFIC COMMISSION RECOMMENDATIONS: Item 5. LAS TUNAS CLEANERS, 9430 Las Tunas Dr. -short time park- ing zone. Traffic Engineer Envali advised this was to be'u'sed._.for pick -up 890 Council Minutes, April 19, 1966, page 5 and delivery as well as for quick -stops for customers. Follow- ing discussion Councilman Merritt moved to approve, Councilman Clemson seconded and the motion carried unanimously. item 6. Temple City Library- short time parking zone: Traffic Engineer Envall stated this was a request from the Library, and the Commission recommend short time green curb marking with enforcement on a complaint basis. Following dis- cussion Councilman Harker moved to approve, Councilman Merritt seconded and the motion was unanimously carried. item 7. Cloverly, Primrose & Kauffman south of Las Tunas, & Camellia Ave. north and south of Las Tunas - marked parking stalls. Traffic Engineer Envall presented the above recommendation and advised the Council this would keep parked cars out of driveways and be valuable as it would give full utilization of the parking area. Following discussion Councilman Clemson moved to adopt the recommendation of the Traffic Commission, Councilman Beckley seconded and the motion carried unanimously. Item 9. Garibaldi & Muscatel - 4 way stop. Engineer Envall advised the Commission recommend placement of "Stop" sign (4 -way) at Muscatel and Garibaldi with additional up- grading of speed limit to 30 mph, subject to certification of the annexation. Following discussion Councilman Merritt moved to approve this recommendation, Councilman Beckley seconded and the motion carried unanimously. Item 10. Hermosa & Muscatel - requested 4 -way stop. The Traffic Engineer advised the Commission recommend placement of "Stop Ahead" pavement markings on Hermosa Dr. at both approaches to Muscatel and placement of double centerline strip- ing on both streets. Councilman Clemson moved to approve item 10 as recommended, Councilman Merritt seconded and the motion carried unanimously. Item 12. "Not a Through Street "sign and pavement marking on Duffy St. at east approach to Noel Dr. with "Stop ahead "pavement marking. This recommendation was presented by the Traffic Engineer and Councilman Merritt moved to approve item 12, Coun- cilman Harker seconded, and the motion carried unanimously. Item 13. a. Recommend "Slow Curve" pavement markings at inter- section on Longden at Encinita. The Engineer presented this recommendation and advised the markings would be on Longden approaching from the west to Encinita. Councilman Harker moved to approve Item 13 a, Councilman Clemson seconded and the motion carried unanimously. Item 13. b. Recommend placement of red curb markings at fire hydrant and two drives on the east side of Oak Ave. southerly of Longden Ave. Following presentation of this recommendation by the Engineer Councilman Clemson moved to approve item 13 b, Councilman Beckley seconded, and the motion was unanimously carried. item 13. c. Recommend placement of Stop signs and Stop and Stop Bar pavement markings on Olema, Woolley, and Fortson Stree+ at the west approach to Encinita. The Traffic Engineer presented the above recommendation. Coun- cilman Merritt moved to approve item 13 c, Councilman Beckley seconded, and the motion carried unanimously. 12. RESOLUTION NO. 66 -599: Warrants & Demands. City Manager Koski presented Resolution No. 66 -599 A RESOLUTION OF THE CITY OF TEMPLE CITY ALLOWING CLAiMS AND DEMANDS iN THE SUM OF $55,423.28, DEMAND NOS. 7906 THROUGH 8116. Following. discussion Councilman Merritt moved to adopt Resolution No. 66 -599, Councilman Clemson seconded, and the motion carried unanimously. 13. COMMUNICATIONS: The City Manager advised the communication re- garding appointment to the Selection Committee had already been done and he had no further correspondence. The Resolution for 891 Council Minutes, April 19, 1966, page this appointment will be prepared for the next Council meeting. 14. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Mr. Ray Burger, 9018 Rancho Real, stated he would like to re- commend that the Councilmen of Temple City be paid for the time and effort, and the services they render the City. The City Attorney advised no councilman can have his salary increased during his term of office. No one else came forward to speak at this time. 15. MATTERS FROM CiTY OFFICIALS: Mayor Tyrell advised the Councilmen if they have any topics they wished to discuss to advise the City Manager and a study session can be scheduled. The City Manager requested the Council to authorize Mayor Tyrell and Mayor Pro Tem Harker to execute the warrants of the City. Councilman Beckley so moved, Councilman Clemson seconded and the motion carried unanimously. The City Manager advised he had received a communication from tii( League of Calif. Cities re a conference in Monterey on May 22 -24 specifically for new Councilmen which he felt would be most helpful to them as well as the other Councilmen. There is a registration fee and transportation and lodging with funds avail _.able to cover it. Following discussion it was decided that any Councilman able to attend will so advise the City Manager. In response to a request from the San Gabriel Valley Bar Association and with Council approval, Mayor Tyrell proclaimed May 1 as "Law Day USA" in the City of Temple City. Mayor Tyrell stated at this time that while the Council gained a couple of fine new members, that the Planning Commission. has lost two very fine members. In recognition of their services as Planning Commissioners on behalf of the City he presented Councilman Beckley and Councilman Clemson each with a Certifi- cate of Recognition for their efforts on behalf of the City serving on the Planning Commission. 16. ADJOURNMENT: Councilman Beckley moved to adjourn, seconded and carried. Council adjourned at 9:20 P. M. The next regular meeting of the City Council will be on May 3, 1966, at 7:30 P.
