A time extension to October 24, 2004 for completion of the public improvments

WHEREAS, a letter of credit from the Mercantile-Safe Deposit and Trust Company in the amount
of $124,036.00 was prodded by the developer to guarantee the installation of public improvements; and
WHEREAS, the town's Director of Engineering and Public Works recommends a time extension
to October 24, 2004.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virgima as follows:
SECTION I. The letter of credit from the Mere, antile-S~e Deposit and Trust Company in the
amount of $124,036.00 is approved to gumantee the installation of public improvements at the Hampton
and
WHEREAS, Leesburg Parmers, L.P., the developer of the Hampton Inn & Suites, has not
completed all the required public improvements in accordance with the approved construction drawings and
town standards within the two-year period agreed to in the contract for public improvements; and
WHEREAS, the developer has requested a time extension to complete the public improvements;
