Agenda for the Planning Board Meeting, December 8, 1983 at 7:30 P.M. at the
Town Hall
Item 1- Rezoning application from McBroom Realty for Robert Lucas for .285
acres located at the southwest corner of Highway 70 and Short Street. This
property adjoins residential property to the south and east on Short Street.
Property to the west (about 14,000 square feet) is zoned General Commercial.
Across the street, there is property at the northwest corner of Faucette Mill
Road is zoned commercial while property at the northeast corner is zoned
residential. This application if completed could be placed on the January
24, 1983 Public Hearing.
Item 2- Rezoning application from Theodore and Sharon Freeland for rezoning
of their property west of Lloyd's property at Corbin and Churton. This request
and the request above are for rezoning from residential to General Commercial.
The Freeland property has commercial property located to the north and the
east. Residential property is located to the west and south and also to the
northeast. 2 acres
Item 2A- Rezoning request from John Roberts forAeast of his commercial zoning.
Item 3- West Orange Study Area. Orange County had a public hearing on this
area and kept their hearing open for comments from the Hillsborough Planning
Board and Town Board. The area under consideration includes location of
existing and proposed water supply reservoirs for the Town of Hillsborough.
The consideration of protection of the reservoirs by limiting development
to two acre minimum lots for residential use is part of the Study. The
Planning Board's comments on this are important. Susan.Smith will present.
Item 4- Orange County has two rezoning requests which need to have immediate
comments from the Planning Board. One rezoning request is for 2.77 acres
surrounding the Orange Garden ,enter on Highway 70 adjacent to the Pantry
at the corner of St. Mary's Rd. The request is from R-1 to NC -2 Neighborhood
Commercial. The other property is located on the south side of Oakdale Drive
east of Kelly Drive (Private Road). The request is for rezoning from R-1
to R-4.
Item 5- James Freeland has requested consideration of two mobile home lots
on his property east of the Campgrounds.

Minutes of December 8, 1983 Meeting
Members present: Myron Martin -Chairman, Rick Cannity, Hilda Brody, Tarleton Davis,
Nancy Goodwin, Dr. Murphy and John Dorward.
Others: Susan Smith, Theodore and Sharon Freeland, and Zoning Officer.
Myron Martin called the meeting to order and offered Holiday Greetings to
the members of the Planning Board. He welcomed Dr. Robert Murphy to the
Planning Board.
Martin suggested that since two new members are to be appointed to the Planning
Board a letter should go out to them explaining the rules of the Planning Board
and welcoming them to the Board.
Cannity suggested that the Board's Rules of Procedures need to be revised and
approved by the Planning Board and them adopted by the Town Board.
On motions for Vice Chairman, Murphy nominated Brody who declined the nomination.
Brody nominated John Dorward. Goodwin seconded the nomination. Cannity moved
that the nominations be closed. Murphy seconded the motion. Dorward was
appointed by acclamation.
Martin then presented a Work Program which he had prepared for the Planning
Board. He noted that a directive was needed from the Town Board prior to
the appointment of a committee to develop Subdivision Regulations. The Work
Program was delayed until the next meeting so that the Board could have time
to consider it.
Martin passed around Sheffield's letter of resignation to the other members.
Regarding rezoning requests, since the McBroom rezoning request on Highway
70 and Short St. was incomplete, it was to be rescheduled to the next meeting.
Sharon Freeland spoke on her rezoning request. She noted that the property is
located across the street from General Commercial - the Station which is vacant
and apartments. Ben Lloyd.'.,s property is adjacent; the Lloyd property was just
approved as General Commercial. On the west side of the Freeland property on
Corbin St. is rental property. The Freeland house has been on the market for
a year and has not sold due to the surrounding commercial uses. They have
had inquiries from buyers wanting to use the property for office use.
The Institute of Government had suggested creating an off ice-insKtutional zoning
prior to adoption of the revisions. Cannity said that he and Goodwin's committee
would work on that, but he wanted to know if the Freeland property would be
nonconforming dimensionally if it was rezoned. The right of way needs to be
determined as well as the setback.
The rezoning petition from John Roberts was considered next. Davis said that he
thought that Roberts had a legitimate request in wanting to extend his commercial
property east. The area which has been filled is the area requested for rezoning.
Martin noted that the Freeland request and the Roberts request should be heard at
the January Public Hearing, which is scheduled on Tuesday, January 24, 1984.

Susan Smith presented the West Orange Study Area Plan. She noted that the plan
would increase the protection of the existing and prospective water supplies
immediately west of Hillsborough as well as increasing the residential, commercial

and industrial zones. Martin noted that the Water Committee of the Town Board
could consider ways to preserve water quality for Hillsborough.
tmith said that an engineering review due in January would examine protection of
the water supplies as well as extension of sewer lines. She noted that the
Triangle J COG staff is concerned about the long term maintenance of package
treatment plants and that Cary maintains package plants put in by developers
who pay maintenance fees to the Town.
Cannity made a motion that the Planning Board recommend to the Town Board that
the Town support the attempts of the Orange County Staff and Planning Board and
County Commissioners to preserve and protect the watersheds and water supplies
in Orange County and support the water quality critical areas with some reservations
about the large size of the commercial and industrial areas as designated on the plan.
Dorward seconded the motion which passed unanimously.
The draft regarding treatment of signs and landscaping requirements in the I-40
corridor is due on December 19, 1983. Smith said that the Town Planning Board
might want to review that draft.
Thomas Merritt had requested a rezoning from the county. Planning Board members
were concerned about the preservation... of neighboring residential property and
buffers for those existing neighborhoods. Control over access to Highway 70
was also expressed. Dorward moved that the request be rejected and that the
concerns could only be addressed by a Planned Development Process. Brody
seconded this recommendation to Orange County Planning Board. The motion
passed.
Cannity moved that the recommendation on the Bruce Smith property be that the
Board had no major objections to the request. Murphy seconded the motion which
passed unanimously.
Goodwin made a report on the progress of her committee. She also presented a
letter from Triangle J COG in response to a letter she had sent regarding storm
water runoff.
