INITIATING CONSIDERATION OF VARIOUS AMENDMENTS TO THE
LEESBURG SUBDIVISION AND LAND DEVELOPMENT REGULATIONS
TO REFINE THE DEFINITION OF BOUNDARY LINE ADJUSTMENT,
MODIFY THE PLAN REVIEW PROCESS FOR PRELIMINARY
DEVELOPMENT PLANS, CLUSTER SUBDIVISIONS, AND LARGE-LOT
SUBDWISIONS, AND ELIMINATE THE CAP ON THE NUMBER OF
TOWNHOUSE LOTS SERVED BY A PARKING COURT.
WHEREAS, improving the plan review process is a goal of the town; and
WHEREAS, improving the quality of development is a goal of the town; and
WHEREAS, amendments to the Subdivision and Land Development Regulations have been drafted
to modify the review process for preliminary development plans, cluster subdivisions, and large-lot
subdivisions, as well as refine the definition of boundary line adjustment and eliminate the restriction on the
number of townhouses that are served by a common parking court.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The necessary study to consider potential amendments to the Subdivision and Land
Development Regulations is hereby initiated and referred to the Planning Commission for recommendation:
1. Amend Section 13-55 to refine the purpose and intent of the Subdivision Regulations.
2. Amend Section 13-55.2 to eliminate the need to apprise the Planning Commission of the
submission of minor subdivision plat applications.
3. Amend Section 13-55.3 to refine the definition of boundary line adjustment.
4. Amend Section 13-57(0 to establish the Planning Commission as the approval body for preliminary
plats of cluster subdivisions in lieu of the Town Council.
5. Amend Section 13-60(e) to establish an administrative review and approval process for final plats
of cluster subdivisions in lieu of Town Council action.
6. Amend Section 13-64 to define the purpose and intent of the development plan regulations.

7. Amend Section 13-66 to establish what professional can prepare development plan applications.
8. Amend Section 13-67(d) thru (i) to establish the Land Development Official as the approval
authority for preliminary development plans in lieu of the Planning Commission.
9. Amend Section 13-75(c)(2)((d)) to eliminate the restriction on the number of townhouse lots that
can be served by a common parking court.
10. Amend Section 13-89(b)(5) to establish the Land Development Official as the approval authority
for preliminary development plans.
11. Amend Section 13-90(a) and (b) to eliminate the Planning Commission as the approval body for
preliminary development plans.
12. Amend Section 13-99(c) to redefine the definition of subdivision so that any subdivision of
property, including subdivisions resulting in lots of greater than 10 acres each, to be subject to the
town's plan review process.

of the 1950 Code of Virginia, as amended.
