Hamlett x°17 S4/ To: Planning Board From: Frank Sheffield Re: Agenda for Planning Board Meeting, February 3, 1983, 7:30 P.M,, at the Town Hall Item 1- Request by Mr. Everette Kennedy for the Planning Board to consider his request for rezoning of .9 acre shown on Tax Map 9, Block A, Lot 30. The current zoning of this property, which is located on Highway 70 and was previously the Cole Motor Company, is General Commercial. Upon notification that the General Commercial District does not allow for assembly of parts, Mr. Kennedy filed a request for rezoning of the property to Industrial to allow for assembly of heater parts. Please view the property if you have time. Item 2- Consideration of compliance by Keeter•Mobile Home Park on Rex Drive. View this property also if your time permits. Item 3- Old Business Public Hearing Review Committee Reports Approval of Minutes PLANNING BOARD Minutes - February 3, 1983 Members present: Sheffield -Chairman, Wagner, Cox, Plambeck, Holman, Page, Martin, Brody, and Goodwin. Others present: William Gaede, neighbor of Keeter MHP, John Dorward, and Zoning Officer. Sheffield called the meeting to order. The first item on the agenda was the request for rezoning by E.H. Kennedy for .9 acre currently zoned commercial on Highway 70 (previously the Cole Motor Company). Kennedy .wrote on his rezoning request that he was requesting Light Industrial which is not one of the zones in the Hillsborough Ordinance. Questions were asked about surrounding usage. Just north of the property is residential property. Adjacent property is commercial, Terrell's Tire Company. Sheffield noted that a rezoning to Industrial could be spot zoning. That area on Highway 70 would seem to be a candidate for commercial redevelopment. We might want to initiate action to encourage redevelopment of that area on Highway 70 from 86 to Faucette Mill Road. The Town might want to offer tax breaks or deferred taxes to encourage redevelopment. Cox noted that the area behind that area is a residential redevelopment area so that federal funds might be available to redevelopment of the commercial area. Further discussion of the noise that might be generated by the rezoning took place. Wagner pointed out that if they put in a punch press, it would be noisy, but it would be hard to excede the adjacent tire business for noise. Page noted that there was not much room for expansion. Sheffield noted that if it were rezoned, any industrial use could go in there. Plambeck said that Prime Industrial with consideration of landscaping and environmental factors would preserve and protect the area better than General Industrial. Holman asked if there was a buffer zone of trees behind the lot to protect the residential area. Cox moved that the Planning Board request the Town Board set a public hearing date on this rezoning request and that the rezoning be considered to Prime Industrial. Wagner seconded the motion which passed unanimously. The next item was consideration of the Keeter MHP on Rex Drive. A neighbor, Mr. Adams, came to speak. He said that he owned property adjacent to the Keeter property. He said that he had a house which he had been unable to sell,and his realtor had told him that the MHP had devalued his house by $5,000. He wondered if he could sue Keeter for the loss. Gaede said that at one time, keeter had two of the waste lines from mobile homes going into a 55 gallon drum. Plambeck noted that information on sewer lines was not on Keeter's plans. Cox wanted information on the water lines. Holman said Keeter's MHP should be kept clean. Sheffield said that Keeter needed to provide more information on water and septic drain lines and lighting. Cox also asked for information on the driveway to the left of the MHP. The item was continued until the next meeting. Under old business the lighting of the MHP at Eno and Collins came up. Questions came up about the actions of the Board of Adjustment. Dorward said that the BOA had granted a variance on the lot size and variances for setbacks for the mobile homes that are there Planning Board Minutes, February 3, 1983 now. New Mobile homes would have to meet the Ordinance setback requirements. Wagner noted that old mobile homes might not get replaced with those stipulations. Cox said that the Minimum Housing Code could be enforced if the housing became too dilapidated. Consideration of the Wagner lighting was continued until the next meeting. Page reported that the Orange County Public Hearing included the letter from the Hillsborough Planning Board which was read into the minutes. She said that she felt that Orange County would go along with the recommendations from the Hillsborough Planning Board and perhaps.add more. The letter referred to the proposed residential development by James Rae Freeland on Highway 86 south of Interstate 85. Under Public Hearing Review, regarding Mobile Home revisions, Wagner said that mobile homes can be put anywhere that a house can be put according to the Supreme Court. Sheffield said that advice from the Institute of Government and the Town Attorney had been that mobile homes could be prohibited from the Historic District and design or architectural standards were required in the Historic District. Martin said that the Mobile Home Committee feels.that there is still a long way to go with this information. Further research on different lots and mobile homes will be done. Gaede said, "We feel mobile homes shouldn't be prohibited in the Historic District because they are mobile homes but because they aren't appropriate, but neither are A -frames." The next meeting of the Mobile Home Subcommittee was announded as Tuesday, February 8th at the Town Hall. Home occupations was discussed and general agreement was that it was ready to go to the Town Board. Cox recommended that the proposed Home Occupations language be sent to the Town Board for their consideration as an amendment to the Zoning Ordinance. Page seconded it and it passed unanimously. On the Multi -Family revisions, Sheffield said that comments had been made to him regarding the double lot size for duplexes which indicated that perhaps a smaller lot size should be considered for duplexes. Dorward said that he had thought that the Town wanted smaller complexes, but he noted that there was no negative feedback on the standards. Sheffield noted that he thought multi -family might be asked for in the A R area at some point in the future. Page said that goals for the South Hillsborough area were being worked on for another public meeting. Minutes were approved for January 6, 1983, November 18, 1982 and December 2, 1982. Discussion of the recent water -sewer information from Pridgen and the Neuse River Report by the State took place. Cox suggested John Wray give a presentation on watershed management. The meeting was adjourned.
