AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES FOR
POTOMAC CROSSING SECTIONS 2B-l, 2E, 3A-l, 4, 5, 6, 7, 8, 8 ROAD
IMPROVEMENTS, 9, TRAFFIC SIGNAL ~ BATTLEFIELD PARKWAY &
SHANKS EVANS ROAD; AND THE STORMWATER MANAGEMENT POND
AND PUMP STATION
WHEREAS, Arcadia Development Company, the developer of Potomac Crossing Sections 2B-l, 2E,
3A-l, 4, 5, 6, 7, 8, 8 Road Improvements, 9, Traffic Signal ~ Battlefield Parkway & Shanks Evans Road; and
the Stormwater Management Pond and Pump Station has not completed all the required public improvements in
accordance with the approved construction drawings and town standards within the two-year period agreed to in
the contract for public improvements and previously approved time extensions; and
WHEREAS, the developer has requested a time extension to complete the public improvements; and
WHEREAS, corporate surety bonds from The Lumbermans Mutual Casualty Company, The American
Motorists Insurance Company and The American Insurance Company in the amount of $129,945.00 for Section
2B-l; in the amount of $204,744.00 for Section 2E; in the amount of $122,643.70 for Section 3A-l; in the
amount of $18,794.18 for Section 4; in the amount of $983,024.57 for Section 5; in the amount of $86,174.82
for Section 6; in the amount of $90,306'59 for Section 7; in the amount of $189,673.94 for Section 8; in the
amount of $165,481.91 for Section 8 Road Improvements; in the amount of $115,546.77 for Section 9; in the
amount of $120,000.00 for the Traffic Signal ~ Battlefield Parkway & Shanks Evans Road; and in the amount
of $43,334.40 for the Stormwater Management Pond and Pump Station were provided by the developer to
guarantee the installation of public improvements; and
WHEREAS, the town's Director of Engineering and Public Works recommends a time extension to
June 17, 2005 for Section 2B-l; to November 17, 2004 for Sections 2E and 3A-l; to June 1, 2005 for Section
4; to June 13, 2005 for Section 5; to June 26, 2005 for Section 6; to June 28, 2005 for Section 7; to June 29,

AND PUMP STATION
2005 for Section 8; to June 29, 2005 for Section 8 Road Improvements; to June 13, 2005 for Section 9; to
December 26, 2004 for the Traffic Signal ~ Battlefield Parkway & Shanks Evans Road; and to June 28, 2005
for the Stormwater Management Pond and Pump Station.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The corporate surety bonds from The Lumbermans Mutual Casualty Company, The
American Motorists Insurance Company and The American Insurance Company in the amounts listed above are
approved to guarantee the installation of public improvements in Potomac Crossing Sections 2B-l, 2E, 3A-l, 4,
5, 6, 7, 8, 8 Road Improvements and the Stormwater Management Pond and Pump Station.
SECTION II. A time extension to June 17, 2005 for Section 2B-l; to November 17, 2004 for
Sections 2E and 3A-l; to June 1, 2005 for Section 4; to June 13, 2005 for Section 5; to June 26, 2005 for
Section 6; to June 28, 2005 for Section 7; to June 29, 2005 for Section 8; to June 29, 2005 for Section 8 Road
Improvements; to June 13, 2005 for Section 9; to December 26, 2004 for the Traffic Signal ~ Battlefield
Parkway & Shanks Evans Road; and to June 28, 2005 for the Stormwater Management Pond and Pump Station
for completion of the public improvements are approved.
