This letter report on the subject property in is fulfillment of our agreement for additional
services dated February 23 2000 This report contains our review of site remediation
efforts by Branching Out Inc (BOI) as documented by BOI s letter to Ms Olga Guilarte
dated February 1 2000 fax and telephone conversations with Steve Hurst of BOI on
March 3 2000 and fax an March 7 2000 Representatives of Edward E Clark Engineers
Scientists Inc (CLARK) also visited the site on February 28 2000 and March 1 2000
The Environmental Site Assessment (ESA) Phase land It prepared by CLARK and dated
September '16 1999 identified the potential for soli and/or groundwater contamination at
two locations on the property Field investigations carried out as part of the Phase 11 of
that ESA identified an affected area near the center of Parcel 2 primarily within an area
where petroleum contaminated soil and a small amount of petroleum contaminated
groundwater were removed during site remediation efforts that occurred circa 1990-1995
The areal extent of the affected area was identified as approximately 100 feet by 120 feet
or about 028 acres The Phase 11 ESA showed a second and smaller affected area of
petroleum contaminated groundwater at the southern boundary of the property The likely
source of this affected area was attnbuted to migration of the documented groundwater
plume at the Amoco service station located immediately adjacent to the southern boundary
of the property The Amoco station had a groundwater treatment system in operation from
1991 to March 1995 when the station was allowed to discontinue treatment until additional
funding is authorized by the State of Florida
BOI was contracted by Key Land Company Inc to perform certain site rehabilitation efforts
at the subject property BOI initially excavated several areas around the site tested two

on -site wells and ultimately conducted additional excavation and soil removal into the
water table to form one large excavation referred to as the lake A total of 925 83 tons
of matenal were removed from around the site and the interior of the site and disposed of
at the Rinker Materials incinerator
The area of the sod removal approximately circumscribes the affected area reported in the
CLARK Phase II ESA The BOI efforts did not address the groundwater plume near the
southern property boundary except to sample the existing groundwater monitoring well
MW -6C The BOI groundwater results show relatively clean groundwater on the site and
in the excavated lake However BOI reported increased petroleum constituents in the
affected area near the southern property line adjacent to the Amoco station Refer to
Table 1 for a comparison of groundwater results
The implication of these results is that the groundwater plume associated with the Amoco
station continues to be present if not advancing farther onto the subject property Until
the contamination is addressed the financial implications of this plume could be that any
additional contaminated soil uncovered during construction for storm drains or other
structures would require removal testing and proper disposal off site No estimate can
be made as to the cost of any future contaminated soil removal and disposal if
encountered during future construction without some indication of future building plans
for the property Any legal implications including any regulatory action toward present or
future property owners is beyond the scope of this engagement
The general area of contaminated soil in the approximately 0 28 -acre area in the intenor
of the property has been removed and the favorable results from the additional
groundwater monitoring well located on the eastern perimeter of the excavation and the
favorable groundwater results of the newly created excavation ( lake ) have addressed the
major concerns of the CLARK Phase I and II ESA Certainly this is not to say that
additional pockets of contaminated soil will not be uncovered during future construction
since the Phase 1 and 11 investigations were not a comprehensive Contamination
Assessment Reportbut identified readily identifiable areas of concern Any future financial
liability due to contamination again would be expected to be limited to removal testing
and disposal off -site of any contaminated soil uncovered during construction Future

building plans will dictate the cost if any of future soil removal Any future legal actions
or actions by any regulatory agency are beyond the scope of this engagement

Dear Ms Guilarte
In the Phase I & II Environmental Assessment conducted by Clark
Engineers -Scientists dated September 16 1999 for the village of
Key Biscayne, an area of potential contamination was delineated
The area was estimated at approximately 100 feet by 120 feet or
0 28 acres in size As a result Branching Out, Inc was
contracted by Key Land Company to investigate and address the
concerns The work was conducted in two phases The first phase
consisted of excavating several areas around the site and
removing two loads of suspect soil (37 85 tons) from the center
of the property on 12/1/99 When the material was removed it eras
replaced with crushed limerock (backhauled) Two on site wells
were tested two weeks after the excavation (APPENDIX A) All of
the material was disposed of in the Rinker Materials Substitut_on
Program (incineration) see APPENDIX B
The second phase was conducted after meeting with Key Land
Company officials ana the trustees to the Rebozo estate The
trustees wanted assurance that all measures to insure that any
potential contamination of the site from past activities had been
addressed It was determined ti,at the area shown in the Clark
Engineering Assessment as being potentially contaminated would be
excavated and disposed of through inc_-erazior

Branching Out, Inc personnel met with the Village of Key Biscayne
Building Department and reviewed the proposed activities with
them A track mounted excavator was mobilized to the site and
excavatior was oegun A total of 36 dump truck loads of material
were removed and 35 loads of crushed limerock were backhauled to
the site The total amount incinerated was 925 83 tons of
material The area was excavated below the water table leav_nc a
lake or pond of groundwater that responds to the tides each day
The material was taken to Rinker Materials for incinerat_on anc
disposal manifests are provided in APPENDIX B The laze was
sampled on 1/25/00 and all samples came back clean for EPA Method
602 and 610 compbunds(petroleum), see APPENDIX C
CONCLUSION
The area shown by Clark Engineering as being potentially
contaminated from past site activities has been excavates and an
material incinerated at Rinker Materials The area is currents;
a lake that changes elevation each day with the tide Testing of
the lake has shown no contamination

This material excavation shoula provide assurance to all
concerned parties that the current owners have taken every
precaution to insure that the site is clean The site is still
receiving petroleum contamination from the Amoco station to the
south but this should have no impact on the proposed site
activities from the Village of Key Biscayne
The Village of Key Biscayne should be notified of the above
activities They will most likely ask their consultant to rev_ew
our documents and test the site sufficiently to satisfy
themselves that the concerns addressed in their earlier reports
have been completed Please inform them that I would like to
split any samples they take
