A RESOLUTION:
AUTHORIZING PRE-SELECTED EQUIPMENT PROCUREMENT
FOR THE WATER POLLUTION CONTROL FACILITY EXPANSION

WHEREAS, THE Virginia Public Procurement Act {}2.2-4303 gives a public body, under
special conditions, authority to contact with a vendor either through "competitive negotiation" or
by "sole source procurement"; and
WHEREAS, it has been determined that pre-selection of critical equipment to be used in
expansion of the Water Pollution Control Facility (WPCF), will ensure that the equipment
installed will meet all requirements of the project; and
WHEREAS, the recommended Biofilter Equipment has been selected through a
competitive RFP process; and
WHEREAS, there is only one source practicably available for the other equipment; and
WHEREAS, pre-selection of equipment has been successfully implemented on the three
previous upgrade and expansion projects at the WPCF; and
WHEREAS, the Director of Utilities recommends procurement of pre-selected equipment
as follows:

THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
The Council hereby determines there is only one source practicably available for the
equipment noted and authorizes staff and the town's consultant, CH2M Hill to negotiate with
vendors for the referenced major equipment items to be used in expansion of the WPCF. The
negotiated price will become part of the successful General Contractor's contract amount with
the town for the entire project.
