AUTHORIZING A TIME EXTENSION FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING A PERFORMANCE GUARANTEE
FOR ALLMAN WATER 8: SANITARY SEWER EXTENSION
on April 22, 2003, the Leesburg Town Council adopted Resolution #2003-60
approving a substitute performance guarantee from the Developers Surety & Indemnity Company provided
by Kid's Domain LLC, to replace the previously approved letter of credit from the Potomac Bank of
Virginia provided by The Allm~ Family Limited Partnership; and
WHEREAS, the town has not received the replacement contract or bond from Kid's Domain LLC,
which is in a dispute with The Allmam Family Limited Partnership over who pays for the installation of the
water and sanitary sewer lines; and
WHEREAS, The Allman Family L'mdt~ Partnership, the developer of the Allman Water &
Sanitary Sewer Extension has not completed all the required public improvements in accordance with the
approved construction drawings and town standards within the mo-year period agreed to in the contract for
public improvements; and
WHEREAS, thc developer has requested a time extension for completion of the public
improvemonts until we receive the contract and replacement bond from Kid's Domain LLC; and
WHEREAS, a letter of credit from the Potomac Bank of Virginia in the mount of $33,000.00 was
provided by the developer to guarantee the installation of public improvements; and
WHEREAS, the town's Director of Engineering and Public Works recommends a time extension
to July 18, 2005.
THEREFORE, RESOLVED by the Council of the Town of I.~esburg in Vffginia as follows:
SECTION I. The letter of credit from the Potomac Bank of Virginia in the mount of
$33,000.00 is approved to guarantee the installation of public improvements at the Allman Water &
Sanitary Sewer Extension.
