RESOLUTION NO. 2004-124 ADOPTED: July 13, 2004
A RESOLUTION: APPROPRIATING $130,000.00 FROM THE LOUDOUN COUNTY
GASOLINE TAX FOR THE EVERGREEN' MILL ROAD/TOLBERT
LANE IMPROVEMENTS PROJECT AND AWARDING A
CONSTRUCTION CONTRACT TO OMNI EXCAVATORS, INC., FOR
CONSTRUCTION OF THIS PROJECT.
WHEREAS, intersection improvements consisting of a left-turn lane from Evergreen Mill
Road onto Tolbert Lane, widening and lengthening the right-turn lane from Evergreen Mill Road
onto Tolbert Lane, providing a left-tum lane and a right-turn lane on Tolbert Lane onto Evergreen
Mill Road, adding a sidewalk, crosswalks, and a signal at that intersection will improve safety and
reduce congestion; and
WHEREAS, funding from Loudoun County Gasoline Tax in the amount of $420,000.00
was appropriated in the FY 2004 mid-year budget; and
WHEREAS, the total funding needed for engineering, construction, and contingencies of this
project is estimated at $550,000.00; and
WHEREAS, the Loudoun County Board of Supervisors, at their meeting on July 6, 2004,
approved additional funding from the Loudoun County Gasoline Tax in the amount of
$130,000.00; and
WHEREAS, an Invitation for Bids (IFB) was issued for the construction of this project in
accordance with the Town of Leesburg Purchasing Policy; and

LANE IMPROVEMENTS PROJECT AND AWARDING A
CONSTRUCTION CONTRACT TO OMNI EXCAVATORS, INC.,
FOR CONSTRUCTION OF THIS PROJECT.
WHEREAS, bids were received from Omni Excavators, Inc., in the amount of
$434.919.80; Cube Construction Corporation in the amount of $587,146, 00; and from A&M
Concrete Corporation in the amount of $728,534.50; and
WHEREAS, the bids were evaluated by the Capital Projects Director and Chief Purchasing
Officer in accordance with the Town of Leesburg Purchasing Policy; and
WHEREAS, Omni Excavators, Inc., was determined to be the lowest responsive and responsible
bidder; and
WHEREAS, this is a unit-price contract and the final contract amount will be arrived at by
multiplying the bid unit prices by the actual approved quantities in place; and
WHEREAS, the Capital Projects Director recommends approval to award the construction contract
to Omni Excavators, Inc., in the initial amount of $434,919.80 for this project.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. Funding in the amount of $130,000.00 from Loudoun County Gasoline Tax is hereby
appropriated for this project and shall remain in effect until such project has been completed.
SECTION II. The Town Manager is hereby authorized to award, on behalf of the town, a unit-
price contract to Omni Excavators, Inc., in an estimated amount of $434,919.80 for construction of the
Evergreen Mill Road/Tolbert Lane Improvements Project.
