ORDINANCE NO. 41 3.2-
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REVISING CHAPTER 15 OF
THE CITY CODE RELATING TO A PRESCRIPTION DRUG MONITORING PROGRAM
WHEREAS, prescription drug, in particular opioid, abuse has been recognized as a
• nationwide epidemic and forty-nine states have established prescription drug monitoring
programs to combat the problem; and
WHEREAS, in the absence of a statewide program in Missouri, various counties and
cities are cooperating to institute their own prescription drug monitoring programs; and
WHEREAS, Cole County has joined with the St. Louis County Department of Health,
which has established a program for monitoring the prescribing and dispensing of schedule II,
III, and IV controlled substances; and
WHEREAS, Cole County has or will enact and execute all necessary and appropriate
regulations, documents and agreement to participate in the aforementioned prescription drug
monitoring program; and
WHEREAS, It is the desire of the City to support Cole County in its goal of protecting the
public health safety and general welfare by ensuring and requiring participation in the
prescription drug monitoring program within the corporate limits of the City;
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The recitals set forth above are hereby referenced and incorporated as
though set forth herein in full.
Section 2. Chapter 15 (Health and Sanitation) is hereby amended to add a new Article V
(Prescription Drug Monitoring Program), to read as follows:
ARTICLE V. PRESCRIPTION DRUG MONITORING
Sec. 15-160.Definitions.
For the purposes of this article,the following words and phrases shall have the meanings respectively
ascribed to them ky this section:
Dispenser. A person who delivers a Schedule II,III,or IV controlled substance to a patient.However,the
term does not include:

(a) a hospital as defined in Section 197.020 RSMo that distributes such substances for the
purpose of inpatient care,or dispenses prescriptions for controlled substances at the time of
discharge from such facility;
(b) a practitioner or other authorized person who administers such substance;
(c) a wholesale distributor of a Schedule II,III,or IV controlled substance;or
(d) a veterinarian licensed pursuant to Chapter 340 RSMo.
Patient. A person who is the ultimate intended user of a drug for whom a prescription is issued,or for whom
a drug is dispensed,not including a hospice patient enrolled in a Medicare-certified hospice program who has
controlled substances dispensed to him or her ll such hospice program.
Prescription Drug Monitoring Program. A program administered la Cole County Health Department under
agreement with the St.Louis County Department of Health for monitoring the prescribing and dispensing of
schedule II,III,and IV controlled substances ll professionals licensed to prescribe or dispense such
substances.
Schedule II,III,IV,or V Controlled Substance. A controlled substance listed in Schedules II,III,or IV as
set out in Section 195.017 RSMo.or the Controlled Substance Act,21 U.S.C.Section 812.
Sec. 15-161.Reporting required.
A. At any time a Prescription Drug Monitoring Program is authorized la the Cole County Commission and
being administered la the Cole County Health Department,within seven business days of having
dispensed a Schedule 1I,III,or IV controlled substance,all dispensers must submit12y electronic means,
information regarding such dispensing through the approved vendor system of the Prescription Drug
Monitoring Program.
B. The information submitted for each dispenser to the Prescription Drug Monitoring Program shall at a
minimum include:
a. The pharmacy's Drug Enforcement Number(DEA);
b. The date of dispensation;and
c. If dispensed via a prescription:
i. the prescription number;
ii. whether the prescription is a new or a re-fill;
iii. the prescriber's DEA or National Provider Identifier number;
iv. the national drug code of the drug dispensed;
v. the quantity and dosage of the drug dispensed;and
vi. an identifier for the patient for whom the drug was dispensed,including but not limited
to any one of the following:
1. driver license number,
2. government issued identification number,
3. insurance cardholder identification number,or
4. the patient's name,address,and date of birth.
C. The dispenser's submission of the required information to the Prescription Lim Monitoring Program,
shall be in accordance with the transmission standards established12y the American Society for
Automation in Pharmacy,or an of its successor organizations.

Section 3. This Ordinance shall be in full force and effect from and after the date of its
passage and approval.
