AUI~O~G TIME EXTENSIONS FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES FOR
RIVER CREEK PHASE Iff, SECTION 4; PHASE V, SECTIONS 2, 3, & 4; PHASE
VII, SECTIONS 2, 3, & 4B; POTOMAC SANITARY SEWER PUMP STATION;
GOLF COURSE FACILITIES EXTENSION OF WATERMAIN; AND GOLF
COURSE SANITARY SEWER CROSSING FAIRWAYS 11 & 12
WHEREAS, River Creek LLC, the developer of River Creek Phase Iff, Section 4; Phase V, Sections 2,
3, & 4; Phase VII, Sections 2, 3, & 4B; Potomac Sanitary Sewer Pump Station; Golf Course Facilities
Extension of Watermain; and Goff Course Sanitary Sewer Crossing Fairways 11 & 12, has not completed all
the required public improvements in accordance with the approved construction drawings and town standards
within the two-year period agreed to in the contract for public improvements and previously approved time
extensions; and
WHEREAS, the developer has requested a time extension to complete the public improvements; and
WHEREAS, these sections of River Creek Subdivision are located in Loudoun County and the town's
bonded improvements are water and sanitary sewer only; and
WHEREAS, corporate sure~y bonds from the Fidelity and Deposit Company of Maryland in the
amount of $5,437.90 for Phase III, Section 4; in the amount of $7,583.18 for Phase V, Section 2; in
the amount of $3,$85.67 for Phase V, Section 3; in the amount of $26,599.65 for Phase V, Section 4;
in the amount of $12,510.00 for Phase VII, Section 2; in the amount of $16,801.51 for Phase VII,,
Section 3; in the amount of $3,607.00 for Phase VII, Section 4B; in the amount of $ 233,842.00 for
the Potomac Sanitary Sewer Pump Station; in the amount of $6,800.20 for the Golf Course Facilities
Extension of Watermain; and in the amount of $92,400.00 for the Golf Course Sanitary Sewer
A RESOLUTION:

AUTHORIZING TIME EXTENSIONS FOR COMPLETION OF PUBLIC
IMPROVEMENTS AND APPROVING PERFORMANCE GUARANTEES
FOR VARIOUS SECTIONS OF RIVER CREEK SUBDMSION
Crossing Fairways 11 & 12 were provided by the developer to guarantee the installation of public
improvements; and
WHEREAS, the town's Director of Engineering and Public Works recommends a time extension to Suly
31, 2005 for the s~ztions of the River Cr~k Subdivision listed above.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virgi~'nia as follows:
SECTION I. The corporate surety bonds from the Fidelity and Deposit Company of Maryland in the
amount of $5,437.90 for Phase III, Section 4; in the amount of $7,553.18 for Phase V, Section 2; in
the amount of $3,585.67 for Phase V, Section 3; in the amount of $26,599.65 for Phase V, Section 4;
in the amount of $12,510.00 for Phase VI/, Section 2; in the amount of $16,801.51 for Phase VII,
Section 3; in the amount of $3,607.00 for Phase VII, Section 4B; in the amount of $ 233,842.00 for
the Potomac Sanitary Sewer Pump Station; in the amount of $6,800.20 for the Golf Course Facilities
Extension of Watermain; and in the amount of $92,400.00 for the Golf Course Sanitary Sewer
Crossing Fairways 11 & 12 are approved to guarantee the installation of public improvements in these
sections of the River Creek Subdivision.
SECTION II. A time extension to July 31, 2005 for the sections of the River Creek Subdivision listed
above for completion of the public improvements are approved.
