Agenda for Planning Board Meeting, June 2, 1983, 7:30 P.M. at the Town Hall
Item 1- Subdivision Courtesy Review of Bessie Crabtree property subdividing
off one lot at the Southeast corner of East Drive, off of Boundary.
Drive (off Terrell Road). The road and turnaround are the main issues.
Item 2- Ben Lloyd questions the correct zoning of the service station at the
Southwest corner of Corbin and Churton Streets. The maps record the
zoning at R-20. Lloyd says that it has always been used commercially
so the maps must be in error.
Item 3- Rezoning of West Hillsborough: question of property zoned R-10 at the
corner of WEst Hill and Piney Lane
Item 4- Request to drop the 150 foot width lot requirement for duplexes in the
Conditional Use Requirements of the Ordinance.
Item 5- Committee Reports
Item 6- Review of Sections 13 and 14 for preparation for Public Hearing
HILLSBOROUGH PLANNING BOARD MINUTES
June 2, 1983 Meeting
Members present: Myron Martin -Vice Chairman (presiding), Hilda Brody, Judy
Cox, Rick Cannity, Nancy Goodwin and Josephine Holman.
Others present: Steve Yuhasz, Sue Jones, James Rae Freeland, Evelyn Hicks,
Mr. and Mrs. Calvin Ashley and Zoning Officer.
Martin called the meeting to order at 7:30 P.M. He described the first item
on the agenda, the subdivision courtesy review of a subdivision of one lot
from the Bessie Crabtree property. The lot to be created would be at the
southeast corner of East Drive, off of Boundary Drive.
Maltbie noted that the Town Board would be reviewing the subdivision also
since Orange County Planning Department wanted a statement that the Town
would accept East Drive as a public road. The Town is currently maintaining
East Drive which has only a 16 foot right of way for the road.
Yuhasz said that most often when a Town maintains a street, they are willing
to accept it as a public street.
Maltbie noted that 16 feet was needed for pavement or roadbed and additional
footage Baas needed for side ditches. Mr. Smith said that six or eight feet
of additional right of way might be required on the west aide of the new
segment of East Drive. In order for the Town to use Powell Bill funds on
maintenance of the East Drive, the side ditches would have to be acquired.
Yuhasz suggested waiting and letting the Town acquire the extra right of
way that it wanted.
Cannity noted that in the future, the Town would have to pay for the street
right of way on East Drive, so the right of way should be obtained now for
the segment of East Drive involved in the subdivision. He stated that
the Ralph Neighbors lot doesn't now have public road access which it would
have after the subdivision. The rectangular turnaround would be an improvement
since there is no turnaround currently.
Brody questioned notification of adjoining property owners and what the other
owners felt about the subdivision. Yuhasz said that the owners had been informed
and had not objected.
Cannity made a motion that the Planning Board recommend approval of the subdivision
with the condition that an additional eight feet of right of way be dedicated
along the eastern boundary of lot number one. Cox seconded the motion which
passed unanimously.
Item 2 was considered. Ben Lloyd said the maps were in error on his service
station at the corner of Corbin and Churton since the use had always been
commercial. His statements were relayed to the Planning Board by the Zoning
Officer as part of the agenda. Since Mr. Lloyd was not present, the next
item was considered. The next item had been added to the agenda. Mr.
Freeland and Mrs. Jones were interested in an interpretation of the Ordinance
regarding lots without Town sewer lines. Cannity suggested that the proper
procedure would be for the Zoning Officer to make a written interpretation
and that interpretation could be appealed to the Board of Adjustment if the
property owner or representative disagreed with the interpretation.

Cox said that she believed that at the time of the ordinance.preparation, Section
2 was intended to require both water and sewer systems in order to allow building
on a 20,000 square foot lot. The revisions to the ordinance will make this section
of the ordinance clearer.
Martin noted that the Zoning Officer's ruling could be appealed to the Board of
Adjustment if the applicant disagreed.
Item 3 was considered next. The rezoning of West Hillsborough and possible map
errors were discussed. C. Ashley said that some of the land in West Hillsborough
should have been upgraded one and one-half years ago. One parcel of land in parti-
cular could be rezoned to R-15 from R-10; the Ashleys and Evelyn Hicks thought the
land was rezoned during the West Hillsborough rezoning.
Martin said that other people in West Hillsborough thought there were some areas
that were supposed to have been rezoned at that time..
Cox said that if the majority of lots in a block were too small to be upgraded,
the block would be left R-10. It would have been unfair to people with smaller
lots to penalize them.
Holman questioned why this was being brought up and if someone was starting to put
something in that would be undesirable.
Hicks said that the neighbors did not know that the lot in question (34-Q-1) was
zoned R-10 until a variance on adjacent property was requested recently. The
neighbors are concerned about someone putting a mobile home on the lot and renting
it. The lot is now for sale.
The recommendation was made that the neighbors ask the property owner if she
wants to request a rezoning. Since the Town Board adopted the Zoning Map as
shown after public hearings and Planning Board recommendation, the only method
of change of that map would be through the rezoning process.
Item 2 was considered next. The service station at the Southwest corner of
Corbin and Churton Streets was a closed station at the time that the 1979
Zoning Ordinance was adopted. Cox said that it was not an error that the
station property was zoned residential.
Martin said that Frank Sheffield had told him that he would prefer that Mr.
Lloyd wait until Section 8 was completed. Also non -conforming uses were to
be studied by a graduate student and recommendations were to be made on all
of the non -conforming uses. Mr. Lloyd could wait for the non -conforming uses
to be considered by the Planning Board or he could request a rezoning.
The service station operators are wanting to use their location to sell furniture
in addition to their current business. They did sell furniture on the weekends
until they found out that they could not do that with their non -conforming status.
Goodwin said that under Section 8 revisions, some non -conforming uses will have
to have a conditional use permit and will have a year to come into compliance.
Holman pointed out the need for something to be done about loud noise' Martin
agreed and suggested that the Planning Board recommend that the*Town Board adopt
a noise ordinance. Cox suggested getting some model noise ordinances; particularly
from Carrboro. Item 4 was referred to the Multi -family Committee. Zoning Officer
requested one additional month for the Payne MHPs, which was granted.

Brody suggested adding two goals for the coming year to the Planning Board's
agenda: 1- Upgrading and including the mill village in the Historic District.
(This is the area Southwest of King and Nash Streets.) 2- Public Meeting of
the Planning Board and the Historic District Commission with a presentation
by Archives and History Department of State government.
Sections 13 and 14 were sent to the .Institute of Government for comments.
The meeting was adjourned.
