A RESOLUTION: 2004-136 PRESENTED: ADOPTED: August 10, 2004 August 10, 2004 APPROVING SPECIAL EXCEPTION TLSE-2003-0004, WATER POLLUTION CONTROL FACILITY EXPANSION, 1391 EAST MARKET STREET, TO EXPAND EXISTING SEWAGE TREATMENT PLANT WHEREAS, the Town of Leesburg Department of Utilities has requested special exception approval to expand an existing water pollution control facility on a 54.47-acre parcel at 1391 E. Market Street; and WHEREAS, the property is located in the I-1 Industrial Research Park Zoning District and the Creek Valley Buffer Overlay District; and WHEREAS, on June 17, 2004 the Planning Commission recommended conditional approval of this application; and WHEREAS, on July 27, 2004 the Town Council held a public hearing on this application; and WHEREAS, the proposed use meets the special exception standards for major public utility as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval with the conditions set forth below. THEREFORE, RESOLVED by the Council of the Town of Leesburg inVirginia as follows: Special Exception application TLSE-2003-0004, Water Pollution Control Facility Expansion, 1391 East Market Street, identified in the Loudoun County Land Records as Parcel Identification Number 149-35-8258, is hereby approved subject to the following conditions: -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2003-0004 WATER POLLUTION CONTROL FACILITY EXPANSION, 1391 EAST MARKET STREET 1. Prior to approval of a Final Development Plan, Applicant shall provide a traffic impact analysis of the ultimate development site entrance to Russell Branch parkway to determine if the ultimate development will accommodate future entrances. 2. Prior to approval of a Final Development Plan, the proposed utilities expansion will be coordinated with the grading, horizontal alignment, and vertical alignment of Battlefield Parkway, Russell Branch Parkway and Trailview Drive. 3. Applicant agrees to access the property from Russell Branch Parkway and Battlefield Parkway as soon as Russell Branch Parkway and Battlefield Parkway are constructed from the site to Route 7 and a traffic signal is installed at Route 7 and Battlefield Parkway. 4. Applicant agrees that once access to Route 7 is provided along Battlefield Parkway, the existing access to Route 7 will no longer be used. 5. Prior to approval of a Final Development Plan the Applicant shall provide for approval a preliminary design of the entrances to the WPCF and the Utility Lines Maintenance Building with Russell Branch Parkway and Battlefield Parkway in place. 6. Prior to approval of a Final Development Plan the Applicant shall relocate the proposed entrance drive to the south of the 35-foot buffer yard adjacent to future Russell Branch Parkway right-of-way. 7. Prior to approval of a Final Development Plan, a storm water management plan shall be submitted in accordance with Leesburg and Loudoun County stormwater management criteria. 8. Powder-coated black vinyl fencing shall be installed as part of the screening along both Battlefield Parkway and Russell Branch Parkway. This fence shall be located on the interior side of the required screening along both of these roadways, with the landscaping situated between the property line and the fence. 9. Applicant shall revise the plat to indicate a 35' buffer along proposed Russell Branch Parkway collector road along the maintenance buildings, a 50' buffer along proposed Battlefield Parkway alongside the maintenance buildings, and a 25' buffer with an S2 Screen along the southern property boundary. 10. Applicant shall revise the plat to increase the interior parking lot islands to a minimum width of 9 feet per Section 12.6.3.B. 11. Applicant shall revise the plat to show FEMA 100 year floodplain based on the Flood Insurance Rate Map Panel 235. 12. Applicant shall revise the plat to indicate the location of the Creek Valley Buffer on the property in accordance with Article 14. 13. Applicant shall revise the lot width provided on Sheet 1 to indicate "50' at front yard setback (legally nonconforming); 1,737.91 L.F.+/- at rear yard setback. 14. Site lighting must be in conformance with the DCSM which requires no more than 0.5 foot-candles at the property boundary, and the source of illumination not visible to off- site properties. 15. The use of outdoor speakers an/or paging systems shall be prohibited. Development of this special exception use shall be in substantial conformance with the plat entitled "Special Exception Plat - To Permit Major Utility within the Town of Leesburg" dated July 7, 2003 prepared by Patton, Harris, Rust & Associates, P.C., and as modified by these conditions. 17. Approval of this special exception application does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, Zoning Ordinance, or Design and Construction Standards Manual, and that final plats, development plans and construction drawings are subject to the applicable town regulations.
