CORRECTING RESOL~ON NO. 2004-132 PERTAINING TO RIVER CREEK
PHASE VII, SECTIONS 4, 4A, AND 4C
WHEREAS, on August 10, 2004 the Leesburg Town Council adopted Resolution #2004o132
authorizing agreements and approving performance guarantees from the Fidelity and Deposit Company of
Maryland in the amount of $176,458.30 for River Creek Phase VII, Section 4A, and in the amount of
$54,045.20 for Phase VII, Section 4C to replace the agreement and corporate surety bond from the
Fidelity and Deposit Company of Maryland for River Creek Phase VH, Section 4; and
WHEREAS, River Creek L.L.C., the developer of River Creek Phase VII, Sections 4A and 4C
had requested approval of corporate surety bonds from the Hartford Fire Insurance Company; and
WHEREAS, the Director of Engineering & Public Works recommends approval of corporate
surety bonds from the Hartford Fire Insurance Company for River Creek Phase VII, Sections 4A and 4C
in lieu of the agreement and corporate surety bond from the Fidelity and Deposit Company of Maryland
for River Creek Phase VII, Section 4.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
Town Council Resolution #2004-132 is hereby corrected to reflect the approval of performance
guarantees from the Hartford Fire Imm Company in the amount of $176,458.30 for River Creek
Phase VII, Section 4A, and in the amount of $54,045.20 for River Creek Phase VII, Section 4C.
