HomeMy Public PortalAbout2004_09_14_r146The Town of Leesburg, Virginia PRESENTED September 14, 2004 RESOLUTION NO. 2004-146 ADOPTED September 14, 2004 A RESOLUTION: AUTHORIZING STAFF DISCUSSIONS WITH FESTIVAL LAKES REGARDING ZONING ALTERNATIVES AND UTILITIES EXTENSION OPTIONS WHEREAS, representatives of J.R. Festival Lakes approached the town regarding their desire to develop their (approximately 105 acres) property consistent with sound planning practices; and WHEREAS, this property historically has been used for recreational purposes and has had its sewage handled by a private hauler under a permit from the town; and WHEREAS, the Festival Lakes representatives have been advised that the town's recent practice has been to extend utilities outside the town's boundary only to government uses and with a boundary line adjustment; and WHEREAS, Festival Lakes asserts that it is entitled to sewer service by virtue of a previous agreement/requirement that the town would authorize sewer when it was generally available in the area; and WHEREAS, all property surrounding Festival Lakes is zoned for residential uses and all are served by town water and sewer, with some properties in the town, some in the county; and RESOLUTION' -2- AUTHORIZING STAFF DISCUSSIONS WITH FESTIVAL LAKES REGARDING ZONING ALTERNATIVES AND UTILITIES EXTENSION OPTIONS WHEREAS, the request by Festival Lakes has been reviewed by town staff and it is the recommendation of the town manager that the staff be authorized to discuss zoning alternatives for the property; recognizing that if the Council agrees to extend utilities, a BLA will be required; and WHEREAS, should the Town Council approve any utility extensions, rezoning, BLA or similar applications, all costs will be borne by the owner/applicant. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The staff is authorized to proceed with discussions with Festival Lakes regarding zoning alternatives and utilities extension options.
