A RESOLUTION OF THE CARSON CITY COUNCIL AMENDING THE FISCAL
YEAR 2021-22 BUDGET NON-DEPARTMENT, NON-DEPARTMENT
DIVISION FOR AIR PURIFIERS.
WHEREAS, the City Council adopted the City’s Fiscal Year (FY) 2021-22 budget on June 15, 2021;
and
WHEREAS, between October 4, 2021 and present the City of Carson (“City”) and County of Los
Angeles (“County”) have received in excess of 1000 complaints from the City and County residents
regarding a foul “rotten egg-like” odor emanating from the Dominguez Channel in the vicinity of the
intersection of the 405 Freeway and Avalon Boulevard in the City of Carson: and,
WHEREAS, the South Coast Air Quality Management District and Los Angeles County HazMat,
among other public agencies, responded to the incident and performed air quality testing; and,
WHEREAS, the test results show that the odor is due to a release of hydrogen sulfide (“H2S”) gas;
and,
WHEREAS, as of October 14, 2021 the regulatory agencies investigating the release have not
determined its exact source; and,
WHEREAS, pursuant to Carson Municipal Code sections 5702(w), 5100 (adopting Los Angeles
County Health Code), and 5703, and Civil Code section 3479, the malodorous conditions constitute a
public nuisance in that it is detrimental to health, offensive to the senses, interferes with the comfortable
enjoyment of life or property, and affects at the same time an entire community or neighborhood and the
City declared a public nuisance on October 11, 2021; and,
WHEREAS, the County has already accepted responsibility for mitigating the public nuisance and
has agreed to reimburse the City’s affected residents and employees for costs associated with
mitigating the effects of the nuisance by providing reimbursement for HEPA masks, HEPA air filters, and
relocation costs;
WHEREAS, in connection with addressing the Public Nuisance, the City desires to assist the County by providing the City’s vulnerable residents such as senior residents, disabled residents, and low income residents (“Vulnerable Residents”) with HEPA masks and HEPA air filters to which the County shall
reimburse the City; and
WHEREAS, the City wishes to budget funds to purchase air purifiers for residents to mitigate
odor emanating from Dominguez Channel and to procure other supplies and services related to the
same.

WHEREAS, the City Council desires to amend FY 2021-22 budget to authorize the use of funds
from the Unreserved Budget to purchase these items.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARSON DOES HEREBY RESOLVE, FIND,
DETERMINE, AND ORDER AS FOLLOWS:
Section 1. The following amendments will be made to the City’s budget:

Section 2. The City Clerk shall certify to the adoption of this resolution and shall keep a copy of
this resolution attached to the FY 2021-22 budget on file, and effective as of October 19th, 2021, the
same Shall be in force and effect.
