Minutes of August 4, 1983 Meeting
Members present: Martin. -Vice Chairman, Goodwin, Cannity, Oakley, .Brody, Dorward
and Cox.
Others present: Walter Faribault, Jr., Ellwood Hicks, Clarence Jones and Kay
Maltbie, Zoning Officer
Additions were made to the agenda including the following:
Faribault request for rezoning;
Hilda Brody agreement to serve as Historic District Commission representative
from the Planning Board;
Lloyd property at the corner of Churton and Corbin Streets; and
A -R minimum lot size.
The first item considered was the Faribault request fpr;,rezoriin.g. There was a
question for the Planning Board's consideration of whether General Commercial
or Neighborhood Commercial was the most appropriate request in this case. The
barbeque business was closed in May of 1981 according to Mr. Faribault. He said
that he wanted a quieter business since the building was just in front of his
parents' home. He said that for now the business would be small, just a one or
two chair beauty parlor, to be run by a person who had been unemployed recently.
Brody noted that if General Commercial were requested, it would raise questions
of spot zoning and developers would want to add more of the surrounding area into
the General Commercial zone.
Cannity noted that General Commercial would allow all of the uses listed under
General Commercial in the Ordinance. The preference of the Planning Board was
clearly that a request to Neighborhood Commercial would be a more appropriate
request than a request to General Commercial. Mr. Faribault agreed with the Board.
Cox made a motion that the Planning Board request that the Town Board set a date
as soon as possible for a public hearing for rezoning to Neighborhood Commercial
for the Faribault property which includes the old barbeque building. Oakley
seconded the motion which passed.
Item 1 on the written agenda was then considered. Ellwood Hicks' MHP was reviewed.
The driveway was not 25 feet wide or wide enough for two cars to pass. Hicks
said that he did not want to cut into the yards or into the old trees to widen
the driveway. He said that a large mobile home park might need a wider driveway,
but the three homes in this MHP did not need a wider driveway.
Brody pointed out the lack of skirting on the double wide nearest the curve of
Lakeshore. Hicks said that the double wide would have a brick or concrete block
skirting on the base of the mobile home. He also said that the road had a good
base and no ruts due to maintenance and gravel placed on the road for 15 years.
Cannity made the motion that the Hicks' MHP consideration be postponed until the
next meeting for zoning officer inspection and report. Cox seconded the motion
which passed unanimously.
Martin then read a letter .from Josephine Holman who resigned her Planning Board
Membership due to other obligations and who suggested Tarleton Davis as replacement.
The Planning Board recommended that Frank write a letter of appreciation to Holman
regretfully accepting her resignation.

Cannity suggested that the Planning Board get the Rules and Procedures of the
Orange County Planning Board.
Item 2 on the agenda was considered next. The mobile homes at King and Nash
were reported by Clarence Jones as not being skirted yet. Also the ownership of
the lot and compliance with the ordinance were discussed. Oakley made a motion
that the Zoning Officer enforce the ordinance by notifying the mobile home owners
that they have two weeks to come into compliance before taking the matter to the
Town Attorney and to the Town Board. Dorward seconded the motion which passed
unanimously.
The mobile homes at the corner of Latimer and Lakeshore were considered. The
previous zoning officer had given three zoning permits to the owner of the
homes since the lots were all deeded and were lots of record. The zoning officer
is to check the building on the property also to see if it is being used as a
dwelling.
Hilda Brody has agreed to serve on the Historic District Commission as a represen-
tative from the Planning Board.
Martin announced that Sheffield is writing a letter to the Town Board regarding
the Lloyd property at the corner of Churton and Corbin Streets which needs a
rezoning public hearing and recommendation from the Planning Board to the Town
Board in order to follow the legal requirements of the Ordinance.
The minimum lot size for A -R was determined to be 25,000 square feet.
Section 13 and 14 were presented for review.
Dorward reported the denied variances from the Board of Adjustment. The Planning
Board commended the BOA for adhering to the ordinance.
Goodwin reported that Section 11 has been typed and will be taken to committee and
then sent to the Institute of Government and to the Planning Board.
Cox reported that the Tree Board will have a workshop on September 21st Wednesday
from 9 to 1 P.M. on maintenance, planting and care of trees. Also there.will be
a first Town Arbor Day celebration which is one of the requirements for becoming
Tree City U.S.A.
The Hillsborough Motel mobile home was discussed. If the mobile home is parked
and not used, it can remain according to the Institute of Government.
Cox made a motion that the Planning Board write to the NC DOT and ask them to
put a third land on Highway 86. Oakley seconded the motion which passed with
two opposed, Goodwin and Brody.
