Hamlett ?T1\' August 29, 1983 To: Planning Board and News of Orange From: Frank Sheffield Agenda for September 1, 1983 Planning Board Meeting at the Town Hall. As you know the first Thursday of each month the Planning Board has the regularly scheduled meeting at 7:30 P.M. Since the rezoning Public Hearing is at 7:00 P.M. on that evening, the Planning Board Meeting will be held immediately after the Public Hearing. Agenda: Item 1: Mrs. Elizabeth Collins is requesting a minor subdivision for a two acre lot to be subdivided from her property at the Southeastern corner of Churton and 70 A. Item 2: Faribault Rezoning Request (If the Planning Board feels that they have all the necessary information and is ready to make a recommendation on this item, then it can be discussed.) Item 3: Lloyd Rezoning Request (Same as in Item 2) Item 4: Request from Roosevelt Warner to change the Ordinance to allow a non -conforming use to enlarge 35 percent. Item 5: Report on Hicks MHP HILLSBOROUGH PLANNING BOARD Minutes of September 1, 1983 Meeting Members present: Sheffield -Chairman, Goodwin, Martin, Brody, Oakley and Dorward Others: Clarence Payne, Ben Lloyd, Sharon Freeland,, Roosevelt Warner, and Kay Maltbie, Zoning Officer Sheffield called the meeting to order and read a letter of resignation from Arthur Plambec Martin made a motion that a copy of the letter go to the Orange County Commissioners and to the Town Board Members. Oakley seconded the motion which passed unanimously. Martin suggested that the Town Board .should hold an interview session prior to the next Town Board meeting so that new Planning Board members could be appointed as soon as possible. Item 1- Planning Board review of Miss Elizabeth Collins' request for a minor sub- division. The map was reviewed. The new lot will face 70-A and will have two acres so that the zoning is satisfied. Dorward moved that the Planning Board recommend approval to Orange County. Brody seconded the motion which passed unanimously. Item 2- The Faribault property was considered regarding the request for rezoning. Brody questioned the parking. Oakley said that parking wouldn't be a problem there. Martin asked about the distance from the road. He said that there was a question of future use since another barbeque place could be a problem in terms of parking and the right of way. It is located outside the Historic District. The Board noted that the Town Board could be asked to give relief to the 100 foot right of way which the NC DOT had turned over to the Town . The one acre lot should be recorded as a subdivision if it was not already recorded. Dorward said that he felt more comfortable with it since it would be zoned Neighbor- hood Business. Payne said he could not understand why the Board was concerned and afraid that.i.if one lot was zoned general commercial, more commercial requests would be made. He said that as the Town grew there would be a need for more commercial. Martin made a motion that a recommendation be made to the Town Board for approval of the petition for rezoning to Neighborhood Business by Mr. Far ibault subject to the proper subdivision of the lot and subject to the Town Board's changing the right of way from 100 feet to no more than 60 feet along Exchange Park Lane. Brody seconded the motion which passed unanimously. Item 3- Lloyd rezoning request. Brody suggested and made a motion that consideration of the request be delayed until input from the Historic District Commission and Chairm.-x-n could be obtained. Martin approved the motion and said that he could like to view the property before he made a decision. Dorward suggested acting in a reasonable time for Mr. Lloyd. Dorward seconded the motion which passed unanimously. Page two, Planning Board meeting of September 1, 1983 Payne said that the property has been used commercially for years. There is no need for the Historic District Commission to be involved in the recommendation. Martin said that it the right of each resident to enjoy the land. The neighbor (Sharon Freeland) is opposed. I feel that I should view it. Sheffield suggested combining the special session to consider the Lloyd rezoning request with a work session on the proposed revisions to the Zoning Ordinance. Lloyd asked if there was any information that he could get for the Board. Brody asked how he could have gone to the Town Board about it being commercial. Lloyd said that it had been commercial in 1948. He could not understand how the property could ever have been zoned residential. He said that he was not notified. He noted that the wall map in the zoning office had said that the property was zoned commercial. The Zoning Officer said that the first time Mr. Lloyd had come to check on the zoning, he had been informed that the official map said that the property was zoned residential and that the wall map was in error and would be corrected. The map in the barn was also checked at the same time. The note on the property said "closed station." Mr. Lloyd was aware of that at the time. Discussion of the date of a meeting to discuss the rezoning request was held. There was not one evening convenient for all, but a meeting had to be called in order to comply with the ordinance requirement that a recommendation be made within thirty days. Oakley made a motion that a special meeting be convened in 30 days with the meeting to be called by the chairman and coupled with a work session. Dorward seconded the motion which passed unanimously. Item 4 Warner asked that the Planning Board consider a .revision to the Ordinance allowing a nonconforming business to enlarge 35 percent in his written request. At the meeting, Warner said that he needed to change that to allow the enlargement of a business to 50 percent. Sheffield said that virtually the entire ordinance is now under revision. This request would apply to all nonconforming uses and would be a significant change. He would send it to the subcommittee working on the nonconforming section.
