REGULAR COUNCIL MEETING, JANUARY 17, 2017
CALL TO ORDER
The Regular Council Meeting of January 17, 2017, was convened at 6:00 P.M. by
Mayor Carrie Tergin.
ROLL CALL
The f ollowing Council Members were present for the roll call:
Present: Branch, Graham, Henry, Hussey, Mihalevich, Schreiber, Ward,
and W iseman
Absent: Prather
A quorum was declared present.
ADOPTION OF THE AGENDA
A motion was made by Councilman Graham, seconded by Councilwoman W ard , to
adopt the agenda as published . The motion was approved unanimously.
NOMINATIONS OF WARD 4 COUNCIL MEMBER
Following an explanation by City Counselor Moehlman of the procedures set out in the
City Code for nominating a Council Member to fill a vacancy, the following n ominations
were brought forward:
Councilman Branch nominated Mr. Bill Luebbert, seconded by Councilman Mihalevich.
There were no other nominations.
A motion was made by Councilman Mihalevich to set the election date for the new
Council Member for the February 6, 2017, City Council meeting. The motion was
seconded by Councilwoman Ward and approved unanimously.
Mr. Moehlman stated that a public forum would need to be held between the nomination
and election which could be at any point up to, and including as par t of, the February 6
Council meeting. The date of that forum would be determined and announced after Mr.
Luebbert has been consulted regarding his schedule.

MISCELLANEOUS AGENDA ITEMS
Mayor Tergin introduced Mr. Sonny Sanders who had agreed to serve as Interim
Planning & Protective Services Department Director.
City Administrator Crowell introduced and presented Jefferson City Firefighters Pipes &
Drums as Outstanding Employee Award Recipients for January. The members of the
band appeared in their band uniform attire and played a sample of their music for the
audience. Mayor Tergin and the Council Members congratulated them upon this
recognition and thanked them for their contribution to the community in their volunteer
capacity by appearing at numerous functions and events.
Mayor Tergin read and presented a proclamation to Mr. Dave Griffith and several
members of the Red Cross in honor of the 100th anniversary of the American Red Cross
of Central and Northern Missouri. Mr. Griffith made a presentation and introduced the
other members present and thanked the City for the recognition. Mayor Tergin and the
City Council congratulated the organization and thanked them for all they do in the
community.
Fire Chief Matt Schofield made a presentation regarding fire sprinklers, and introduced
Mr. Norm Robinson and Susan Cook from River City Habitat for Humanity. Ms. Marlene
Medin was also recognized in the audience for her contribution to the effort of placing
sprinklers in the Habitat homes. Following the presentation, Mayor Tergin thanked Chief
Schofield and Habitat for Humanity for their contribution to the community.
PUBLIC HEARINGS
Preliminary PUD Plan Amendment for Property Addressed as 925 S. Country Club
Drive and Final Subdivision Plat of Westport Plaza Subdivision:
A staff presentation was made by Senior Planner Eric Barron who stated that a
substitute bill 2016-95 had been distributed and explained the changes to the plat
contained in the substitute.
A motion was made by Councilman Graham to accept the substitute Bill 2016 -95
previously distributed, seconded by Councilwoman Wiseman, and approved
unanimously.
Following the conclusion of the staff presentation, Mayor Tergin opened the flo or for the
public to make comments in favor of, or opposition to, the proposed PUD Plan and Final
Subdivision Plat.
No one came forward to speak in fa vor of, or opposition to, the PUD Plan Amendment
and Final Subdivision Plat.

At the conclusion of the public testimony period, Mayor Tergin declared the evidentiary
portion of the public hearing concluded and stated that the Cou ncil would now take up
the associated pending bill.

Bill 2016-95 was read third time by title, placed on final passage, and passed , as

Mayor Tergin recommended the following appointments for Council approval:

A motion was made by Councilman Graham for approval of the appointments as
presented, seconded by Councilwoman Ward, and approve d unanimously.
PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS
Mayor Tergin asked Mr. Larry Kolb to introduce the members from the Vecino Group to
present a proposed development for the International Shoe Building on East Capitol
Avenue called “Capitol Avenue Lofts,” a low income housing project. Mr. Kolb
introduced Mr. Bruce Adib-Yazdi and Ms. Kate Medin-Stockton who performed the
presentation which was also made available to the media and the public. At the
conclusion, they answered questions asked by the Council. Mayor Tergin thanked them

for their presentation and asked staff to keep the Council informed on this project as it
progressed through the planning stages.
ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF
Mayor Tergin announced a meeting held by the Housing Authority would be held on
Monday, January 30, at 5:00 p.m. at City Hall to discuss the outcome of the public
forum in which citizens participated recently, and continue discussions on the East
Capitol Avenue redevelopment issues.
Mayor Tergin thanked all the staff and City departments who had worked to keep the
public safe during the recent ice storm.
Mayor Tergin stated she had received several contacts from people who had visited the
City during the Governor’s inauguration on January 9 and thanked the City for allowing
free parking on that day, as well as Uber who had reported they had provided over
1,000 rides.
Councilman Graham announced the Thursday, January 26 meeting of the Public Safety
Committee, and that that the issue of Uber may appear on the agenda.
Councilman Henry announced the Public Works & Planning Committee meeting for
Thursday, January 19, at 7:30 a.m.
Chief Schofield introduced Retired Fire Captain Tim Young who made a presentation
commemorating the 175th anniversary of the First Volunteer Fire Company in Jefferson
City, Missouri, established on January 26, 1842. Following Captain Young ’s
presentation, he answered questions about the progress being made on the Fire
Museum.
LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE
Lincoln University student liaison Jonathan Jackson was not present to provide an
update.

Mayor Tergin announced that, pursuant to Sec. 610.021 of the Revised Statutes of
Missouri, the Chair would entertain a motion to go into closed session to discuss the
following:

b. Real Estate [Sec. 610.021.(2)]
c. Negotiated Contract [Sec. 610.021(12)]
A motion was made by Councilman Mihalevich to go into closed session for the above-
stated purposes, seconded by Councilman Graham, and app roved unanimously at 7:32
P.M.:
