A RESOLUTION:
APPROVING A SUPPI F~MENTAL APPROPRIATION TO THE FY 2005
UTILITY FUND BUDGET IN THE AMOUNT OF $9,383,000.00 AND
AUTHORIZING AWARD OF CONTRACT 3140-829-FY05-01 IN THE
AMOUNT OF $32,062,000.00 TO UI J JMAN SCHUTTE
CONSTRUCTION, L.L.C. FOR EXPANSION OF THE WATER
POLLUTION CONTROL FACILITY
WHEREAS, in response to a public solicitation for bids for construction of this project, the
following bids were received from pre-qualified bidders on September 14, 2004:
* Ulliman Schutte Construction, L.L.C.. $32,062,000.00
* Fru-Con Construction Corp. $33,646,000.00
* W.M. Schlosser Company, Inc. $36,822,000.00
and;
WHEREAS, all bids were reviewed by staff and the town's engineer, CH2M Hill, and
found to be responsive to the bid request and within the engineer's project estimate; and
WHEREAS, a supplemental appropriation of $9,383,000.00 is required, by Council, from
the unappropriated Utility Fund balance to fund award of this contract; and
WHEREAS, a public heating was duly advertised and heard
proposing an amendment to the FY 2005 Utility Fund budget
appropriation; and
WHEREAS,

THEREFORE, RESOLVED

POLLUTION CONTROL FACILITY
SECTION I. The Leesburg Town Council hereby appropriates the supplemental amount of
$9,383,000.00 from the unappropriated Utility Fund balance, to the Water Pollution Control
Facility Expansion and Upgrade Project 7.5 account.
SECTION 1I.. The Town Manager is hereby authorized to execute a contract, in a form
approved by the Town Attorney, with Ulliman Schutte Construction L.L.C. Engineering Corp., in
the amount of $32,062,000.00 for this project.
