A RESOLUTION: PRESENTED December 14, 2004 2004-197 ADOPTED December 14, 2004 AUTHORIZING AN AGREEMENT AND APPROVING A WATER EXTENSION PERMIT AND WAIVING A PERFORMANCE GUARANTEE FOR THE J. LUPTON SIMPSON MIDDLE SCHOOL WATER LINE INSTALLATION WHEREAS, the Director of Engineering and Public Works has approved the construction plans for a water line installation for the J. Lupton Simpson Middle School to be constructed by the Loudoun County Public Schools; and WHEREAS, it is in the public interest to waive the performance guarantee to reduce the costs associated with installing the necessary public improvements for Loudoun County School projects; and WHEREAS, the Director of Engineering and Public Works recommends approval of a contract for installation of public improvements and waiving the performance guarantee for the J. Lupron Simpson Middle School water line installation. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The town manager shall execute the contract for public improvements in a form approved by the town attorney with the Loudoun County Public Schools for the improvements shown on the plans approved by the Director of Engineering and Public Works for the J. Lupton Simpson Middle School water line installation. SECTION II. The extension of municipal water for J. Lupton Simpson Middle School is approved in accordance with Section 19-18 of the Town Code. The performance guaramee for the public improvemems in the amount of $74,468.13 is waived, conditioned on the requiremem that the public improvemems are completed to the satisfaction of the town, or a subsequem performance guarantee is furnished in an amount approved by the Director of Engineering and Public Works for outstanding punchlist items.
