HomeMy Public PortalAbout20150519 - Select Board - Minutes 1 Hopkinton Board of Selectmen Meeting Minutes May 19, 2015 TOWN OF HOPKINTON Board of Selectmen May 19, 2015 A meeting of the Hopkinton Board of Selectmen was held on Tuesday, May 19, 2015 at Town Hall, 18 Main Street, Hopkinton, Massachusetts. Selectmen Present: Todd Cestari, John Mosher, Ben Palleiko, John Coutinho, Brian Herr. Officials Present: Town Manager Norman Khumalo, Operations Assistant Jamie Hellen. CALL TO ORDER: Chairman Cestari called the public meeting to order at 6:00 PM in Room 211. The Chair entertained a motion to enter executive session to discuss strategies with respect to collective bargaining updates by the Town Manager relative to Police, Fire and Dispatch, because an open meeting may have detrimental effects on the bargaining positions of the Board; to discuss considering the purchase, exchange, lease or value of real property in regards to a property on Claflin Avenue, Pratt Estate, the Wyckoff Parcel and the parcels recommended by the Elementary School Building Committee, because an open meeting may have a detrimental effect on the negotiating position of the Board; to discuss strategy with respect to litigation with respect to NSTAR/Eversource (DPU 15-02), because an open meeting may have a detrimental effect on the litigation position of the board; and to conduct strategy sessions in preparation for negotiations with nonunion personnel with respect to the Finance Director; to allow town staff Norman Khumalo and Jamie Hellen to participate; and, to enter public session at the conclusion. MOVED by Mr. Coutinho and SECONDED by Mr. Mosher. ROLL CALL: Mr. Mosher-Yes, Mr. Cestari-Yes, Mr. Coutinho-Yes, Mr. Herr-Yes. VOTE to Approve: Yes-4, No-0. REOPEN PUBLIC SESSION: Chair Cestari reopened the Public Session in Room 215 with the Pledge of Allegiance. PUBLIC FORUM: Residents were invited to share ideas, opinions, or ask questions regarding town government. There was no one present who wished to participate in public forum. STAFF APPOINTMENTS: The Board confirmed the following staff appointments made by the Town Manager: Thomas Welch, Deputy Assessor; Denise McBride, Youth Services Director; and Jennifer Burke, Principal Planner. Mr. Khumalo introduced each candidate to the Board and comments and questions were addressed. VOTE to Approve: Yes-5, No-0, Abstained-0. REORGANIZATION OF THE BOARD OF SELECTMEN: The Board conducted its annual reorganization. MOTION by Mr. Mosher to nominate Ben Palleiko as Chairman, SECONDED by Mr. Coutinho. VOTE to Approve: Yes-5, No-0, Abstained-0. Mr. Palleiko assumed the position of Chairman. MOTION by Mr. Cestari to nominate John Coutinho as Vice Chairman, SECONDED by Mr. Herr. VOTE to Approve: Yes-5, No-0, Abstained-0. Mr. Coutinho assumed the position of Vice Chairman. CONSENT AGENDA: 1. Parade Permit: The Board considered approving a parade permit for Aaron Nemzer, DMSE Sports Enterprises, for September 27, 2015 at 5:30 a.m. 2. Marathon Fund Request: The Board considered approving Marathon Fund requests for $1,000 for the Hopkinton Police Association 2015 Fishing Derby; $2,000 for the 300th Anniversary Committee to fund the “Gym Dandies Unicycle Drill Team” for the 300th Anniversary Parade; and $1,000 for Council on Aging fitness classes. 3. Seasonal Liquor License: The Board considered approving a seasonal liquor license for the Zoll Cellar Winery for the Farmer’s Market. Chairman Palleiko asked that Item 2 be broken out. MOTION by Mr. Cestari to approve consent agenda Items 1 and 3, SECONDED by Mr. Coutinho. VOTE to Approve: Yes-5, No-0, Abstained-0. Chairman Palleiko asked what the $1,000 for the Police Association will be used for. Mr. Khumalo indicated it will be used to restock the fish for the 2015 Fishing Derby. Chairman Palleiko expressed concern that this request may not qualify for a Marathon Fund Request. He asked Mr. Khumalo to check into this request for consistency. MOTION by Mr. Cestari to approve consent agenda Item 2, request 2 and 3, SECONDED by Mr. Coutinho. VOTE to Approve: Yes-5, No-0, Abstained-0. CONTINUED PUBLIC HEARING: LIQUOR LICENSE, 85 WEST MAIN HOPKINTON, LLC 3 Hopkinton Board of Selectmen Meeting Minutes May 19, 2015 Mr. Herr asked if he would be allowed to participate in this hearing, as he is a newly elected member of the Board. Chairman Palleiko was of the opinion he could participate if he reviewed the materials. Ms. McCarthy, Attorney for the applicant, stated they would like to reserve their rights on that decision. After discussion and consideration Mr. Herr recused himself from this hearing. The Board continued a public hearing to consider approving an application for a Section 15 Wine & Malt Beverage license for 85 West Main Hopkinton, LLC and forward to the ABCC for their affirmation. Ms. McCarthy, Attorney for the applicant, addressed the Board. She stated they submitted a new floorplan indicating 28% of the store would house the beer and wine section. She stated this would be a convenience store for one-stop shopping. She submitted information on the hours of operation and security measures. Questions and concerns from the Board were addressed. There were no members of the public who wished to comment. MOTION by Mr. Mosher to close the public hearing, SECONDED by Mr. Coutinho. VOTE to Approve: Yes-4, No-0, Abstained-0. After deliberation the Board took no action on this request, therefore, not granting the requested liquor license. ASCERTAINMENT HEARING FINDINGS FROM CABLE ADVISORY COMMITTEE: The Board, as cable television Franchising Authority, considered the Ascertainment Findings prepared by staff and the Cable Advisory Committee. MOTION by Mr. Coutinho to adopt the detailed preliminary Cable Television license renewal ascertainment findings relative to the Verizon franchise renewal process, as unanimously recommended by the town’s Cable Television Advisory Committee, and authorize the Town Manager to sign any and all documents related to the findings, SECONDED by Mr. Cestari. VOTE to Approve: Yes-5, No-0, Abstained-0. WATER AUDIT: The Board reviewed a completed water audit report from consultants Weston & Sampson on the unaccounted for water. John Westerling, DPW Director, and Leah Stanton from Weston & Sampson were present to present this information and answer questions from the Board. TOWN MEETING DEBRIEF: Mr. Khumalo and the Board held a discussion about Town Meeting. LIAISON REPORTS: Mr. Coutinho reported on the Policeman’s Ball which he recently attended. TOWN MANAGER’S REPORT: 4 Hopkinton Board of Selectmen Meeting Minutes May 19, 2015 1. Waste Management Contract Renewal and Automation: Mr. Khumalo provided information to the Board regarding the town’s waste contract with E.L. Harvey and asked them to consider automation and single stream recycling. After discussion the Board requested this be put on a future agenda for more in depth discussion. 2. Mr. Khumalo announced they have contracted with an appraisal company to begin working on the town meeting land acquisitions. FUTURE BOARD AGENDA ITEMS: Mr. Mosher asked Mr. Khumalo if the amendment to the motion on Lake Maspenock at Town Meeting required the formation of a committee. Mr. Khumalo confirmed that the Town Meeting vote will require the formation of a citizen’s group. Mr. Mosher asked that a discussion on forming a committee for the repurposing of Center School be put on a future agenda. He also asked for discussion of the flow of information to the Board. POSITION ANALYSIS & PAY CLASSIFICATION PLAN WORKSHOP: The Board hosted a workshop to discuss the proposed position analysis and pay classification plan. Correspondence to Board of Selectmen 1.
