A RESOLUTION: 2005-23 PRESENTED: ADOPTED: February 8, 2005 February 8, 2005 APPROVING SPECIAL EXCEPTION TLSE-2004-0006, CATOCTIN CIRCLE CENTRE BANK WITH A DRIVE-THROUGH, CATOCTIN CIRCLE, N.E. NEAR EDWARDS FERRY ROAD, TO PERMIT A THREE-LANE DRIVE-THROUGH ADDITION TO A BANK WHEREAS, Waterford Holdings, LLC has requested special exception approval to permit a three-lane drive-through addition to the bank within the Catoctin Circle Centre mixed- use development on Catoctin Circle, N.E.; and WHEREAS, the property is located in the B-2 Established Corridor Commercial Zoning District; and WHEREAS, on December 16, 2004, the Planning Commission recommended conditional approval of this application; and WHEREAS, on January 25, 2005 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a drive-through facility as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditiOns set forth below. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2004-0006, Catoctin Circle Centre Bank with a Drive-Through o._~n Catoctin Circle, NE. identified in the Loudoun County Land Records as Parcel Identification Number 188-26-1371 subject to the following conditions: 1. Development of this special exception use shall be in substantial conformance with the plat entitled "Special Exception for Drive in for Bank, Catoctin Circle Centre" dated revised through 1/24/05 prepared by William H. Gordon Associates, Inc. This plat A RESOLUTION: -2- APPROVING SPECIAL EXCEPTION TLSE-2004-0006, CATOCTIN CIRCLE CENTRE BANK WITH DRIVE THROUGH, CATOCTIN CIRCLE, N.E. includes Sheets 1-3, 3A-3C, a sheet entitled "Landscape Exhibit" and a sheet entitled "Line of Sight illustrative". o o Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM), and that final plats, development plans, and construction drawings are subject to the applicable town regulations. The applicant shall (1) construct a south-bound lane along Catoctin Circle adjacent to the proposed site and (2) provide minimum 12-foot wide egress lanes at the Catoctin Circle entrance as called for in the applicant's traffic impact study dated December 3, 2003 by Gorove/Slade Associates, Inc. and demonstrated on the Special Exception Plat dated 2/20/04 and revised through 12/03/04 by William H. Gordon Associates, Inc. Adequate sight distance shall be maintained at the drive-through exit as depicted by the "clear sight triangles" indicated on the special exception plat. The drive-through lighting shall be employed in accordance with the photometrics plan included with the Special Exception Plat dated 12/03/04. Site lighting shall not exceed 0.5 foot-candles at the property boundary and the source of illumination shall not be visible beyond the site in accordance with DCSM Section 7-760. 6. The applicant shall operate the speakers in the drive-through so that noise levels do not exceed the following limits: Sound Level (Decibels) Distance from Customer Unit (Feet) 75 dB 3 72 dB 10 64 dB 20 61 dB 30 57 dB 40 55 dB 50 53 dB 60 53 dB 70 o Should the 6-foot high buffer-yard wall impede the surface drainage from the single- family dwellings along Edwards Ferry Road or the apartment open space, it shall be the responsibility of the applicant to mitigate that impediment to allow proper surface drainage. A RESOLUTION: -3- APPROVING SPECIAL EXCEPTION TLSE-2004-0006, CATOCTIN CIRCLE CENTRE BANK WITH DRIVE THROUGH, CATOCTIN CIRCLE, N.E. Buffer-yard width along the northern property boundary shall be modified in accordance with Zoning Ordinance Section 12.8.5.D. and in accordance with the recommendation of the Land Development Official's letter dated 11/22/04. This modification allows the width of the northern boundary buffer-yard to be reduced to 24.5 feet wide with the installation of a 6-foot high brick wall as demonstrated on the Special Exception Plat dated 12/03/04 with the exception of the area immediately adjacent to the bank drive through lanes. Here the applicant shall provide the minimum required 35-foot wide buffer-yard with the six-foot high wall as shown on the Special Exception Plat dated 2/20/04 and revised through 12/03/04. If any existing tree intended to be saved declines to a state of unacceptable risk as determined by the Urban Forester or dies within five years from the date of final development plan approval, the applicant will replace the dead tree with an S-3 landscape screen within the area of the buffer-yard that was initially comprised of the tree's critical root zone. 10. The grading at the edge of the drive-through lanes closest to the elm trees shall be revised to eliminate the slope to the edge of pavement and shall employ a hip-wall to retain the existing grade and minimize disturbance of the elm's smaller surface roots. 11. Elevation drawings showing architectural design elements that are consistent with the architecture of the center presented to the Planning Commission and Town Council shall be submitted as part of the Land Development Application or No Adverse Impact Plan for administrative design review.
