APPROVING SPECIAL EXCEPTION TLSE-2004-0007, CATOCTIN
CIRCLE CENTRE PRIVATE PARKING STRUCTURE, CATOCTIN
CIRCLE, NE NEAR EDWARDS FERRY ROAD, TO PERMIT A
FOUR-LEVEL PRIVATE PARKING STRUCTURE
WHEREAS, Waterford Holdings, LLC has requested special exception approval to
permit a four-level private parking structure within the Catoctin Circle Centre mixed-use
development on Catoctin Circle, N.E.; and
WHEREAS, the property is located in the B-2 Established Corridor Commercial Zoning
District; and
WHEREAS, on December 16, 2004, the Planning Commission recommended conditional
approval of this application; and
WHEREAS, on January 25, 2005 the Town Council held a public hearing; and
WHEREAS, the proposed use meets the special exception standards for a private parking
structure as set forth in the Zoning Ordinance; and
WHEREAS, staff recommends approval, with the conditions set forth below.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia hereby
approves Special Exception application TLSE- 2004-0007, Catoctin Circle Centre Private
Parking Structure, Catoctin Circle, NE, identified in the Loudoun County Land Records as Parcel
Identification Number 188-26-1371, subject to the following conditions:
1. Development of this special exception use shall be in substantial conformance with the
plat entitled "Special Exception for Parking Structure, Catoctin Circle Centre" dated
revised through 1/24/05 prepared by William H. Gordon Associates, Inc. This plat

includes Sheets 1-3, 3A-3C, a sheet entitled "Landscape Exhibit" and a sheet entitled
"Line of Sight illustrative".
Approval of the special exception does not express or imply any waiver or modification
of the requirements set forth in the Subdivision and Land Development Regulations, the
Zoning Ordinance, or the Design and Construction Standards Manual (DCSM), and that
final plats, development plans, and construction drawings are subject to the applicable
town regulations.
The private parking structure shall be used solely for the parking of vehicles in operating
condition. No motor vehicle parking repair work except emergency service shall be
permitted in association with a parking facility.
The applicant shall (1) construct a south-bound lane along Catoctin Circle adjacent to the
proposed site and (2) provide minimum 12-foot wide egress lanes at the Catoctin Circle
entrance as called for in the applicant's traffic impact study dated December 3, 2003 by
Gorove/Slade Associates, Inc. and demonstrated on the Special Exception Plat dated
2/20/04 and revised through 12/03/04 by William H. Gordon Associates, Inc.
Lighting on the top deck of the parking structure shall be recessed into the parapet walls
except along the west elevation adjacent to the proposed office building, (Building A).
Pole-mounted lights shall be prohibited on the top deck of the parking structure.

Forty-eight inch (48") high parapet walls shall be provided on the decks of the parking
structure to block vehicle headlight glare on the adjacent residential properties.
Should the 6-foot high buffer-yard wall impede the surface drainage of the single-family
dwellings along Edwards Ferry Road or the apartment open space, it shall be the
responsibility of the applicant to mitigate that impediment to allow proper surface
drainage.
A reciprocal cross parking easement shall be executed by all lot owners of the Catoctin
Circle Centre development prior to issuance of a zoning permit for the parking structure.
Buffer-yard width along the northern property boundary shall be modified in accordance
with Zoning Ordinance Section 12.8.5.D. and in accordance with the recommendation of
the Land Development Official' s letter dated 11/22/04. This modification allows the
width of the northern boundary buffer-yard to be reduced to 24.5 feet wide with the
installation of a 6-foot high brick wall as demonstrated on the Special Exception Plat
dated 2/20/04, revised 8/27/04.

10. Elevation drawings showing architectural design elements that are consistent with the
architecture of the center presented to the Planning Commission and Town Council shall
be submitted as part of the Land Development Application or No Adverse Impact Plan
for administrative design review.
