CITY OF TEMPLE C;TY
TEMPLE CITY CALIFORNIA
MAY 17, 1966
INITIATION:
1. Mayor Tyrell called the regular meeting of the City Council to
order at 7:30 P. M. He called the attention of the audience to
the new •procedure on the top of the Agenda inviting people to
address the Council at the time the item is on the agenda on
2. which they wish to speak. Father Lueur of St. Lukes Catholic
Church of Temple City gave the invocation, following which the
3. Mayor led the Pledge of Allegiance to the Flag.
4. ROLL CALL:
PRESENT: Councilmen - Beckley, Clemson, Harker, Merritt, Tyreii
ABSENT: Councilmen -None
ALSO PRESENT: City Attorney Martin, Director of Public Works
Pizzorno, City Manager Koski
5. APPROVAL OF MINUTES: REGULAR MEETING OF MAY 3, 1966.
Councilman Clemson referred to the last paragraph of item 5 on
page 2 stating it was Councilman Beckley who made a personal
appeal to the audience. As there were no further corrections
Councilman Clemson moved to approve the minutes of May 3 as
corrected, Councilman Beckley seconded, and the motion carried
unanimously.
At this time Mayor Tyrell requested Mr, David Oakley to come for
ward to be sworn in as a new Commissioner on the Planning Commis-
sion. The City Clerk gave Mr. Oakley the Oath of Office follow-
ing which he was congratulated and welcomed by the members of
the City Council.
PUBLIC HEARING: 7 :30 P,M, CURB & GUTTER, LOWER AZUSA, south side,
Fiesta to Cloverly
Director of Public Works Pizzorno advised there was a total
lineal footage of 282 ft. and approximately 73% or 219 ft, had
signed the petition for curb & gutter. Mayor Tyrell declared
the public hearing opened and asked if anyone wished to speak
for or against this petition. No one came forward to speak.
Councilman Merritt moved to close the public hearing, Councilman
Clemson seconded and the motion carried unanimously. Councilman
Merritt moved to find the project in public interest and instruct
the Supt. of Streets to cause the work to be done, Councilman
Harker seconded, and the motion was unanimously carried.
UNFINISHED BUSINESS:
6. RESOLUTION N0, 66 -608: re granting Zone Variance subject to
conditions, Ernest R. Starr, 9129 Las Tunas Dr.
City Attorney Martin read title to Resolution No. 66 -608 A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RE-
VERSING THE PLANNING COMMISSION AND GRANTING A, ZONE VARIANCE
SUBJECT TO CERTAIN CONDITIONS. Councilman Merritt moved to
adopt Resolution No. 66 -603, Councilman Harker seconded, and the
motion was carried by the following called vote:
AYES: Councilmen- Harker, Merritt, Tyrell
NOES: Councilmen -None
ABSENT: Councilmen -None
ABSTAINING: Councilmen - Beckley, Clemson
NEW BUSINESS:
7. RENEWAL OF GENERAL SERVICES AGREEMENT: LOS ANGELES COUNTY
City Manager Koski advised the present Agreement for General
Services with the County expires on June 30, 1966, and he re-
commended it be renewed for another five years, He explained
this is the General Agreement whereby we contract for various
services of the County Departments. Councilman Harker moved to
approve a five year renewal of the General Services Agreement,
Councilman Beckley seconded, and the motion was unanimously
carried..

8. RESOLUTION NO. 66 -609: Budget proposal to Division of Highways
for Engineering 1966 -67
Director of Public Works Pizzorno advised this is a Resolution
adopting and submitting an annual budget for engineering funds
from the Division of Highways and which is based on population,
and the established amount for Temple City is $6000. Following
discussion Councilman Merritt moved to adopt Resolution No. 66-
609, Councilman Clemson seconded, and the motion was carried
unanimously.
9. APPEAL FROM PLANNING COMMISSION DECISION, ROY A.& RICHARD E.
STABILE, 6258 Hart Ave., Variance Case No. 66 -183
Councilman Harker moved to set a public hearing on June 8,
7:30 P. M. to hear this appeal, Councilman Beckley seconded, and
the motion was carried unanimously.
10. RESOLUTION NO. 66 -610: appointing temporary employee: Recreation
Dept.
City Manager Koski presented Resolution No. 66 -610 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING
TEMPORARY EMPLOYEE. Councilman. Beckley moved to adopt Resolu-
tion No. 66 -610, Councilman Clemson seconded, and the motion
carried unanimously.
11. RESOLUTION NO. 66 -611: Warrants & Demands
City Manager Koski read title to Resolution No. 66 -611 A RESOLU-
TiON OF THE CITY COUNCIL OF THE CITY OF TEMPLE CiTY ALLOWING
CLAIMS AND DEMANDS IN THE SUM OF $69i788.140 DEMAND NOS. 8117,
8170 THROUGH 8262, AND 8264 THROUGH 8266. Following discussion
Councilman Merritt moved to adopt Resolution No. 66 -611,
Councilman Harker seconded, and the motion was unanimously
carried.
12. TRAFFIC COMMISSION RECOMMENDATIONS:
a. item 12. Rescind red curb south side of Lemon Ave. west of
Temple City Blvd. for 49 ft. Director of Public Works Pizzorno
stated the curb would be sisned'by no stopping signs on school
days from 11. to 5 P.M. Councilman Merritt moved to approve the
recommendation for Item 12 a, Councilman Clemson seconded and
the motion carried unanimously.
B. Item 15. Fratus Dr. & Pentland St.: recommend full stop
south approach to Pentland on Fratus and placement of double
center line easterly of Encinita to 75 ft. east of Fratus.
The recommendation of the Traffic Commission was presented by
the Director of Public Works. Councilman Clemson moved to
approve Item 15 b, Councilman Harker seconded, and the motion
carried unanimously.
13. RENEWAL GROUND MAINTENANCE AGREEMENT WITH COUNTY: Temple City
County Library, for 1966 -67
The City Manager advised the present agreement expires June 30,
and recommended renewal at $35. per month or $420. per year.
The County has indicated their interest and requested we submit
a price for this service which they will review and submit a
contract for renewal for 1966 -67. Following discussion Council-
man Clemson moved to approve, Councilman Beckley seconded, and
the motion carried unanimously.
14. COMMUNICATIONS:
City Manager Koski presented a request from the Temple City
American Legion Post #279 for a proclamation from the City
declaring June 1, 1966, "AMERICAN LEGION DAY iN TEMPLE CiTY" to
commemorate the 40th anniversary of the founding of Post 279.
The City Manager read in full the proposed proclamation. Coun-
cilman Beckley moved to approve, Councilman Clemson seconded,
and the motion carried unanimously,
15. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Clyde M. Sutton, representing Temple City American Legion Post
#279 expressed appreciation for the proclamation and extended
an invitation to the Council to participate with them on June
1 at dinner with festivities starting at 5:30, dinner at 6:45
and entertainment and anniversary celebration following.. The
Mayor stated Mr. Sutton was the first commander of this post and
requested him to carry back to the post the congratulations of

the City Council and that the Council will attempt to be there.
Mayor Tyrell at this time introduced Girl Scout Troop #179 who
were visiting and welcomed them to the Council meeting.
16. MATTERS FROM CITY OFFICIALS:
Councilman Clemson advised a Civil Defense Committee meeting had
been held and another one to be held on Wednesday and they expect
to have a report for the Council at the next meeting.
Councilman Merritt suggested the idea used on Council Agendas be
extended to all Commission agendas showing the next meeting date
of the various Commissions and Council.
City Attorney Martin advised the Council that as far as the peti-
tions are concerned Annexation 11 has been completed. He pre-
sented Resolution No. 66 -612 setting a public hearing for June
82 7:30 P. M. The City Attorney read title to Resolution No.
66 -612 A RESOLUTION OF THE CITY COUNCIL OF TEMPLE CITY DECLARING
ITS INTENTION TO CALL A SPECIAL ANNEXATION ELECTION, AND FIXING
A TIME AND PLACE FOR PROTESTS BY PROPERTY O' !NERS. Councilman
Harker moved to adopt Resolution No. 66-612, Councilman Clemson
seconded, and the motion was carried unanimously.
The City Attorney advised the Council had requested him to pre-
pare a Resolution supporting Proposition W and he read title to
Resolution No. 66 -613 A RESOLUTION OF THE CiTY COUNCIL OF THE
CITY OF TEMPLE CITY ENDORSING PROPOSITION W, THE 'WATER BOND
ISSUE SPONSORED BY THE METROPOLITAN WATER DISTRICT OF SOUTHERN
CALIFORNIA AT THE JUNE 7, 1966, PRIMARY ELECTION AND URGING ALL
VOTERS TO SUPPORT THE WATER BOND ISSUE. He explained the origin
al project was to bring water from northern California called
the Feather River project and it is up to the local agencies to
bring distribution to the different water agencies. This would
be paid for by the water used. Councilman Clemson moved to
adopt Resolution No. 66 -613, Councilman Beckley seconded, and
the motion carried unanimously.
City Attorney Martin presented Resolution No. 66 -614 A RESOLU-
TION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CiTY PERTAINING
TO THE DESIGNATION OF PERSONNEL TO EXECUTE CERTIFICATES OF
ACCEPTANCE ON DEEDS OR GRANTS ON BEHALF OF THE CiTY OF TEMPLE
CiTY: AND DESIGNATING CERTAIN PERSONNEL OF THE CiTY OF TEMPLE
CiTY TO EXECUTE CERTIFICATES OF ACCEPTANCE OF THESE DEEDS OR
GRANTS IN ACCORDANCE WITH THE PROVISIONS OF SECTION 27281 OF THE
GOVERNMENT CODE. He explained this was necessary due to change
of personnel. Councilman Merritt moved to adopt Resolution No.
66 -614, Councilman Harker seconded, and the motion carried unan-
imously.
City Manager Koski presented the calendar for the assessment
hearing on Parking District No. 4, and recommended a public
hearing be set for July 5th and on June 8 a Resolution be adopt-
ed on the City's contribution to this district. He requested
this hearing be set by minute order for July 5, 1966, at 7:30
P. M. It was moved by Councilman Harker and seconded by Council
man Beckley, and unanimously carried, that the action of the
Clerk in fixing July 5, 1966, at 7 :30 o'clock P. M. as the time
for the hearing on the assessment heretofore filed with him for
Vehicle Parking District No. 4 of the City of Temple City be
approved.
The City Manager presented a request to proclaim the week of
May 22 as "Cerebral Palsy Week ". Councilman Harker recommended
the Mayor so proclaim, Councilman Beckley seconded, and the
motion was carried unanimously.
City Manager Koski stated an agreement submitted by the San
Gabriel Valley Humane Society had been reviewed by the City
Attorney. He also stated the Councilmen had received a copy of
the agreement and asked for the Council recommendation regarding
renewal of the contract. Councilman Beckley moved to authorize
a new three year contract on the same terms and conditions, 5;10
to authorize .the M'a!yov 'and City Clerk to execute the agreement,

Councilman Merritt seconded, and the motion was unanimously
carried.
The City Manager advised that at a prior meeting the Council
had indicated interest in having the local radio station in
Pasadena retained in the San Gabriel valley. The City Attorney
has prepared an affidavit indicating the benefit to the valley,
and recommends the facility be allowed to remain in the San
Gabriel Valley. He then read the affidavit in full. Councilman
Beckley moved to approve, Councilman Merritt seconded and the
motion was carried unanimously.
The City Manager brought before the Council the discussion of
the acquisition of the Pacific Ackworth school property, the
proceedings were initiated last fall, various reports have been
made, appraisals have been made, and requested instruction as to
further proceedings. The City Attorney advised the action was
filed last Sept. and the City has one year to bring to trial.
The issue at present is whether the Council wishes to proceed
or to abandon the action. There have been many study sessions,
financial statistics given us and purchasing costs and develop-
ing costs and a determination should be made of further proced-
ure. Councilman Harker stated he had been very much concerned
over this from the beginning and it appeared to him that there
were possibly other avenues that could be explored in the same
general area without following through on the condemnation pro-
cedure and wanted to qualify his position at this time in that
way. Councilman Beckley felt the condemnaticn.proceedings
should be dropped at this time and the Council should take a
fresh look and discuss other properties. Councilman Clemson
asked the City Attorney if we could negotiate with Pacific
Ackworth School with or without the condemnation proceedings and
was advised this was true, and in that case he felt the con-
demnation proceedings should be dropped and they should proceed
with other negotiations and that the excessive cost for develop-
ment and purchase of the property was not financially expedient
to proceed. Councilman Beckley stated if the Pacific Ackworth
people are going to proceed with their building program they have
started it would be an asset to the community..
Mayor fyrell asked Mr. Manners of the School if the organization
in his opinion has suffered any costs so far as the condemnation
proceedings have been concerned and was advised they had counsel
but at no cost. The Mayor expressed on behalf of the Council
and the City appreciation for the candor and forthright presen-
tations that have been made by Mr. Manners on behalf of their
organization and stated he hoped something could be worked out
with them.
Councilman Beckley moved to dismiss the pending action against
the Pacific Ackworth School For condemnation, Councilman Clemson
seconded, and the motion was carried by the following roll call
vote:
AYES: Councilmen- Beckley, Clemson, Harker, Merritt, Tyrell
NOES: Councilmen -None
ABSENT: Councilmen -None
Mr. Manners spoke on behalf of the school and expressed their
appreciation to the Council for abandoning this condemnation and
he assured the Council they would try to become an integral part
of the community and plan to cooperate with the Council in any p:
program that will provide more recreational area for the City
that is consistent with their program.
17. ADJOURNMENT: Councilman Harker moved to adjourn to an adjourned
meeting on June 2, 1966, in the Council Chambers, seconded and
carried. Council adjourned at 8 :40 P. M.
