A RESOLUTION: PRESENTED: March 22, 2005 2005-55 ADOPTED: March 22, 2005 APPROVING SPECIAL EXCEPTION TLSE-2004-0027 ARBY'S AT POTOMAC STATION, TO PERMIT A FAST FOOD RESTAURANT WITH DRIVE THROUGH SERVICE WHEREAS, Master Design has requested special exception approval to permit a 3,250 square foot fast food restaurant with drive through service within the Marketplace at Potomac Station mixed-use development on Potomac Station Dr. NE; and WHEREAS, the property is located in the PRC, Planned Residential Community Zoning District; and WHEREAS, on February 3, 2005, the Planning Commission recommended conditional approval of this application; and WHEREAS, on March 8, 2005 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for fast food restaurants with drive through service as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2004-0027, Arby's at Potomac Station, Potomac Station Dr. NE, identified in the Loudoun County Land Records as Parcel Identification Number 148-25-9434, subject to the following conditions: 1. Substantial Conformance. Development of this special exception use shall be in substantial conformance with the special exception plat dated November 29, 2004 entitled "Arby's Marketplace at Potomac Station" prepared by Master Design LLC. This plat includes Sheets A-l, A-3 through A-10 and as modified by site plan Sheet SK-1 dated February 7, 2005, and masonry wall elevations shown on Sheets SK-2 and SK-3 dated January 24, 2005. Approval of this special exception application does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, Zoning Ordinance, or Design and Construction Standards Manual, and that final plats, development plans and construction drawings are subject to the applicable town regulations. o Masonry Wall. An eight (8) foot brick masonry screen wall shall be erected at the rear of the building as shown on Sheets SK-1, SK-2 and SK-3 referred to in Condition #1. The wall shall match the materials and architectural detail of the main building. 4. S3 Screen. An S3 landscaping screen shall be installed in the buffer at the rear property elevation facing the Giant Food store. 5. Menu Board Volume. The menu board speaker volume shall be maintained at a level that is not audible beyond the boundary of the Arby's at Potomac Station property. 6. Menu Board Location. The menu board and speaker location shall be at the southwest comer of the building. 7. One-Way Travel. The applicant shall maintain the one way travel on site in order to minimize vehicle conflicts with the loading space. Best Management Practices. The applicant shall provide best management practices in conformance with all Loudoun County and Town of Leesburg standards with regards to water quality. The final development plan shall demonstrate all calculations and conformance with all storm drainage and storm water management requirements of the town and county. 9. Pedestrian Access. The sidewalk to the front door of the restaurant shall provide a direct and convenient path that minimizes pedestrians' exposure to moving cars. 10. Lighting. Lighting fixtures shall not have a source of illumination that is visible beyond the site or cause illumination of adjacent properties in excess of 0.5 foot-candles, as measured at the site boundary, (DCSM Sec. 7-670.1). The applicant needs to employ enhanced shielding devices or exchange the types of lighting fixtures to meet this criterion. Light poles will not exceed 20 feet in the H-2 Corridor.
