A RESOLUTION: PRESENTED: March 22, 2005 2005-56 ADOPTED: March 22, 2005 APPROVING SPECIAL EXCEPTION TLSE-2004-0028 LOUDOUN NATIONAL BANK, TO PERMIT A 10,750 SQUARE FOOT BANKING FACILITY WITH DRIVE THROUGH SERVICE WHEREAS, Loudoun National Bank has requested special exception approval to permit a 10,750 square foot bank facility with drive through service at 204 Catoctin Circle SE; and WHEREAS, the property is located in the B-2, Established Corridor Commercial Zoning District; and WHEREAS, on February 3, 2005, the Planning Commission recommended conditional approval of this application; and WHEREAS, on March 8, 2005 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for bank facilities with drive through service as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2004-0028, Loudoun National Bank, 204 Catoctin Circle SE, identified in the Loudoun County Land Records as Parcel Identification Number 231-10-3552, subject to the following conditions: 1. Substantial Conformance. Development of this special exception use shall be in substantial conformance with the special exception plat dated May 20, 2004 entitled "Shenandoah Valley National Bank Plat of Special Exception" prepared by Dewberry & Davis LLC. 2. Stacking Spaces. The special exception plat allows sufficient stacking for two teller window lanes and an ATM lane. The third lane must remain an ATM lane only with no teller window access. Pedestrian Access. Access points to the building must be clearly marked and the building made handicapped accessible. DSCM Modification Required. Special exception shall be conditioned upon approval of a DCSM modification for the proposed entrance onto South Street which is not aligned nor separated from adjacent entrances by 125 feet. (DCSM Section 7-361(2).) Lighting. Site lighting must be in conformance with DCSM regulations. A lighting plan shall be provided that indicates all outdoor lighting fixtures exclusive of street lights which shall not have a source of illumination that is visible beyond the site or cause illumination of adjacent properties in excess of 0.5 foot-candles, as measured at the site boundary (DCSM 7-670.1). Applicant must provide details regarding lighting fixtures to demonstrate these standards will be met. Details will include pole heights, locations, shielding devices and wall-mounted light details. All canopy lights must be recessed. Ingress/Egress Easement Expansion. The ingress/egress easement on the subject property running to the benefit of the adjacent landowner will be widened to match the width of the proposed entrance onto Catoctin Circle at the time of final development plan approval. 7. Mechanical Equipment Screen. All mechanical equipment shall be screened from public view by appropriate architectural elements. 8. Building Height. Height of the building shall not exceed 45 feet, measured by the vertical distance to the highest point of the roof. (TLZO Section 18.1.72 & Section 6.4.3) Architectural Elevations. Applicant must provide an elevation of the proposed canopy prior to Town Council approval. The applicant shall work with the Crescent District Master Plan consultant and the BAR consultant to refine the building architectural features to make the building more compatible with the surrounding architecture. 10. Refuse Containers. When not set out for collection, refuse containers will be stored inside the building, or in an onsite screened enclosure meeting the requirements of the Zoning Ordinance, that protects refuse from dispersal by wind or otherwise and is kept free of litter and refuse overflow. 11. No Modifications Granted or Implied. Special exception approval does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual, and that final plats, development plans, and construction drawings are subject to the applicable town regulations. -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2004-0028 LOUDOUN NATIONAL BANK, TO PERMIT A 10,750 SQUARE FOOT BANKING FACILITY WITH DRIVE THROUGH SERVICE PASSED this 2_~2nd day of March 2005.
