HomeMy Public PortalAboutResolution No. 78-88 (fully executed)RESOLUTION NO. 178-88 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF CARSON ACCEPTING THE WORK PERFORMED BY C. W. POSS, INC., PROJECT NO. 177 - AVALON BOULEVARD WIDENING FROM SEPULVEDA TO BONDS AND PROJECT NO. 222 - AVALON BOULEVARD WIDENING AT AT & SF RAILROAD CROSSING WHEREAS, the Redevelopment Agency did, on the 6th day of January, 1978, award the contract for street improvements to C. W. Poss, Inc., for Project Nos. 177 and 222; and WHEREAS, said work has been duly performed and completed by said contractor; and WHEREAS, said work has been inspected by the Director of Public Works and by him approved as constructed and completed in its entirety, project and authorized revisions therein; and WHEREAS, said Director does now recommend and request the acceptance of the work and the filing of a Notice of Completion thereof; and WHEREAS, the final contract price for said work is the sum of $194,758.04 which said sum the Director has approved as just and fair; and WHEREAS, the contract documents provide that a total of 10% ($19,475. 80) of said total contract price shall be retained until thirty-five (35) days after the recording of the Notice of Completion of said improvement project. NOW, THEREFORE, THE CARSON REDEVELOPMENT AGENCY DOES HEREBY RESOLVE AS FOLLOWS: section 1. That the Redevelopment Agency does hereby accept the work performed by said contractor and approves the same as being completed in accordance with the plans and specifications for said project and authorized revisions therein; and the Executive Director is hereby authorized to file a Notice of Completion of said project in the Office of the Los Angeles County Recorder; and section 2. That the Agency Treasurer is authorized and directed to pay to said contractor, C. W. Poss, Inc., the sum of $194,758.04 in full payment of said work performed by said contractor, less any sums held until the expiration of thirty-five days (35) following the filing of said Notice of Comple- tion, and then paid contingent. upon the absence of the filing of any stop notice against said project within thirty (30) days after the filing of the Notice of Completion; and Section 3. That upon expiration of said thirty-five (35) days following the filing of said Notice of Completion without any claim being ruled against said project, that all bonds filed by the contractor in said project shall be exonera- ted and discharged, excepting that the faithful performance bond shall remain in force until the expiration of one year from the date of filing said Notice unless a substitute bond approved by the Director of Public Works and the Agency Attorney shall have been filed.
