A RESOLUTION: PRESENTED: May 10, 2005 2005 -83 ADOPTED: May 10, 2005 APPROVING SPECIAL EXCEPTION TLSE-2004-0004 POTOMAC STATION PARCEL B (PAD SITE D), TO PERMIT A CONVENIENCE STORE WITH GAS PUMPS AND CAR WASH AT 601 POTOMAC STATION DRIVE NE. WHEREAS, Edens and Avant has requested special exception approval to permit a 2,400 square foot convenience store with a 1,012 square foot drive through car wash with six fuel pump islands located at 601 Potomac Station Dr. NE; and WHEREAS, the property is located in the PRC, Planned Residential Community Zoning District; and WHEREAS, on March 17, 2005, the Planning Commission recommended conditional approval of this application; and WHEREAS, on April 26, 2005 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for convenience stores with car wash and fuel pumps as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2004-0004, Potomac Station convenience store with car wash and fuel pumps, 601 Potomac Station Dr. NE, identified in the Loudoun County Land Records as Parcel Identification Number 148-16-4540, subject to the following conditions: 1. Substantial Conformance. Development of this special exception use shall be in substantial conformance with the special exception plat entitled "Potomac Station Parcel 'B' Convenience Store with gas pumps and car wash" dated November, 2004 and revised through 2/17/05 apd prepared Dewberry & Davis, L.L.C. -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2004-0004 POTOMAC STATION PARCEL B (PAD SITE D), TO PERMIT A CONVENIENCE STORE WITH GAS PUMPS AND CAR WASH AT 601 POTOMAC STATION DRIVE NE. Lighting. Site and canopy lighting is subject to review and conformance with the Design and Construction Standards Manual (DCSM). Foot candles at the property shall not exceed .5 and the source of illumination shall not be visible. Flat lens shall be used in the canopy flush with the bottom of the canopy. Free standing lights and building mounted lights shall have box-style housings with a flush lens in a horizontal fixed position. Shields shall be placed on any free standing lights with the shields located on the outside perimeter of the light if necessary to meet the standards of the DCSM. Any free standing lights shall be limited to 20 feet in height. Lighting shall also be reviewed and approved by the Board of Architectural Review. 3. Sidewalk. A concrete sidewalk shall be extended along the Battlefield Parkway frontage; providing safe pedestrian access to the site. Grease Interceptor. A grease interceptor will be required and details regarding shall be included at the construction plan submission. The special exception plat shall contain a note stating said requirement. No Modifications Granted or Implied. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual. Final plats, development plans and construction drawings are subject to the applicable town regulations. 6. BAR. The Board of Architectural Review shall review and approve architectural elevation drawings as well as landscaping and lighting plans. 7. Dumpster. Screening of the dumpster shall be reviewed and depicted on the special exception plat. 8. Mechanical Equipment. All mechanical equipment shall be screened from public view by appropriate architectural elements, including all rooftop equipment. Sight Clearance. Demonstrate a line of sight from the exit area of the car wash with the rest of the site that does not lead to dangerous traffic congestion within the site prior to development plan approval.
