A RESOLUTION: PRESENTED: June 14, 2005 2005-101 ADOPTED: June 14, 2005 APPROVING SPECIAL EXCEPTION TLSE-2004-0011 HERTZ RENT- A-CAR, 4 CARDINAL PARK DRIVE SE, TO PERMIT A VEHICLE RENTAL FACILITY IN THE B-3 DISTRICT WHEREAS, CMT Properties, LLC and Hertz. have requested a Special Exception to permit a vehicle rental facility within the existing Craftsman Auto Body shop; and WHEREAS, the property is located in the B-3 Community Retail/Commercial Zoning District; and WHEREAS, on May 5, 2005 the Planning Commission recommended approval of the Special Exception; and WHEREAS, on June 14, 2005, the Town Council held a public hearing; and WHEREAS, the proposed use has provided required information as part of a special exception application as set forth in the Zoning Ordinance, and WHEREAS, staff recommends approval. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: Special Exception application TLSE-2004-0011, Hertz Rent-A-Car, 4 Cardinal Park [)five SE, identified in the Loudoun County Land Records as Parcel Identification Number 189- 29-5529 is hereby approved with the following conditions: 1. Development of this property shall be in substantial conformance with Special Exception Plat dated September 13, 2004, revised March 8, 2005 by Bowers and Associates, Ltd (Vollmer and Associates) with reasonable allowances to be made for engineering and design alteration to meet Town Subdivision and Land Development Regulations, Zoning Ordinance or Design and Construction Standards Manual requirements. -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2004-0011 HERTZ RENT- A-CAR, 4 CARDINAL PARK DRIVE SW, TO PERMIT A VEHICLE RENTAL FACILITY IN THE B-3 DISTRICT. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual. Final plats, development plans, and construction drawings are subject to the applicable town regulations. 3. Sales rooms, rental offices, or service facilities shall be located within an enclosed building. The outdoor area devoted to storage, loading, parking, and display of goods shall be limited to that area so designated on an approved site plan. Such areas shall not be used for the storage or display of vehicles in inoperable condition as defined in Section 10-157 of the Town Code. 5. All outdoor areas used for parking, storage, loading, display, and driveways shall be constructed and maintained with an all-weather dustless surface. o All lighting fixtures used to illuminate outdoor areas shall be designed to avoid glare in surrounding areas. The facility shall be lit only during the hours that the facility is open for business, except for necessary security lighting. Note 6 should be removed from the landscape plan. The plan should clearly depict which of the required landscaping is missing or dead. In turn, the plan should also include a landscape schedule that indicates the number and size of the trees and shrubs that will be installed to replace the dead and missing plant material. A note should be added to the plan that these plants will be installed prior to the issuance of the zoning permit for Hertz Rent-A-Car. o Additional trees shall be planted in the landscape area along Cardinal Park Drive. The species of trees shall be taken from the list of acceptable trees found in Zoning Ordinance Section 12.9.6. Tree Selection and Cover Guide. If/when any of the existing Bradford Pear trees in this landscape area become damaged or die, that tree shall be replaced with an acceptable species from the list found in Section 12.9.6. The plan must be revised to delineate the installation of a concrete pad for the dumpster pursuant to section 4-310.5 of the Design and Construction Standards Manual. The concrete pad must be of a sufficient size to accommodate the front wheels of the pick-up vehicle. -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2004-0011 HERTZ RENT- A-CAR, 4 CARDINAL PARK DRIVE SW, TO PERMIT A VEHICLE RENTAL FACILITY IN THE B-3 DISTRICT. 10. In accordance with Design and Construction Standards Manual Section 7-520.8.C. the northernmost row of parking spaces shall be broken up by the landscape island as shown on the Special Exception Plat. 11. The semi-trailer loading space and relocated dumpster enclosure shall be constructed and maintained as shown on the Special Exception Plat. PASSED this 14th day of June 2005. '[ca:islt, n~.
