A RESOLUTION: PRESENTED: June 14, 2005 2005-103 ADOPTED: June 14, 2005 APPROVING EXTENSION OF WATER AND SEWER TO SERVE PHILLIP BOLEN PARK ON THE SHELLHORN TRACT on the Shellhorn Tract. In order to facilitate the development of Phillip Bolen Memorial Park on the Shellhorn property as approved by the voters, the Town Council hereby agrees to make available water and sewer service to the park at Phase 1-, subject to the approval by the Town and the County of an agreement setting forth the terms and conditions upon which WHEREAS, the Town Council met in joint session with the Loudoun County Board of Supervisors on June 6, 2005, to explore issues of mutual concern, including establishing a schedule of regular meetings of the two governing bodies for such purposes, supplying municipal water and sewer service to Bolen Park proposed to be constructed on property known as the Shellhom tract; and preserving long-planned employment uses on land in the vicinity of Leesburg Executive Airport and protecting it from encroaching residential uses; and WHEREAS, the Board invited the Council to identify property it wishes to incorporate into the Town and seek Board approval. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: Approving Extension of Municipal Water and Sewer Service to Bolen Park -2- RESOLUTION: APPROVING EXTENSION OF WATER AND SEWER TO SERVE PHILLIP BOLEN PARK ON THE SHELLHORN TRACT such utility services shall be provided. The cost of construction of the necessary utility infrastructure will be borne by the County and the utility extensions will to sized to serve only the demands of the park. The Council directs staff to cooperate with County staff to develop a timeline and critical path of activities (pertaining to site master planning, park design and funding, water tank specifications and utility infrastructure construction) to support the earliest possible opening of the park. Nothing herein shall be deemed to be a holding out by the Town as the sole water and sewer service provider outside its boundaries in this vicinity nor shall it operate as a commitment to provide such services to any party other than Loudoun County or for any purpose other than the purposes stated herein.
