AUTHORIZING SOLE SOURCE PROCUREMENTS FOR THE
OVERHEAD UTILITY RELOCATIONS AND WETLAND
MITIGATION FOR THE SYCOLIN ROAD WIDENING PROJECT
AND AUTHORIZING THE TOWN MANAGER TO PROCURE THESE
SERVICES
WHEREAS, the Sycolin Road Widening Project is a funded capital project; and
WHEREAS, the Sycolin Road Phase I (Oaklawn) is moving forward ahead of the town's capital
improvements projects; and
WHEREAS, the town is required to facilitate the overhead utility relocations; and
WHEREAS, the town has received preliminary estimates from the utility companies for the
relocation work; and
WHEREAS, the utility companies do not allow other entities to relocate their facilities; and
WHEREAS, the utility relocations by the utility companies becomes a sole source procurement
issue; and
WHEREAS, the estimates received are above the authorization level of the Town Manager as
· NOVEC $196,260.00
· Dominion Virginia Power $159,249.00
· Verizon Virginia $262,132.00; and
WHEREAS, the town is responsible for actual construction costs; and
WHEREAS, the overhead utility relocation can not begin until all overhead easements have been
acquired from the affected properties; and
WHEREAS, the Sycolin Road Widening Project requires wetland mitigation by the Virginia
Department of Environmental Quality (DEQ); and

MITIGATION FOR THE SYCOLIN ROAD WIDENING PROJECT
AND AUTHORIZING THE TOWN MANAGER TO PROCURE THESE
SERVICES
WHEREAS, the town has a choice to either do physical mitigation of the stream and wetland
impacts caused by the project or make a cash payment to an approved wetland bank as determined by the
DEQ; and
WHEREAS, in as much as the DEQ has designated the Virginia Aquatic Resources Trust Fund to
receive our payment, the mitigation payment therefore becomes a sole source procurement.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The Town Council hereby determines that only one source is practicably available
for each of these procurements and directs that this resolution be posted on the public notice board in the
town offices for a period of ten days.
SECTION II. The Town Manager is hereby authorized to procure the sole source utility relocation
services of the designated utility companies on Sycolin Road contingent upon acquisition of all needed
overhead utility easements.
SECTION III. The Town Manager is hereby authorized to procure the sole source payment to the
Virginia Aquatic Resources Trust Fund in order to validate the town's DEQ permit.
