Call to Order
Art Hernandez called the meeting to order at 6:00 p.m.
Approval of Agenda
Bill Case moved the agenda be approved as printed. Mary Schantz seconded the motion.
Motion carried.
Old Business
The proposed ordinance was reviewed and each suggested change was discussed. After a
review of the full document the Commission then voted on each suggested change.
Section 8-32 Part A – City Attorney Wolford suggested the scope be less broad. Commission members
voted to leave the statement as printed in the proposed ordinance. Motion carried.
Section 8-32 Part B – City staff clarified the language of the boundary. Commission members voted to
accept the changes as presented. Motion carried.
Section 8-32 Part D Number 1 – The language was not clear on roof replacements and it was suggested
the Commission entertain the addition of language stating that a full roof replacement would not be
considered demolition. Motion carried.
Section 8-32 Part E – City staff suggested a change to the language to provide clarification of the
application process. Motion carried.
Section 8-32 Part E - City staff reported the title of the building official was incorrectly listed as building
commissioner and suggested changing the title. Motion carried.
Section 8-32 Part E Number 1 – City staff added a currently required item, “A copy of the historic
preservation checklist.” Motion carried.
Section 8-32 Part E Number 3 – City Attorney Wolford recommended removing the requirement of
photos of surrounding properties because it would be unduly burdensome on the landowner.
Commission members voted to remove the language. Motion carried.
Section 8-32 Part E Number 6 – City Attorney Wolford suggested the commission remove the language
regarding site plans, floor plans, and elevation for planned new building(s) and/or accessory buildings.
Commission members voted to remove the language. Motion carried.
Section 8-32 Part E Number 7 – City Attorney Wolford recommended removing language that would
require a notarized signature of all owner’s-of-record. Commission member voted to remove the
language. Mary Schantz voted no. Motion carried.
Section 8-32 Part E Number 8 – City Attorney Wolford recommended adding the “at a reasonable
market price” to this item. Commission members voted to add the suggested language. Motion carried.
Section 8-32 Part F Number 1 – City Attorney Wolford recommended decreasing the number of days the
Historic Preservation is allowed to make a recommendation on the issuance of a permit. Commission
members voted to change the duration to 60 days. Art Hernandez voted no. Motion carried.
Section 8-32 Part F Number 2 – City Attorney Wolford raised concerns over the availability of funds to
cover the costs of newspaper ads. Commission members voted to remove the requirement of
publishing newspaper ads. Motion carried.
Section 8-32 Part F Number 3 – This section needed to be updated to reflect the change in Section 8-32
Part F Number 1 regarding the number of days the Historic Preservation Commission has to make a
recommendation on the issuance of a permit. Commission members voted to change the duration to 60
days. Art Hernandez voted no. Motion carried.
Section 8-32 Part F Number 5 and 6 – Doug Record motioned to keep the language but to change the
number of days of the stay period to thirty days. Bill Gerling seconded. Art Hernandez voted no.
Motion passed.
Section 8-32 Part F Number 7 – City Attorney Wolford recommended removing language making the
City Council responsible for making a decision. Commission members voted to leave the language as
printed in the proposed ordinance. Motion carried.
Section 8-33 Part A – Attorney Wolford recommended reducing the fine for unlawful demolition to the
maximum fine allowed in which a municipality can impose of $1,000 and up to 180 days imprisonment
and also to change the number of years the Department Director may impose a ban on building permits
to one year. Commission members voted to accept these recommended changes. Motion carried.
Section 8-33 Part B – City staff recommended clarified language regarding fees. Commission members
voted to accept the recommended changes. Motion carried.
Section 8-33 Part C – This section should be included in Appendix Y. Commission members voted to
move Section C to Appendix Y. Motion carried.
Appendix Y – The commission then voted that Appendix Y be amended to include a demolition permit
fee of $210 for historic buildings as described in Section 83-2 Part A. Motion carried.
Section 8-34 Title – The word properties should be changed to buildings. Motion carried.
Section 8-34 Number I – City staff recommended clarifying the language for consistency. Commission
members voted to accept the recommended changes. Motion carried.
Doug Record then motioned to approve all changes and passing the demolition ordinance on to the
Public Works and Planning Commission of the City Council. Terri Rademan seconded. Motion carried.
