REGULAR MEETING
March 10, 2009
The Moab City Council held its Regular Meeting on the above date in
the Council Chambers of Moab City Offices, located at 217 East Center
Street, Moab, Utah. Mayor David L. Sakrison called the Pre-Council
Workshop to order at 6:30 PM.
Mayor Sakrison called the Regular City Council Meeting to order at
7:00 PM and Citizen B.D. Howard led in the Pledge of Allegiance. Also
in attendance were Councilmembers Jeffrey Davis, Gregg Stucki, Kyle
Bailey and Sarah Bauman; City Manager Donna Metzler, City
Recorder/Assistant City Manager Rachel Ellison, Planning Director Jeff
Reinhart, City Treasurer Jennie Ross, Community Development
Director David Olsen, City Engineer Dan Stenta, Police Chief Mike
Navarre and Animal Control Officer Randy Zimmerman. Twenty-two
(22) members of the audience and media were present.
Councilmember Bailey moved to approve the Special Meeting Minutes
of February 4 and 5 and March 5, 2009 as well as the Regular Meeting
Minutes of February 10 and 24, 2009. Councilmember Bauman
seconded the motion. The motion carried 4-0 aye.
Under Citizens to be Heard, David Bodner stated that he had some
concerns with proposed Ordinance #2009-01. Mr. Bodner stated that he
would like to see the square footage requirement for coops changed as
well as the run square footage requirement.
A Community Development Department Update was not given.
Under Engineering Department Update, City Engineer Stenta stated that
he had received a letter from Bill Love regarding grazing in the
watershed that had some merit. City Engineer Stenta stated that he was
working on a response.
Under Planning Department Update, Planning Director Reinhart stated
that staff was preparing a flood plain ordinance.
A Police Department Update was not given.
A Public Works Department Update was not given.
Councilmember Davis moved to approve a Local Consent for
Issuance of a State of Utah Private Club Liquor License to
Edward Snyder, d.b.a. Eddie McStiff’s Inc. Located at 57 South
Main Street. Councilmember Bauman seconded the motion.
The motion carried 4-0 aye.
Councilmember Bailey moved to approve a Private Club
License for Edward Snyder, d.b.a. Eddie McStiff’s Inc. Located
at 57 South Main Street. Councilmember Bauman seconded the
motion. The motion carried 4-0 aye.
Councilmember Bauman moved to approve a Local Consent for

Councilmember Stucki moved to approve a Request for Use of
Old City Park by Western Stars Riders on June 17, 2009 with the
condition that the event end by 10:00 PM. Councilmember
Bauman seconded the motion. The motion carried 4-0 aye.
Councilmember Davis moved to approve a Request by John
Knowles for Use of City Right-of-way to Conduct a Sidewalk
Sale on March 21 to 22, 2009. Councilmember Stucki seconded
the motion. The motion carried 4-0 aye.
Councilmember Davis moved to approve a Moved-on Structure
Permit for Shannon Clarke, d.b.a. Millenium Shades Sunglasses
Located at 391 South Main Street to Conduct a Temporary
Mobile Sales Structure for Sunglasses Sales from April 2 to
April 27, 2009. Councilmember Stucki seconded the motion.
The motion carried 4-0 aye.
Councilmember Stucki moved to approve a Moved-on Structure
Permit for Brian Merrill, d.b.a. Moab Adventure Center Located
at 225 South Main Street to Conduct a Parking Lot Sale from
March 20 to September 20, 2009. Councilmember Bauman
seconded the motion. The motion carried 4-0 aye.
Councilmember Bailey moved to approve Proposed Resolution
#06-2009 – A Resolution Encouraging the Utah State
Legislature to Utilize the Current Transportation Funding
Distribution Formula for any Increase to the Statewide Gas Tax
so that the Entire Transportation Network May Benefit.
Councilmember Bauman seconded the motion. The motion
carried 4-0 aye.
Councilmember Bauman moved to approve Ordinance #2009-01
– An Ordinance to Amend Title 17.00, Zoning, with the
Addition of a New Chapter 17.52, Keeping Limited Numbers of
Fowl, Specifically Hen Chickens for Eggs and Establishing
Maintenance Standards. Councilmember Stucki seconded the
motion. Councilmember Stucki withdrew his second.
Councilmember Davis moved to table Ordinance #2009-01 – An
Ordinance to Amend Title 17.00, Zoning, with the Addition of a
New Chapter 17.52, Keeping Limited Numbers of Fowl,
Specifically Hen Chickens for Eggs and Establishing
Maintenance Standards. The motion died for lack of a second.
Councilmember Bauman amended her motion to approve
Ordinance #2009-01 – An Ordinance to Amend Title 17.00,
Zoning, with the Addition of a New Chapter 17.52, Keeping
Limited Numbers of Fowl, Specifically Hen Chickens for Eggs
and Establishing Maintenance Standards to include a permitting
system for all chicken owners with the provision that the permit
be eligible for renewal every two years with no fee.
Councilmember Bailey seconded the amended motion. The
motion carried 3-2 aye with Councilmembers Stucki and Davis
voting nay, Councilmembers Bauman and Bailey voting aye and
Mayor Sakrison voting aye to break the tie vote.
Councilmember Bailey moved to approve the City of Moab
Flexible Benefits Plan Election Form/Contract and
Compensation Reduction Agreement. Councilmember Davis
seconded the motion. The motion carried 4-0 aye.

Mayor Sakrison opened a public hearing on Proposed Ordinance #2009-
04 – An Ordinance Annexing Property to the City of Moab and a public
hearing on Proposed 2009 Community Development Block Grant
Project to Improve the Virginian Apartments at 7:30 PM.
A brief presentation was made by City Staff. No public comment was
given.
Mayor Sakrison closed the public hearing at 7:35 PM.
Councilmember Bauman moved to approve a Boundary Line
Adjustment for Drake Taylor for Property Located at 498
Rosetree Lane. Councilmember Stucki seconded the motion.
The motion carried 4-0 aye.
Councilmember Bailey moved to approve Proposed Resolution
#05-2009 – A Resolution Ratifying All Action on Authorizing
not more than $4,900,000 of Taxable Sales Tax Revenue Bonds
to Finance Recreational Improvements. Councilmember
Bauman seconded the motion. The motion carried 3-1 aye by a
roll-call-vote with Councilmember Davis voting nay.
Councilmember Stucki moved to approve Proposed Resolution
#07-2009 – A Resolution Approving the Form of the Equipment
Lease Agreement with Zions First National Bank, Salt Lake
City, Utah, finding that it is in the Best Interests of the City of
Moab, Utah to Enter Into Said Agreement, and Authorizing the
Execution and Delivery Thereof. Councilmember Bauman
seconded the motion. The motion carried 4-0 aye by a roll-call-
vote.
Under Reading of Correspondence, Mayor Sakrison read a letter of
Recognition for Public Safety Services in the City of Moab from the
State of Utah.
Under Administrative Report, City Manager Metzler stated that
departmental budget meetings were underway and that the selection
committee was interviewing the final six architects for the Aquatic
Center Project. City Manager Metzler also stated that she was working
on the Rotary Park Purchase.
Under Report on City/County Cooperation, Mayor Sakrison stated that
he was waiting on the Grand County Council Chair to schedule the next
joint meeting.
Under Mayor and Council Reports, Councilmember Bailey stated that
representatives from Housing and Urban Development would be
conducting a hospital field trip on March 24 and 25, 2009.
Mayor Sakrison stated that the City Council representative to the Moab
Area Chamber of Commerce needed to be filled.
Councilmember Bailey moved to pay the bills against the City of Moab
in the amount of $76,077.86. Councilmember Bauman seconded the
motion. The motion carried 4-0 aye by a roll-call-vote.
Mayor Sakrison adjourned the meeting at 7:54 PM.

MOAB CITY COUNCIL
REGULAR MEETING
March 24, 2009
The Moab City Council held its Regular Meeting on the above date in
the Council Chambers of Moab City Offices, located at 217 East Center
Street, Moab, Utah. A Pre-Council Workshop was not held due to a
lack of quorum.
Mayor Sakrison called the Regular City Council Meeting to order at
7:06 PM and Citizen B.D. Howard led in the Pledge of Allegiance. Also
in attendance were Councilmembers Gregg Stucki, Kyle Bailey, Rob
Sweeten and Sarah Bauman; City Manager Donna Metzler, City
Recorder/Assistant City Manager Rachel Ellison, Planning Director Jeff
Reinhart, City Treasurer Jennie Ross, Community Development
Director David Olsen, City Engineer Dan Stenta and Deputy Recorder I
Dan Tally. Seven (7) members of the audience and media were present.
There were no minutes to approve.
There were no Citizens to be Heard.
Under Community Development Department Update, Community
Development Director Olsen stated that he was planning a grand
opening of Dixie Park on Arbor Day, April 24, 2009. Community
Development Director Olsen continued that there were funds available
in the amount of $100,000 to use towards bridges on 500 West as well
as 300 West. Community Development Director Olsen also stated that
the Trail Mix Committee was working to extend the Millcreek Pathway
towards Lion’s Back and that some City support might be needed.
Under Engineering Department Update, City Engineer Stenta stated that
there would be complete construction plans for the 500 West project
later in the week. City Engineer Stenta also stated that the intersection
at 500 West and 400 North was being proposed as a two or four way
stop. City Engineer Stenta continued that the Riversands Waterline
project would be out to bid in the next two weeks and that he had
attended a webinar regarding the federal stimulus programs. City
Engineer Stenta stated that he would work on scheduling the public
involvement phase of the 500 West project. City Engineer Stenta
finished that he had received the Lion’s Back Watershed Protection Plan
and was in the process of reviewing it.
Under Planning Department Update, Planning Director Reinhart
reviewed the upcoming Planning Commission agenda.
A Police Department Update was not given.
A Public Works Department Update was not given.
Mayor Sakrison proclaimed April 24, 2009 as Arbor Day in the City of
Moab.
Mayor Sakrison proclaimed March 24, 2009 as Grand County High
School Debate Team Day in the City of Moab.
Mayor Sakrison proclaimed April 2009 as Child Abuse Prevention
Month in the City of Moab.
A presentation was made by Mike Dean, Head Ranger of the Moab
Office of the United States Forest Service Regarding the Brumley
Grazing Allotment Revision.

Councilmember Bailey moved to approve Proposed Ordinance
#2009-04 – An Ordinance Annexing Property to the City of
Moab with the following conditions: 1) The annexed property be
zoned R-4; 2) The additional access parcel adjacent to and
extending north of the Apple Lane right-of-way, and adjacent
property along 400 North be included as recommended by the
Moab City Planning Commission; 3) The surrounding adjacent
zoning be applied to these areas. Councilmember Stucki
seconded the motion. The motion carried 4-0 aye.
Councilmember Stucki moved to award the Golf Course Water
Line Project to C&B Earthworks in the amount of $39,211.
Councilmember Sweeten seconded the motion. The motion
carried 4-0 aye by a roll-call-vote.
Councilmember Sweeten moved to approve the Golf Course
Water Line Project Contract with the condition of removing the
performance and payment bond requirements from the contract.

Sweeten stated that they had been contacted by Loren Johnson
regarding the dam maintenance issue.
Under Administrative Report, City Manager Metzler reviewed the
proposed budget schedule for the next month. City Manager Metzler
stated that staff was seeking creative means to balance the proposed
budget. City Manager Metzler stated that the selection committee had
been working on the selection process of the firm for the Aquatic Center
Architectural Services Contract. City Manager Metzler stated that three
architects had been selected from the original seventeen and that the
selection committee would be participating in an aquatic center site visit
that next Friday. City Manager Metzler stated that the Housing
Committee was proceeding with their Affordable Housing Plan drafting
process.
Under Report on City/County Cooperation, Mayor Sakrison stated that
he had spoken to Grand County Council Chair Bob Greenberg and told
him to choose a date for the next Joint Meeting.
Under Mayor and Council Reports, Councilmember Bailey stated that
he had attended a meeting in Moab with the Hospital, community and
the Housing and Urban Development office in Moab. Councilmember
Bailey stated that a proposal should be submitted by April 15, 2009.
Councilmember Bailey moved to pay the bills against the City of Moab
in the amount of $74,335.58. Councilmember Sweeten seconded the
motion. The motion carried 4-0 aye by a roll-call-vote.
Mayor Sakrison adjourned the meeting at 8:24 PM.

SPECIAL MEETING
April 7, 2009
The Moab City Council held a Special Meeting on the above date in the
Council Chambers of Moab City Offices, located at 217 East Center
Street, Moab, Utah.
Mayor Sakrison called the Special City Council Meeting to order at 7:00
PM. Also in attendance were Councilmembers Gregg Stucki, Kyle
Bailey, Rob Sweeten, Jeffrey Davis and Sarah Bauman; City Manager
Donna Metzler, Deputy Recorder Danielle Guerrero, Planning Director
Jeff Reinhart, Community Development Director David Olsen, Police
Chief Mike Navarre and Animal Control Sergeant Randy Zimmerman.
Three (3) members of the audience and media were present.
Councilmember Bauman moved to approve a Moved-on
Structure Permit for MS, LLC d.b.a. Dippin’ Dots Located at
702 South Main Street to Conduct a Dippin’ Dots Mobile Trailer
from April 8 to April 12, 2009. Councilmember Davis seconded
the motion. The motion carried 3-0 aye.
Councilmember Davis moved to approve a Moved –on Structure
Permit for The Parts Store Inc. Located at 356 South Main Street
to Conduct a Concession Stand for Various Dates beginning
April 8 to November 8, 2009. Councilmember Bailey seconded
the motion. The motion carried 3-0 aye.
A presentation was made by City Manager Metzler regarding the fiscal
year 2009-2010 Budget for all funds. Discussion followed.

Subject: Exception to Purchasing Procedure
I, along with the Mayor, recently met with Bob’s Sanitation regarding the upcoming
expiration of the solid waste contract. As you may know, this contract was originally
awarded after a competitive bidding process, and has seen an extension from the
original termination date. The contract expires this December.
Moab Municipal Code provides for a competitive bidding process, as follows:
2.28.040 Purchasing procedure--Securing competitive proposals and bids.
It shall be the duty of the purchasing agent to make all purchases upon the most advantageous
terms to the city, and to this end, the purchasing agent shall procure competitive proposals from at
least two responsible persons, and shall take advantage of the lowest possible prices for goods of
equal value. In all cases involving the expenditure of sums in excess of seven thousand dollars and
below fifteen thousand dollars, the purchasing agent shall secure proposals in writing from at least
three bidders, which proposals shall be filed with the requisitions pursuant to which the expenditures
are made. Unless specifically excepted by provisions of this section, in all cases involving the
expenditures of sums in excess of fifteen thousand dollars, the purchasing agent must advertise and
solicit sealed bids as provided under current procurement guidelines. (Ord. 06-07 (part), 2006: Ord.

The Moab Municipal Code also allows for exceptions to this provision, as follows:
2.28.045 Purchasing procedures--Exceptions.
G. Procurements by procedures other than as specified in this chapter shall be allowed only upon good
cause shown, and by approval of the city council. (Ord. 06-09, 2006: Ord. 05-04 (part), 2005)
At the meeting, Bob Hawks indicated that he would like to continue providing solid waste
service under the current terms and conditions of the contract, and that he did not expect
any price increases. Given that the contractor has committed to providing the service at
the same price, and given the history of good service provided by Bob’s Sanitation, I
believe that it is appropriate for the City Council to make an exception to City purchasing
procedures and to waive the competitive bidding requirement. If the City Council
approves this exception, I can negotiate a new contract with the current service provider.

Subject: Approval of the Final Plat for the Secret Cove Subdivision as
Presented by Bryan Hurley, and Referred to Council by the
Planning Commissions
Background
Brian Hurley, acting on behalf of property owners, Arthur and Wanda Secrest, has
submitted the Secret Cove Subdivision to the city for review. The 3.94-acre property is
located at approximately 500 South 400 East on the east side of 400 East. The property
is affected by Mill Creek, and deems some of the land unsuitable for building because of
the floodway. The property is further split by the R-2 Residential Zone and the FC-1
zone adjacent to and including the Mill Creek drainage area. The 100-year flood plain,
AO Zone, as noted on the current Flood Insurance Rate Map (FIRM), is significantly
spread across the majority of the property. Please refer to the attached plat and
drawings for more detail.
The plan is to create six (6) single family lots that vary from 7,800 square feet up to
63,000 square feet in size. Access to the lots will be from a newly dedicated and
constructed cul-de-sac named Robin Court that extends off of 400 East.
The application was originally submitted on December 15, 2008, and revised and
resubmitted on January 9, 2009, after staff review. The attached plat has incorporated
the changes for compliance with the code that were noted by staff.
Discussion
The Planning Commission reviewed the final plat at their meeting on March 26, 2009. An
additional easement for city crews to access the bottom of Mill Creek for removal of
debris was added as requested by City Staff. The plat has been favorably referred to
Council with three conditions:
1) All construction must meet or exceed FEMA regulations.

easement.
3) Detailed street, storm water drainage plan, and utility plan shall be submitted
to the City for review by the Public Works Director and City Engineer.
Recommendation
Staff agrees with the Planning Commission and recommends that Council approve the
final plat of the Secret Cove Subdivision with conditions established by the Planning
Commission.

Official Zoning Map Indicating the Realignment of the FC-1 Flood Channel
Zone, as Referred to Council by the Planning Commission
Discussion
The attached proposed zoning map indicates the most recent boundaries of the FC-1 Zone as
delineated by a recent FEMA study. The boundaries have incurred widening of some areas and
narrowing in others as noted on the attached exhibit. The adoption of this map will clarify and
identify the new boundaries of the flood channel as well as provide a progress of the recently
annexed and zoned areas.
Recommendation
Staff agrees with the Planning Commission and recommends that the map be adopted. There are
no identifiable changes that can be made to the newly delineated boundaries and the addition of
the newly annexed areas is a simple housekeeping action. No other changes are incorporated into
this map.

AN ORDINANCE TO ADOPT A REVISED OFFICIAL ZONING MAP INDICATING THE
REALIGNED BOUNDARIES OF THE FC-1 FLOOD CHANNEL ZONE
WHEREAS, the Moab City Council (Council) adopted Title 17.00.00, also known as “The
Zoning Ordinance of Moab City, Utah” on May 19, 1954, and the associated Zoning Map
titled “Zone Map of Moab, Utah”, in an effort to encourage and facilitate orderly growth
and development, promote a more attractive and wholesome environment, and to
protect the public health, safety and general welfare; and,
WHEREAS, the Federal Emergency Management Agency (FEMA) has initiated a project
to generate a digital Flood Rate Insurance Rate Map (FIRM) that has upgraded the
FIRMs for many places in Moab, Utah (City) and altered the boundaries of the
designated floodway channel for Mill Creek and Pack Creek; and,
WHEREAS, the Planning Commission (Commission) held a duly advertised public
hearing on the matter during their regular meeting held on March 20, 2009 to receive
testimony from the public and consider the recommendations from staff; and,
WHEREAS, the Commission favorably recommended the City of Moab Official Zoning
Map (Map) to the Moab City Council (Council) for review and approval; and,
WHEREAS, Council reviewed the Map during their regular meeting held on March 24,
2009, and agreed with the Commission that said Map should become the Official Zoning
Map for the City.
NOW, THEREFORE, be it ordained by the Moab City Council that the attached map
titled “The Official Zoning Map for the City of Moab” is hereby adopted and is an
acceptable representation of the zoning district boundaries for the City.
PASSED AND APPROVED in open Council by a majority vote of the Governing
Body of Moab City Council on April 14, 2009.

Review of Ordinance #2009-06, An Ordinance Amending the
Municipal Code Chapter 17.33, FC-1 Flood Channel Zone,
Specifically Referencing Fencing, Structures for Public
Transportation, Vegetation, and Penalties, as Referred to Council
by the Planning Commission
The FC-1 Zone dovetails with the language of Ordinance # 2009-03, Flood Damage
Prevention ordinance and establishes the regulations for the zone. In some cases, the
regulations are more stringent than the FEMA regulations and are necessary and
intended to reduce losses of property from possible flooding.
Discussion
The adoption of ordinance 2009-06 is a step in strengthening our regulations for this
potentially hazardous zone. The regulations specifically targets fencing, planting and
removal of trees and shrubs as well as stating that the floodway shall be kept clear of
barriers. The existing language from the development code has been attached for your
convenience.
The Planning Commission reviewed this text amendment at their meeting held on March
26, 2009, and after some minor changes, unanimously voted to recommend the
ordinance to Council for approval.
Recommendation
Staff recommends that this ordinance be adopted as submitted.
Alternatives
In its action, Council can:
1) Approve Ordinance #2009-06 as submitted;
2) Approve Ordinance #2009-06 with any changes necessary to satisfy other
adopted regulations or address concerns;
3) Table the ordinance in order to satisfy the need for additional information.

AN ORDINANCE AMENDING THE CITY OF MOAB MUNICIPAL CODE,
CHAPTER 17.33, FC-1 FLOOD CHANNEL ZONE, SPECIFICALLY REFERENCING
FENCING, STRUCTURES FOR PUBLIC TRANSPORTATION, VEGETATION AND
PENALTIES
WHEREAS, the Moab, Utah (City) City Council ("Council") adopted the Moab Municipal
Code ("Code") Title 17.00, Zoning, and especially Chapter 17.30 Flood Channel Zone, in an
effort to facilitate the protection of life and property from damage because of floods orderly
growth and development in the City as well as to curtail losses and damage to properties
from flooding; and,
WHEREAS, from time to time, the Federal Emergency Management Administration (FEMA)
has conducted hydrologic studies and presented the city with necessary changes to the
boundaries of the Floodway that may or may not alter the boundaries of the FC-1 Flood
Channel Zone; and,
WHEREAS, over time, City staff has recognized that certain aspects of Code Chapter 17.30,
FC-1, Flood Channel Zone, are not conducive to providing protection from flood damage; and,
WHEREAS, fencing in floodways, construction of public transportation structures,
construction of barriers, removal or planting of vegetation in floodways, and enforcement
and penalties are inadequately addressed in the existing text of the FC-1 Zone; and,
WHEREAS, Staff has recommended the attached amendments to the FC-1 Zone; and,
WHEREAS, the City of Moab Planning Commission ("Commission") in a public hearing held
on March 26, 2009, reviewed the changes to Code text that references the Flood Channel;
and,
WHEREAS, the Commission found that adoption of the proposed language for the
continued participation of the City in the NFIP was a great benefit to the residents of the City
of Moab; and,
WHEREAS, the Commission favorably recommends the new language to Council for review
and approval; and,
WHEREAS, Council reviewed Ordinance #2009-03 in a regularly scheduled meeting held
on April 14, 2009, to hear and decide the merits of the proposed change to Chapter 15.30,
Flood Channel Zone, of the Code; and,
WHEREAS, Council found that the changes will add to the welfare and safety of the
residents and provide greater prevention benefits from flooding to the residents of Moab.
NOW, THEREFORE, the Moab City Council hereby ordains that Chapter 17.30, FC-1, Flood
Channel Zone shall be amended to read as follows:

17.33.010 Objectives and characteristics.
The primary purpose of the FC-1 flood channel zone is to facilitate the protection of
life and property from damage due to flood events by ensuring that the creek channel and
adjacent overbank areas necessary to convey flood flows will be permanently kept free of
encroachments. Lands within this zone are characterized by the primary creek channel
and adjacent riparian fringes, which are free of buildings, fences, and fill embankments that
are likely to be damaged or which will likely cause a restriction to the free flow of
floodwaters during recurring floods. (Prior code § 27-12-1)
17.33.020 Use requirements.
Only the following uses shall be permitted in the FC-1 flood channel zone:
A. Agricultural uses, farming, truck gardening and the growing of nursery stock;
B. Temporary corrals, pens and coops that will not impede the free flow of
floodwaters in a significant way, and are sufficiently anchored to resist movement by
floodwaters;
C. Fencing up to six feet in height provided that the requirements of paragraph
17.33.060 are met;
C. The care and keeping of animals and fowl subject to the rules and regulations
of the board of health;
D. Revetments and other flood protection structures;
E. Public parks, trails, and playgrounds;
F. Public transportation structures.
17.33.030 Area, width and location requirements.
There shall be no regulations pertaining to area, width or location of building
requirements in the FC-1 flood channel zone. (Prior code § 27-12-3)
17.33.040 Specific Regulations.
The following use regulations shall apply:
A. Fences. — No fences either temporary or permanent in nature shall be
permitted to be erected with the FC-1 zone unless a fencing plan is approved by
the City Floodplain Administrator. The plan shall include scaled drawing(s) that
clearly depict the location of the fence on the property, an elevation view of the
fence indicating the materials to be used, and a timeline for the construction of
the fence.
B. Planting or removal of trees and shrubs. — Deep-rooted vegetation within the
flood channel provides critical protection against large scale erosion. However,
dense stands of sturdy trees and woody shrubs can also obstruct the free flow of

floodwaters. The best situation is scattered native trees with a dense
groundcover of native shrubs and grasses that offer minimal resistance to the
passage of floodwaters. No existing native vegetation shall be removed and no
new trees shall be planted within the floodway without the written approval of the
City Floodplain Administrator. For any clearing or revegetation activity, a
stabilization plan is required to be submitted to the city for evaluation and
approval by City Staff.
C. F000dway to be kept clear. — The presence of debris such as fallen trees and
tree limbs, construction materials, vehicles, or similar, within the floodway
represents a significant hazard to the community as the debris can be
transported by the floodwaters and become lodged against one of the several
bridges structures. The accumulation of debris or storage of materials is
prohibited within the floodway. It shall be the property owner's responsibility to
keep the floodway portion of their property free of any such materials.

17.33.050 Enforcement and Penalties
No structure or land shall hereafter be constructed, altered, converted, or extended
without full compliance with the provisions of this chapter and all other applicable
regulations. Violations of this chapter by failing to comply with any of its requirements shall
constitute a misdemeanor. Any person who violates this ordinance through non-compliance
with any of its requirements shall upon conviction thereof be fined not more than $ 1,000.00
or imprisoned for not more than ninety (90) days, or both, for each violation, and in addition
shall pay all costs and expenses involved in the case. Such associated costs may include
attorney fees, all court fees, staff time, and shall include costs associated with the
abatement of the violation. Such costs may include, but are not limited to, removal of all
prohibited barriers, structures, or fill. Nothing herein contained shall prevent the City of Moab
from taking such other lawful action as is necessary to prevent or remedy any violation.
AND, FURTHERMORE, the Moab City Council hereby ordains that Chapter 17.06,
Definitions, shall be amended to include the following term:
Revetment. A wall or facing of stone, concrete, masonry, wood or other stabilizing material
placed on the banks of rivers, streams or levees to protect them from erosion
Effective Immediately Upon Passage.
