PARK/BEACH RESERVATION SYSTEMS
Adopted April 28, 1988
I. "Private Gatherings"
This might include "invitation -only" affairs such as company parties,
reunions, service club functions, church/fraternal picnics, weddings,
anniversaries or receptions.
Generally these groups expect and request total or near total use of a
park area. Usually they are short duration, three hours or less.
Frequently they request or desire additional fixtures, tables or
benches than are usually available at the site. Most often there is
no attendance charge or nominal if any (possibly a per plate charge at
a club picnic.) Usually the general public is not encouraged or
allowed to attend these gatherings.
POLICY:
The City Administrator may develop a policy to allow this use.
General Outline:
1. Permit fee - $50.00 non-refundable fee payable in advance.
Applications must be filed fourteen (14) days prior to the pro-
posed event. If request is denied fee will be returned.
$50.00 damage/clean-up deposit is required.
2. Limitations
A. The event, including set-up and take -down, must be less than
four (4) hours.
B. Applications will not be accepted for summer holidays,
weekends (Memorial Day, July 4th celebration, Labor Day).
C. The gathering may only occupy fifty per cent of the park
beach site. This may be indicated to the public by use of
ropes, signs or flagging. The remaining park shall be open
to the public.
D. The host or sponsor is limited to equipment, facilities at
the site. The City of McCall will not move, loan or secure
additional tables, benches or trash cans for the gathering.
C. flout/Group Sponsor is responsible for sita set-up and
clean-up. City Park attendants will not be on hand through-
out the gathering. Damage deposit will be returned only upon
inspection of site by City Park Department.
F. Host/Group Sponsor must obey and comply with existing state
and local laws. This includes crowd conduct, consumption of
alcoholic beverages on city property and limitations on volume
of music or public address systems.
G. No gathering may continue past 9:00 P.M. Mountain Time.
Sponsor/host is responsible for conclusion of party and de-
parture of guests.
H. City Administrator may deny permit to any group based on con-
cerns regarding conduct of gathering, public safety or
potential damage to facility.
I. Any damage will be accessed at replacement/and/or repair cost
and must be paid to City of McCall immediately.
II. "Commercial/Public Gatherings"
This is usually a function that any and all citizens are invited to or
urged to participate in. The commercial aspect includes the selling
of merchandise, food, beverage or services for profit. This might
include renting of booths or display space. Activities involved in
such functions might include: 1) Craft fairs or expositions, 2) Arti-
sans festivals, 3) Music concerts requiring admission, 4) Public (for
profit) food concessions or barbeques, etc.
Generally these groups need or desire all of the park/beach
facilities. Usually the gatherings involve lengthy set-up or prepar-
ations, one-half to one full day of preparation. Usually there are
site admission prices or merchandise for sale. If these events are
successful or popular the crowds can be quite large and obviously will
have quite a physical impact on the park site. Often there is
necessary clean-up and repair tasks associated with such a gathering.
POLICY:
The City Administrator may develop an application policy to regulate
and control this use.
General outline:
1. Permit application fee - $150.00 per day, non-refundable, payable
in advance. Application must be filed twenty one (21) days in
advance. If request is denied the money will be returned.
$150.00 per day damage deposit is due at the application time.
2. Limitations:
A. Set-up and on -site preparation may not begin prior to 4:00
P.M. the day prior to the gathering.
B. A11 take -down and clean-up must be completed prior to 9:00
P.M. the final day of the event.
C. Applications will not be accepted for summer holiday week-
ends (Memorial Day, July 4th Celebration and Labor Day).

riate food -concession licenses.
G. No gathering may continue past 9:00 P.M. Mountain Time.
Sponsor/host is responsible for conclusion of party and
departure of guests.
H. City Administrator may deny permit to any group based on con-
cerns regarding conduct of gathering, public safety or
potential damage to facility.
I. No overnight camping will be allowed at the park site. If
necessary for security reasons, the sponsor may seek permis-
sion to allow designated participants to stay at the site.
This request must be made in writing in advance.
J. Applicant must indicate on application who the event sponsors
are, the proposed schedule of events, fees or charges for
participation (booth space, admission, etc.)
K. If the City Administrator deems the need, the City of McCall
may require additional regulations and/or costs as suitable,
i.e. insurance, traffic control, site inspection, additional
equipment, additional site personnel.
L. McCall City Council will reserve right to review appeals or
requests for exceptions.
(Note: Street Carnival or Hawkers license may apply to Commercial
ventures)
III. "Public/Non-commercial Gatherings"
These groups might include youth, school, civic or community groups.
The event might be a program, concert event or gathering open to the
general public at no charge or admission. These gatherings must be of
recreation/leisure/education nature and not business related.
These groups would be handled on a case by case basis. A refund for
cleaning and damage may be collected as necessary. City Administrator
or designee may develop policy or requirement for use.

"Public/Non-commercial Gatherings"

The McCall Parks & Recreation Advisory Committee recommends that
the city adopt the following parks, beaches and docks rules &
regulations.
1. PENALTIES FOR VIOLATIONS: Any person, persons, partnership,
corporation, concessionaire, association, society, fraternal, social
or other organized groups failing to comply with these rules
regulations, or conditions will be guilty of a misdemeanor and subject
to the penalties provided in McCall Code f
The above penalty shall not prevent the Parks and Recreation
Department from filling a civil claim against a violator to collect
damages incurred to park/beach areas or facilities.
City Police shall have the authority to remove any violator of
the rules and regulations from the area, as a trespasser. No fees
paid by a violator shall be returned to the violator upon his removal
from the park or beach.
2. PRESERVATION OF PUBLIC PROPERTY: The destruction, injury,
defacement, removal or disturbance of any public building, sign,
equipment, monument, statue, marker or any other structures, or of any
tree, flower, vegetation or any other public property of any kind is
prohibited. Violation will face fines and/or be subject to
replacement of damaged items.
3. PUBLIC BEHAVIOR AT PARKS & BEACHES:
A. Users are restricted from the production of noise that may be
disturbing to other users.
B. Amplified sound, poorly muffled vehicles, loud conduct or
loud equipment are prohibited within a park or beach.
C. State Laws in regard to alcoholic beverages, public
drunkenness, disturbing the peace or the illegal use of drugs will be
enforced on park and beach premises.
4. FIREWORKS: No person shall use fireworks of any kind within or
over the boundaries of the Park & Beach area, except as authorized
under a special use permit pursuant to chapter sect. of the
McCall City code.
5 . LITTERING:
A. It is unlawful for any person to dispose of throw away or
leave any empty container or other litter on any public park, grounds,
or beaches within the city; provided, however, that such empty
container or other litter may be deposited in receptacles provided
especially for that purpose.
B. No person shall scatter or throw, distribute or affix upon
any public parks or beaches or public property or on utility pole or
standard or in or on any vehicle while parked on such public property,
any handbill, poster, advertisement flier, litter or paper. The
provisions of this section do not interfere or prevent the posting of
notices required by law to be posted.
6. FIRES: The use of fires is restricted to fire pits, grills and
other fixture designed for such use. A11 fires must be kept under
control and must be extinguished before leaving the park or beach or
whenever the fire is left unattended. All parks & beaches may be
closed by the City Fire Chief to open fires. Open fires on sand
beaches are prohibited.
7. FIREARMS: No person shall discharge firearms or any other
projectile firing device within or over the boundaries of the parks or
beaches.
8. DOCKS/BOATS:
A. Boats and fishing activities must remain clear of swimmers
and designated swimming areas.
B. Motorized water craft are not allowed to be beached nor
moorage at any city beaches.
C. No person shall moor a watercraft for more than six (6) hours
during any twelve(12) hour period at the city owned docks.
D. Water skiing to or from city docks is prohibited.
E. Fishing is permitted at docks, but mist be excised with
caution.
9. USE OF EVIORIZED VEHICLES:
A. A11 motorized vehicles must stay on authorized roadways or in
designated parking areas. The drivers of all vehicles operated within
such roadway & Parking areas shall be licensed as required by Idaho
Code.
B. This rule does not prohibit the official use of motorized
vehicles or machines by city employees anywhere within the parks or
beaches.
10. PARKING AND CAMPING: Overnight parking and camping at the parks
and beaches is prohibited. Police are authorized to remove any
violators from premises.
11. PETS AND ANIMALS: Pets and all other domestic animals are not
allowed within the boundaries of the parks and beaches pursuant to
city code section
12. PROTECTION OF WILDLIFE: Molesting, injuring, killing or
disturbing any wild creature or animal is strictly prohibited. This
does not intend to prohibit game fishing as regulated by Idaho Fish &
Game regulations.
13. AUTHORIZED OPERATIONS:
A. No person, firm, corporation, association or other
organization shall operate any concession, business, or enterprise
within the park or beach boundaries except as authorized by a special
use permit issued by the city.
B. No persons, partnership, corporation, association or other
organized groups are permitted to:
a. beg or solicit for any purpose
b. gamble or operate a gambling device of any nature
c . abandon any property or
d. advertise or conduct business operations
e. discriminate in any manner against any person or persons
because of race, creed, color, sex or national origin within the
boundaries of the parks & beaches.
14. RESPONSIBILITY: The City of McCall is not responsible for damage
to, or theft of personal property within the boundaries of the city
parks and beaches. A11 areas and facilities within the parks and
beaches boundaries are used at the users own risk. Swimming, Park,
and Playground areas are active sites involving a variety of physical
activities that may be physically demanding or potentially dangerous
to users.
The committee feels that these sort of park & beach regulations
would enhance the resident's & visitor's enjoyment & use of the sites
by improving the sites user safety. The committee strongly believes
the notice or posting of such regulation at the various site rrust be
done in a positive manner.
