HomeMy Public PortalAbout2005_09_27_r155The Town of Leesburg, Virginia RESOLUTION NO. 2005-1555 A RESOLUTION: PRESENTED: September 27, 2005 ADOPTED: September 27, 2005 APPROVING SPECIAL EXCEPTION TLSE-2005-0003 PETSMART VETERINARY HOSPITAL, TO PERMIT A 2,023 SQUARE FOOT VETERINARY HOSPITAL WITHIN THE PETSMART RETAIL STORE AT 510 E. MARKET STREET. WHEREAS, PetsMart, Inc. has requested special exception approval to permit a 2,023 square foot veterinary hospital within the Leesburg Plaza Shopping Center located at 510 E. Market Street; and WHEREAS, the property is located in the B-2, Established Corridor Commercial Zoning District; and WHEREAS, on September 1, 2005, the Planning Commission recommended conditional approval of this application; and WHEREAS, on September 27, 2005 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for veterinary hospital uses as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2005-0003, PetsMart Veterinary Hospital, 510 E. Market Street, identified in the Loudoun County Land Records as Parcel Identification Number 188-25-9123, subject to the following conditions: 1. Substantial Conformance. Development of this special exception use shall be in substantial conformance with the special exception plat entitled "PetsMart" revision date 6/05 and prepared by Bohler Engineering, P.C. -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2005-0003 PETSMART VETERINARY HOSPITAL, TO PERMIT A 2,023 SQUARE FOOT VETERINARY HOSPITAL WITHIN THE PETSMART RETAIL STORE AT 510 E. MARKET STREET. 2. No Modifications Granted or Implied. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual. Final plats, development plans and construction drawings are subject to the applicable Town regulations. 3. Sound Attenuation. PetsMart shall install the following sound attenuation safeguards in the Leesburg store: Prototypical demising and exterior walls shall be constructed of full height 8" CMU that attenuates any sound produced inside the PetsMart store. If metal stud wall construction is used for exterior and demising walls, full height 6" batt insulation will be used in the interior walls and exterior walls. This construction method attenuates any sound produced inside the store. Fiberglass batt insulation will also be used on the interior walls of the grooming area and the health services area in combination with acoustical ceiling tile to further control sound within the PetsMart store. 4. Ventilation. PetsMart shall not generate any objectionable fumes or odors that will adversely affect nearby properties or the general neighborhood. PetsMart shall keep all of its services within the confines of the store and will not have outside pet runs or other exterior pet service areas. 5. Medical Waste Disposal. Contracted vendors will remove any medical waste in the form of spent syringes, catheters and etc. All syringes will be pulled apart and the needles put in a "Sharps" container. National Healthcare Distributers CNHD), or other properly licensed vendors, will install, service and manage film processor waste for silver recovery units (x-ray wastes). All other pharmaceuticals, vaccines and antibiotics will be packaged and labeled by manufacturers as required by the FDA. All medical wastes, pharmaceuticals, vaccines and antibiotics shall be disposed of according to FDA standards. PASSED this 27th day of September 2005. ATTEST: ~ca4ste~C.
