HomeMy Public PortalAbout003-1978 - Zoning - 1300 S. 9th - C-2 to C-4ORDINANCE NO. 3-1978 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968, designates and describes as C-2 Community Business District, the following described property located at 1300 South 9th Street, in the City of Richmond, Indiana more particularly described as follows: Lots numbered eleven (11), twelve (12), thirteen (13) and four- teen (14) in the Beallview Addition to the City of Richmond, EXCEPTING fourteen (14) feet off the entire West end of each of said lots, dedicated for use of public alley as set forth in Plat Book 6, page 127, AND ALSO, Lots 64, 65, 66, 67, 68, and 69 in Beallview Addition to the City of Richmond, Indiana. ALSO, a strip of land fourteen (14) feet in width lying East of Lots Numbered Sixty-four (64), Sixty-five (65), Sixty-six (66), Sixty-seven (67), Sixty-eight (68) and Sixty-nine (69) in the Beallview Addition to the City of Richmond, Indiana, and more particularly described as follows: Beginning on the south side of South"M" Street in the City of Richmond, Indiana, at a point one hundred sixty-four (164) feet East of the northwest corner of Lot Number Sixty-four (64) in the Beallview Addition to the City of Richmond, Indiana, and running thence, from said beginning point, West along the south line of South "M" Street, fourteen (14) feet to the northeast corner of said Lot Number Sixty-four (64) in said Beallview Addition; thence South, along the east lines of Lots Sixty- four (64), Sixty-five (65), Sixty-six (66), Sixty-seven (67), Sixty-eight (68) and Sixty-nine (69) in said Beallview Addition to the southeast corner of said Lot Number Sixty-nine (69) in said Beallview Addition; thence East fourteen (14) feet; thence North, parallel to the east line of Lots Sixty-nine (69), Sixty- eight (68), Sixty-seven (67), Sixty-six (66), Sixty-five (65) and Sixty-four (64) in said Beallview Addition to the place of beginning. Being a part of that portion of a certain public alley which was vacated by order of the Board of Public Works of the City of Richmond, Indiana, by declaratory Resolution Number 226-1928, a plat of which vacation of said portion of said public alley is spread of record in the Office of the Recorder of Wayne County, Indiana, in Plat Book 6, page 128. EXCEPTING THEREFROM, Being part of Lots Sixty-four (64), Sixty- five (65), Sixty-six (66), and Sixty-seven (67), Beallview Addi- tion, and part of vacated South 8th Street, including that portion designated as "Park" lying west of and adjacent to part of vacated South 8th Street, all in the City of Richmond, Indiana, more particularly described as follows: Beginning at an iron pipe at the present southeast corner of South 8th Street and South "M" Street, in said City of Richmond, Indiana, and running thence, from said beginning point, east, along the south line of South "M" Street, one hundred sixty (160) feet to a point; thence south, assuming the south line of South "M" Street to run east and west, one hundred thirty (130) feet to a point, thence west parallel to the south line of said South "M" Street, one hundred twenty and ninety-seven hundredths (120.97) feet to a point on the east line of present South 8th Street; thence north sixteen (16) degrees and forty-three (43) minutes west, along a chord of a curve to the right in the east line of said South 8th Street, a chord distance of one hundred thirty-five and seventy-six hundredths (135.76) feet to the place of beginning. Page 2 SECTION 2. WHEREAS, it is the intent and purpose hereof to change the zoning classification on the above described area from C-2 Community Business District to C-4 General Business District, and, SECTION 3. WHEREAS, study of this Ordinance was con pIcted by the Richmond City Plan Commission the v '� day of 1978, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. SECTION 4. WHEREAS, the vote of the Richmond City Plan Commission was to o in favor of/in recommending the passage of Ordinance No. 3-1978. NOW THEREFORE: SECTION 5. It is hereby ordained that the zoning classification of the above described property be, and the same is hereby changed to C-4 Gen- eral Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amendments thereto. SECTION 6. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. SECTION 7. The originalzoning classification of the aforementioned area is hereby rescinded and the zoning classification of this area will be in accordance with Section 2 of this Ordinance.
