HomeMy Public PortalAbout005-1978 - Zoning - Intersection of US 40 and Salisbury Rd - From R-1 to C-2ORDINANCE NO. 5-1978 SPONSORED BY COUNCILMAN AUSTERMAN AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: WHEREAS, it is the intent and purpose hereof to change the zoning classification on the following described property from R-1 One - Family Residence District to C-2 Community Business District, and, WHEREAS, the Zoning Ordinance No. 2325-1968 designates that newly annexed territories are to be zoned R-1 One -Family Residence District on a temporary basis and provides that the Planning Commission shall make a recommendation for a permanent zoning classification to Common Council within a period of six (6) months on the following described property located on the north- west corner of the intersection of U.S. 40 and Salisbury Road, in the City of Richmond, Indiana more particularly described as follows: Being a part of Fractional Section One (1), Township Thirteen (13) North, Range Two (2) West, in Wayne Township, and part of Fractional Section Twenty -Two (22), Township Sixteen (16) North, Range Fourteen (14) East, in Center Township, Wayne County, Indiana, more particularly described as follows: Beginning at a point on the present centerline of Salisbury Road, said point described as follows: be- ginning at the northwest corner of Fractional Section One (1), Township Thirteen (13) North, Range Two (2) West, and running thence south nine (09) degrees and six (06) minutes west, along the centerline of Salisbury Road, and along said centerline extended, three hundred eighty-six and fifty hundredths (386.50) feet; thence south eighteen (18) degrees and twenty-two (22) minutes east, along said centerline and the extension thereof, six hundred seventy-five and thirty-one hundredths (675.31) feet; thence south twenty (20) degrees and twenty-two (22) minutes east, along said centerline and the extension thereof, two hundred two and four hundredths (202.04) feet to a point of curve to the right in said center- line; thence south sixteen (16) degrees and eighteen (18) minutes east, along a chord of said curve to the right, a chord distance of two hundred thirty-two and nineteen hundredths (232.19) feet; thence south seven (07) degrees and thirty-six (36) minutes east, along a chord of said curve, a chord distance of two hundred sixty-four and forty-eight hundredths (264.48) feet to the true beginning point of this description; thence, from said beginning point, south zero (0) degrees and fifteen (15) minutes east, along a chord of said curve to the right in the centerline of Salisbury Road, a chord distance of one hundred fifty-four and twenty- four hundredths (154.24) feet to a point of tangency; thence south two (02) degrees and twenty-seven (27) minutes west, along said centerline, four hundred forty-five and seventy-nine hundredths (445.79) feet to a point of intersection of said centerline with the centerline of United States Highway Forty (U.S. 40); ORDINANCE NO. 5-1978 Page 2 thence south seventy-seven (77) degrees and forty-two (42) minutes west, along the centerkine of said United States Highway, two hundred one and three hundredths (201.03) feet; thence south seventy-seven (77) degrees and forty-nine (49) minutes west, along said centerline nine hundred fourteen and ninety-seven hundredths (914.97) feet; thence north two (02) degrees and twenty-three (23) minutes west, eight hundred thirty-five and thirty-seven hundredths (835.37) feet; thence north eighty-nine (89) degrees and fifty-eight (59) minutes east, one thou- sand one hundred forty-three and ninety-one hundredths (1143.91) feet to the place of beginning, containing an area of eighteen and four hundred fifty-five thousandths (18.455) acres, there being ten and four hundred eight thousandths (10.408) acres in Wayne Township, and eight and forty-seven thousandths (8.047) acres in Center Township, Wayne County, Indiana. SUBJECT TO: The right-of-way of all legal highways and easements of record. WHEREAS, this Ordinance, being number 5-1978, was referred to the Richmond City Planning Commission for study and recommendation on the a v th day of January, 1978, and, WHEREAS, the Richmond City Planning Commission held public hea 'ngs on this Zoning Ordinance No. 5-1978 on the y day of ��u.� 1978, and after said hearings, the Richmond City Planning ommis- sion voted to G to recommend passage of this Ordinance No. 5-1978. NOW THEREFORE: BE IT ORDAINED by the Common Council of the City of Richmond, Wayne County, Indiana, that: SECTION 1: The zoning classification of the herein described property be, and the same is hereby changed to C-2 Community Business District. SECTION 2: This Ordinance shall be in full force and effect from and after the effective date of Ordinance No. 3285-1977.
