APPROVING SPECIAL EXCEPTION TLSE-2004-0019 VILLAGE AT
LEESBURG MULTI-FAMILY IN THE B-4 ZONING DISTRICT, TO
PERMIT 85 MULTI-FAMILY DWELLINGS WITHIN THE B-4
ZONED PORTION OF THE VILLAGE AT LEESBURG
DEVELOPMENT.
WHEREAS, Sandler at Leesburg Commons, LLC c/o KSI Services, Inc. has requested a
Special Exception to permit multi-family residential dwelling units; and
WHEREAS, the property is located in the B-4 - Mixed-Use Business Zoning District;
and
WHEREAS, on June 2, 2005 the Planning Commission recommended denial of the
Special Exception; and
WHEREAS, on October 25, 2005, the Town Council held a public hearing; and
WHEREAS, the proposed use fails to provide required information as part of a special
exception application as set forth in the Zoning Ordinance, and
WHEREAS, staff recommends denial.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows: Special Exception application TLSE-2004-0019, Village at Leesburg Multi-Family
Residential Within the B-4 Zoning District, identified in the Loudoun County Land Records as
Parcel Identification Number 149-18-2092-002 is hereby approved with the following
conditions.
1. Development of this property shall be in substantial conformance with the special
exception plan entitled "Special Exception for Residential within the B-4 Zoning
District", Sheets 1-5, dated October 22, 2004, Revised October 31, 2005 by Bowman
Consulting Group, Ltd. ("the Special Exception Plat") with reasonable allowances to be
made for engineering and design alteration to meet Town Subdivision and Land

PORTION OF THE VILLAGE AT LEESBURG DEVELOPMENT.
Development Regulations, Zoning Ordinance or Design and Construction Standards
Manual requirements.
Approval of the special exception does not express or imply any waiver or modification
of the requirements set forth in the Subdivision and Land Development Regulations, the
Zoning Ordinance, or the Design and Construction Standards Manual. Final plats,
development plans, and construction drawings are subject to the applicable town
regulations.
3. The landscape layout shown on the Special Exception Plat is subject to review and
approval by the town at Final Development Plan or No Adverse Impact Plan review.
Site lighting shall be in conformance with DCSM Section 7-670, which states, "All
outdoor lighting fixtures exclusive of street lights will not have a source of illumination
that is visible beyond the site or cause illumination of adjacent properties in excess of 0.5
foot-candles, as measured at the site boundary." Conformance with the DCSM limitations
shall be reviewed as part of Final Development Plan approval.

Architectural design shall be made subject to H-2 Corridor Guidelines and subject to the
review of the Board of Architectural Review. Architectural elevation drawings that show
the architectural design, materials, and colors of the proposed multi-family buildings
shall be submitted in accordance with H-2 Corridor Guidelines.
6. The use shall be developed in compliance with the use standards found in Zoning
Ordinance Section 9.3.12.

The applicant shall be responsible for any payments required to Loudoun County as a
result of developing unplanned residential units in accordance with the Annexation Area
Development Policy (AADP)
8. Parking shall be provided in accordance with Zoning Ordinance Section 11.3.
