Home My Public Portal About012-1978 - Zoning - North side of East Main St. between Woodside Dr and Gravel Pit Rd - from R-2 and C-2 to C-4ORDINANCE NO. 12-1978 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. WHEREAS, the Zoning Map which is part of Ordinance No. 2325-1968, designates and describes as R-2 One -Family Residence Dis- trict and C-2 Community Business District, the following described property located on the north side of East Main Street between Wood- side Drive and Gravel Pit Road, in the City of Richmond, Indiana more particularly described as follows: Being a part of the southwest and southeast quarters of Section thirty-five (35), Township fourteen (14), Range one (1) west, in Richmond, Indiana, and more particularly described as follows: Beginning at the point of intersection of the center lines of Woodside Drive and U.S. Highway 40; thence northwardly and eastwardly along the centerline of Woodside Drive to the point of intersection with the centerline of Gravel Pit Road; thence south along the centerline of Gravel Pit Road to the point of intersection with the centerline of U.S. Highway 40; thence westwardly along the centerline of U.S. Highway 40 to the point of beginning; except, TRACT I that part of the southeast quarter of Section thirty-five (35), Township fourteen (14), Range one (1) west, Richmond, Indiana, and more particularly described as follows: Beginning at a point on the west line of said Quarter Sec- tion and the centerline of Woodside Drive; thence south 00 26' west, five hundred thirty-two and eighty-five hun- dredths (532.85) feet to a point; thence north 880 00' east, three hundred ninety-three (393) feet to an iron pipe; thence north 870 24' east, one hundred seven and sixty-three hun- dredths (107.63) feet to a point; thence north 00 26' east, seven hundred twelve and seventy-seven hundredths (712.77) feet to the centerline of Woodside Drive; thence southwestwardly along said centerline to the place of beginning; also excepting, TRACT II that part of the southeast quarter of section thirty-five (35), Township fourteen (14), Range one (1) west, in Rich- mond, Indiana, and more particularly described as follows: Beginning at a point in the centerline of Woodside Drive, said 'point being four hundred ninety-five (495) feet east of the west line of said Quarter Section; thence south 00 26' west, five hundred sixty-three and nine hundredths (563.09) feet to an iron pipe; thence north 700 11' east, three hundred seven and seventy-six hundredths (307.76) feet to an iron pipe; thence south 00 22' west to a point, said point being north 00 22' east, three hundred seventy- two and fifty hundredths (372.50) feet from the centerline of U.S. Highway 40; thence east ninety-five (95) feet to a point; thence north 00 22' east, one hundred two and fifty hundredths (102.50) feet to a point; thence east to the centerline of Sycamore Drive; thence northeastwardly along the centerline of Sycamore Drive to a point, six hundred sixteen and eight tenths (616.8) feet north of the center- line of U.S. Highway 40; thence east three hundred twenty ORDINANCE NO. 12-1978 Page 2 (320) feet to a point; thence north 11 29' east to the centerline of Woodside Drive; thence southwestwardly along the centerline of Woodside Drive to the point of beginning; also excepting. TRACT III that part of the southeast quarter of Section thirty-five (35), Township Fourteen (14), Range one (1) west, Richmond, Indiana, and more particularly described as follows: Beginning at a point on the east line of said Quarter Section, said point being two hundred ninety-three and twenty-eight hundredths (293.28) feet north of the centerline of U.S. Highway 40; thence north 510 51' west, four hundred thirty- seven (437) feet to a point;thence south 850 48' west, eight hundred forty and eighty-eight hundredths (840.88) feet to a point; thence north 10 29' east to the Centerline of Woodside Drive; thence southeastwardly along said centerline to a point of intersection with the east line of said Quarter Section, also being the centerline of Gravel Pit Road; thence south along said line, four hundred fifteen and thirty-two hundredths (415.32) feet to the point of beginning of this description. SECTION 2. WHEREAS, it is the intent and purpose hereof to change the zoning classification on the above described area from R-2 One -Family Residence District and C-2 Community Business District to C-4 General Business District, and, excepting that, SECTION 3. WHEREAS, it is the intent and purpose hereof that Tract I shall remain zoned R-2 Single Family Residence District, that Tract II shall remain zoned R-1 Single Family Residence District and that Tract III shall remain zoned R-2 Single Family Residence District, and, SECTION 4. WHEREAS, a study of this Ordinance was conducted by the Rich- mond City Plan Commission the _2_ b t_A day of k'—"_c_ , 1978, at which time remonstrances were heard from all parties interested in or affected by this Ordinance. SECTION 5. WHEREAS, the vote of the Richmond City Plan Commission was to —L— in favor of/i recommending the passage of Ordinance No. 12-1978. NOW THEREFORE: SECTION 6. It is hereby ordained that the zoning classification of the above described property be, and the same is hereby changed to C-4 Gen- eral Business District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana, and all amend- ments thereto. SECTION 7. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. SECTION 8. The original zoning classification of the aforementioned area is hereby rescinded and the zoning classification of this area will be in accordance with Section 2 of this Ordinance.
