APPROVING SPECIAL EXCEPTION TLSE-2005-0004 CARR TANK
#2 MAJOR PUBLIC UTILITY, FORT EVANS ROAD, N.E., TO
PERMIT A WATER STORAGE TOWER/FACILITY
WHEREAS, The Town of Leesburg Department of Capital Projects Management. has
requested a Special Exception to permit a water storage tower facility adjacent to the existing
water storage tower on Fort Evans Road; and
WHEREAS, the property is located in the B-3 Community Retail/Commercial Zoning
District; and
WHEREAS, on October 20, 2005 the Planning Commission recommended approval of
the Special Exception; and
WHEREAS, on November 22, 2005 the Town Council held a public hearing; and
WHEREAS, the proposed use meets the special exception standards for a major public
utility as set forth in the Zoning Ordinance; and
WHEREAS, staff recommends approval with certain conditions.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows: Special Exception application TLSE-2005-0004, Can' Tank #2 Water Storage Tank
Facility, Edwards Ferry Road, N.E., identified in the Loudoun County Land Records as Parcel
Identification Number 148-46-9255 and 148-47-3304 is hereby approved subject to the
following conditions:
1. Development of this special exception use shall be in substantial conformance with the
Cart Tank #2 Special Exception Plat dated September, 2005, date stamped September 14,
2005, prepared by Whitman, Requardt and Associates.

WATER STORAGE TOWER FACILITY.
Approval of the special exception does not express or imply any waiver or modification
of the requirements set forth in the Subdivision and Land Development Regulations, the
Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as
specifically approved by Town Council or as shown as approved by Town Council on the
Special Exception Plat and supporting documents.
3. The private access easement depicted on the Boundary Line Adjustment Plat must be
vacated or relocated outside of the water tower parcel prior to site plan approval.
Site disturbance shall be limited to within the Limits of Disturbance (LOD) area depicted
on the Tank #2 Special Exception Plat dated September, 2005, date stamped September
14, 2005. Best efforts will be made to not disturb existing trees outside the LOD area.
The historic civil war trench shall not be disturbed.

Note #5 on the Carr Tank #2 Special Exception Plat dated September, 2005, date stamped
September 14, 2005, prepared by Whitman, Requardt and Associates shall be revised to
read as, "There shall be no site lighting except as mandated by Federal Aviation
Administration Requirements.
