HomeMy Public PortalAbout019-1978 - Amend General Penalty Provisions of Muncipal CodeU GENERAL ORDINANCE NO. 19 -1978 AN ORDINANCE TO AMEND GENERAL PENALTY PROVISIONS OF THE MUNICIPAL CODE OF THE CITY OF RICHMOND, INDIANA. WHEREAS, the legislature of the State of Indiana has determined that a second class City in the State of Indiana may not impose imprisonment as a penalty for the violation of a City ordinance; and, WHEREAS, it is the desire of the Common Council, of the City of Richmond, Indiana , to make the Municipal Code of the City of Richmond conform to the acts of the General Assembly in the State of Indiana. NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, WAYNE COUNTY, INDIANA, THAT: SECTION 1. Section 1.07 of the Municipal Code of the City of Richmond shall be and hereby is amended to read as follows: 1.07 GENERAL PENALTY PROVISIONS. (a) Standard Penalty. Any person, firm, corporation or agent or employee who violates any ordinance of the City of Richmond, including any provision of this code, for which no penalty is specifically prescribed, upon conviction, shall be fined a sum not exceeding $300. -ov--lath: for rte� more than (b) Costs. Each act of violation and every day upon which a violation occurs constitutes a separate offense. (e) Applicability. The penalty provided by this section applies to the amendment of any section of this code or any code adopted herein by reference whether or not such penalty is re- enacted in the amendatory ordinance. (f) Reference to Sections. Reference to any section of this code shall be understood also to refer to and include the penalty section relating thereto, unless otherwise expressly provided. (g) Failure of Officers to Perform Duties. The failure of any officer or employee of the city to perform any official duty imposed by this code shall not subject such officer or employee to the penalty imposed for violation of this code, unless a penalty is specifically provided. k. SECTION 2. This ordinance shall be in full force and effect from and after its passage, adoption and publication as provided by law.
