AUTHORIZING A TIME EXTENSION FOR COMPLETION OF
PUBLIC IMPROVEMENTS AND APPROVING A PERFORMANCE
GUARANTEE FOR ALLMAN WATER & SANITARY SEWER
EXTENSION
WHEREAS, The Allman Family Limited Partnership, the developer of the Allman Water
& Sanitary Sewer Extension has not completed all the required public improvements in
accordance with the approved construction drawings and town standards within the two-year
period agreed to in the contract for public improvements and previously approved time
extension; and
WHEREAS, The Allman Family Limited Partnership is working with Kid's Domain
LLC on the cost for installation of the water and sanitary sewer line; and
WHEREAS, the developer has requested a time extension for completion of the public
improvements; and
WHEREAS, a letter of credit from the Potomac Bank of Virginia in the amount of
$33,000.00 was provided by the developer to guarantee the installation of public improvements;
and
WHEREAS, the Town's Director of Engineering and Public Works recommends a time
extension to July 18, 2006.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:

IMPROVEMENTS AND APPROVING A PERFORMANCE GUARANTEE
FOR ALLMAN WATER & SANITARY SEWER EXTENSION
SECTION I. The letter of credit from the Potomac Bank of Virginia in the amount of
$33,000.00 is approved to guarantee the installation of public improvements at the Allman Water
& Sanitary Sewer Extension.
SECTION II. A time extension to July
improvements is approved.
