A SPECIAL ORDINANCE AUTHORIZING A SPECIAL USE FOR 2050 CHESTER BLVD. SITUATE
IN AN R-2 DISTRICT, TO BE A NURSING HOME.
WHEREAS, James E. F. Carter has petitioned the Planning Commission and Common
Council to permit a Special Use on a certain parcel of ground herein-
after described in Section 1 and zoned R-2.
WHEREAS, Article 21 Sections 21.01 and 21.011 of Chapter 22 of the Municipal
Code of the City of Richmond, Indiana, provides that a nursing home
is a permitted Special Use in an R-2 District, and,
WHEREAS, a notice was given and a public hearing on this Ordinance was conducted
by the Richmond City Planning Commission the 25th day of April ,
1978, at which time remonstrances were heard from all parties interested
in or affected by this Ordinance, and,
WHEREAS, the vote of the Richmond Planning Commission was 6 to 0
in favor of/in opposition to recommending the passage of Ordinance No.
22-1978, therefore,
BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as
follows:
SECTION 1. As provided in Article 21 Section 21.01 and Section 21.011 all pursuant
to Article 48 of Chapter 22 of the Municipal Code of the City of Richmond,
Indiana, the following use of the following described real estate is
allowed as a Special Use for a nursing home at 2050 Chester Blvd., in
the City of Richmond, Indiana, more particularly described; to wit:
A part of the South half of the Southeast quarter of
Section 20, Township 14 North, Range 1 West, in Wayne
County, Indiana, more particularly described as follows:
Commencing 548.18 feet West of the northeast corner of
said South half of said Southeast quarter section; thence
West 409 feet to the point of beginning; thence continuing
West 670.82 feet to a marked stone; thence South 450 West
23.26 feet to a marked stone; thence South 460.35 feet to
a marked stone; thence East 687.32 feet to a stake thence
north 470.44 feet to the place of beginning containing
7.26 acres, more or less and subject to all existing
rights -of -way and easements of record.
SECTION 2. Pursuant to Article 48 Section 48.03 of Chapter 22 of the Municipal
Code as a condition of the aforesaid Special Use the following require-
ments shall hereinafter and at all times be met by the owner,leasee, or
any person, firm or Corporation using such real estate.
SECTION 3. The Planning Director of the City of Richmond, Indiana, is hereby
authorized and directed upon passage of this Ordinance to record and
approve the issuance of an improvement location permit for the Special
Use herein allowed.

SECTION 4. This Ordinance shall be in full force and effect from and after its
passage and approval as by law required.

Re: Ordinance No. 22-1978 - Plan Commission Case PC-78-8 -
Heritage House of Richmond, Inc., 2070 Chester Boulevard,
requesting, a Special Use.
Dear Mr. Austerman, Members of the Council and Mrs. Trimble:
The Richmond City Planning Commission conducted a public hearing on April
25, 1978, on Ordinance No. 22-1978.
The petitioner, Mr. James E. F. Carter, was requesting a Special Use for a
proposed Nursing Home at 2050 Chester Boulevard. No one spoke in opposition
to the petition. Sixteen (16) letters had been sent to adjoining properties;
three (3) were returned in favor and zero (0) in opposition.
The Plan Commission voted six (6) to zero (0) to allow this Special Use with
the following conditions:
1. All surface and storm water drainage for the project be con-
ducted to the drainage swale at the west end of Heritage
!louse property;
2. that the engineering drawing for surface and storm water
drainage be prepared by a professional engineer subject
to the approval of Friends Fellowship and the City Engineer's
office; and,
3. after the construction of drainage swules and improvements,
the professional engineers shall certify to the City Planning
Department all construction was done according to specifications
outlined in the plans and drawings.
Commissioners Conley, Hunter and Tiano were absent.
