AN ORDINANCE AUTHORIZING A SPECIAL USE IN AN R-3 DISTRICT. BEING A PARKING
LOT SITUATE ON LOT-38 JC.
WHEREAS, D & W Real Estate Inc, has petitioned the Common Council and the
City Planning Commission of the City of Richmond, Indiana, to
permit a Special Use on a certain parcel of land hereinafter
described in Section 1 and zoned R-3 One -to -Eight Family Residence
District.
WHEREAS, a notice was given and a public hearing of this Ordinance was con-
ducted by the Richmond Planning Commission the day of
, 1978, at which time remonstrances were heard
from all parties interested in or affected by this Ordinance, and,
WHEREAS, the vote of the Richmond Planning Commission was to
in favor of/in opposition to recommending the passage of Ordinance
No. 28-1978, therefore,
BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as
follows:
SECTION 1. As provided in Article 21, Section 21.01 and Article 41.00, Sec-
tion 41.012 all pursuant to Article 48 of Chapter 22 of the Municipal
Code of the City of Richmond, Indiana, that the following described
real estate is allowed as a Special Use for a parking lot at 116-118-
120-122 North 6th Street, in the City of Richmond, Indiana; more
particularly described; to wit:
Lot-38 JC
SECTION 2. Pursuant to Article 48.02 of the Zoning Ordinance as a condition of
the aforesaid Special Use and as an additional restriction on said
use, the following requirements shall hereinafter and at all times
be met by the owner, leasee, or any person, firm or Corporation using
such real estate:
SECTION 3. The Planning Director of the City of Richmond, Indiana, is hereby
authorized and directed upon passage of this Ordinance to record and
approve the issuance of an improvement location permit for the Special
Use herein allowed.
SECTION 4. This Ordinance shall be in full force and effect from and after its
passage and approval as by law required.

Re: Ordinance No. 28-1978 - Plan Commission Case PC-78-8,
D&W Real Estate Inc., requesting a Special Use at
property located at 116-118-120-122 North 6th Street.
Zoned R-3.
Dear Mr. Austennan, Members of Common Council and Mrs. Trimble:
The Richmond City Plan Commission conducted a public hearing on May
23, 1978, on Ordinance No. 28-1978.
The petition, represented by Mr. Homer Henry, President of D&W Real
Estate, is requesting authorization for a Special Use for an off-
street parking lot accessory to Fifth Quarter Restaurant and Lounge.
No one spoke in opposition to the petition. Seven (7) letters had
been sent to adjoining properties; none were returned.
The Plan Commission voted five (5) to zero (0) to allow this Special
Use with the following conditions:
1. The site plan accompanying the petition be identified
as Exhibit "A' and made a part of Ordinance No. 28-
1978; and,
2. That the petitioner consult with Richmond Pacer and
Light to determine the appropriate type and location
of lighting for the off-street parking lot.
